Here we go with another adventure in DMV ***le land. Some neighbors split up and both moved away. They left behind a 78 Chevy 3/4 ton pickup with a 454 & turbo 400. Only 82,000 miles on it - was a camper truck not driven all the time. I was able to contact the husband & he said it was his wife's truck. Okay, I contact the wife, gave her what she wanted for the truck. Had the ***le notorized with her signiture because the ***le said "and/or on it". I went to DMV, almost got the ***le transfered - suddenly it all came to a stop. The lady said that even though the ***le says and/or it does not really mean and/or. Okay now this made about as much sense to me as an old episode of the tv show Taxi where Alex explains to Jim that it was a blue berry - not a blueberry. I admit I may have felt about the same as Jim at that point. Anyway, she said that just means if one spouse dies the other gets ***le to the vehicle......then what I needed to do was contact the ex-husband and have him sign the ***le & get it notarized again....2 weeks later...he called & we got it done today. Summary; in Arizona don't get caught up in that and/or on the ***le like I did. Oh, by the way the 454 will get some minor mods; pistons, heads, camshaft, manifold, carb, headers & find a new home in a 1949 Chevy 2 door sedan.
Every car I have had here for the last 30 years has been an OR ***le. With and/or.. AZDOT "AND / OR" Legal Status This ownership is a joint tenancy with right of survivorship. The owners' names will appear on the ***le as in this example: JOHN DOE AND/OR JOE ROSS To transfer ownership of the vehicle, license plates and/or fees, or to record loan information, the signatures of both parties will be required, if both are living. Upon proof of death, the survivor may sign alone.
Depends on how and what you're getting a ***le for. If you're building something from 'pieces' they (DMV) may require proof of ownership of the "major" parts. i.e. engine, transmission, frame, body, etc. They absolutely do this when you show up with say a "T" with aftermarket frame. The DMV here in OK will do the same thing. Normally, bill of sale and receipts will do for components but if you happen to draw a wacko...... all bets are off. Oh, and as for the and/or statement in AZ, it is used ONLY for awarding property to the SURVIVOR upon death of the other (without probate). Its not used for sale of property if both parties are alive.
Isn't there an "OR" feature to ***les? Seems like that one allows either party to sign off the vehicle. When things get weird, gather up all the papers and try a different DMV. Preferably one in a small town.
That's for sure! I have a cousin in Tucson that did the and/or thing with an ex-gf. He went down to the DMV with only his signature - they changed it to his name only without a fuss at all. Also, I had a ***le thing going with my 55 chevy. I went to the first DMV and I didn't get the answer I wanted. So I went to a second DMV and got the issue taken care of. Arizona DMV = if the first answer isn't what you want (right or wrong) then just go to another DMV.
The notary thing is very important in AZ for some reason. And means and, or means or. Put both on there and you will cause issues. They also want to inspect vehicles changing ***les from out of state. Hard to do when your vehicle is under construction on jack stands in the garage. The AZ MVD makes it extremely difficult to do ANYTHING with just one trip to their facility. In California, AAA could do almost every function of the DMV in their plush office that has comfortable couches and a TV, along with people fairly happy to be at work. If AZ is so hard up for money, why not let the Auto Club do some of those things here??? I have changed plenty of ***les in AZ in the last 6 years, but they all said OR. These days you should have the spouse on the ***le of the vehicle that he/she does not typically drive to avoid the radar/tax cameras.
No, but you do need to have the ***le in your name to get rid of the rest of the truck. In alphabet soup terms, AZ DMV is a PITA.
If you were anywhere but benson, you could have just brought the ***le to a different CLERK on another day... I imagine that in Benson there might only be one clerk... Only would have been a short trip over to Sierra Vista...
If your building a old car (not a new one from scrarch) call a ***le service for about $50 they will come inspect the car and do all the in state/outa state paper work.done it a couple of times
I just returned from DMV 17 minutes ago, trying to convert a bi-fuel van into gas only. How ****in fun this is. Now I gotta go back and try again. One hand doesn't know what the other hands doing. At least I get paid, it's a UofA van.
completely agree... i never have any trouble of any kinda at a smaller DMV office. things go faster (hardly ever a line) the people at the counter actually do help you and they overlook a lot of BS
That is a handy bit of info. I just called and set up an appointment for Tuesday. The girlie lives close to me and will only charge $25. Since they are a level one inspector, the VIN must be in two locations. I will be "locating" the VIN on my frame, since I do not believe Chevy did any other ID on their trucks besides the driver door frame........... I really want to fire it up and roll it over to the neighborhood car shows on its first test drive, rather than waste time at MVD. I also want to get a good personalized hot rod plate while the gettin' is good!! I am lucky the VIN was in two places on my Model A when I had it inspected. Apparently only one MVD in town is a level 2 inspection station...................
Im in the fight of my life with a new off road rig I just built. Picked up a jeep in CA and did a frame swap on it. Since there is no vin on the frame DMV called the cops and had my Jeep impounded for a week while the cops looked to see if it was stolen. Just got the Jeep back. Now DMV is saying they will not give me a ***le because there is no VIN on the frame... Cops are ok with it not having a VIN on the frame and called the DMV and were told the same thing. I now have a Jeep that has a few hundred hours into it and a few thousand $$$ invested that I cant ***le. Fawk me!
dont know about the two.hell they only checked for one on my 56 chevy and my 39 pontiac,dont worry about two...however I would make sure it has "aged" correctly
I put and/or on all mine in case something happens to me she can do something with it otherwise it gets all caught up in probate. You know those DMV People are like fish in my Aquarium, They are just testing the area and do what they can get away with just to see if they can be the King Fish someday. Good luck with the 454
get a power of attorney letter sent to you from anyone you need to sign off on something and legally sign their name yourself without them being there.
You got something else to worry about re surviving spouse on ***le in AZ. You'll need to provide hubby's death certificate, only guess what? You are not en***led to his death cert., only a relative is, LOL. So get the survivor to provide the death cert. or a certified copy of the distribution of his estate, showing her as heir to the car.
