The guy that dug the trench for my electric when I built my house left his trencher in my driveway for 3 months. I contacted my lawyer stating I had called telling him to move it every month and he did not. Guy claimed it would not start, but I had been using the backhoe for 6 weeks. Lawyer told me to put in writing that if he does not come remove it from my property in 30 days, he will forfeit (sp) it to me. He showed up the next week to get it. This was Minnesota.
I cant believe how common this is..I have read about this on here..heard about it from friends, have heard it brought up in conversations thru-out my life..it makes no sense to me..goofy people out there spending money(even if its a down payment ) and never coming to get their purchase and yet..its still your call. you can do what ever you want..possesion , no paperwork? i would say its yours to re-sell, or if you feel compelled to call the guy and give him one last shot at what he spent his money on, than thats mighty nice of ya. After that, You can do what ever you want with it.

I sold an international tractor on Ebay 3 years ago to a local guy who paid and never has come for it. I gave a lawyer $350 to make me a will and he never did but his 1956 Chevy 2 dr station wagon has been sitting on my property for 5 years. I talked to a traveling salesman who bought 1957 chevys when he traveled. he also drank too much. One time he stopped at a farm house and offered to buy a 57 and the farmer told him that he sold him the car a year earlier and wondered when he was gonna come get it. A friend sold a T bucket to a guy who smelled of alcohol. The buyer also paid for extra fenders but didnt take them nor did he ever come back for them.
All of the advice posted previously makes sense --- but --- your best bet is always to check with a lawyer with your specific situation and the laws in your specific jurisdiction. For example, to make sure your bases are covered when the buyer decides to sue you in small claims, and it is his word against yours. Or when you resell it (in the situation where the guy just wanted the title) and now you are selling something that does not belong to you. Make sure your bases are covered! There are plenty of rats out there that like to twist the system around for their own selfish reasons.
you have recourse, contact ebay, if it went through paypal even better, I would still check your local laws also, that should take you 10 min. by phone.
