    yes, the very cool fire department helped me bend the trailer back to a usable piece and we got the motor picked up. i'm no candyass.
    had the girls checked out first of course.
    state cop was a hot rodder too

    I lived in Minnesota when "no fault" was started. When you read the fine print, what it amounts to is a pree pass for the insurance companies. They are not your friend, but the law says you have to have it. Catch 22.

    forced by law to have it..and they can charge you whatever they wanna...bastards:mad:

    Yup,they are all in bed with each other because they are smart.Just like sharks,they pick out a prey who is a loner and go into a feeding frenzy.
    That's whay on any vehicle ya really care about it's important to have adequate comp insurance.
    Well,at least it's good the guy here with the 430 at least got the engine home.

    This is my first post so don't come down on me too hard. First of all, I am an unemployed claims adjuster in Georgia so we don't have no fault here. It seems like a strange concept to me but it's not your insurance company that's the bad guy here. Michigan's government decides what type of coverage they will have in their state so if you want to blame someone, blame your politicians. The insurance company is correct but they will subrogate against the at fault party to get their money back. I hate to advise anyone to get an attorney because they don't do shit but in this case, I think you're going to need one. If the boy died, an estate will have to be set up which takes a long time and he probably didn't have anything to get so you would need to go after his carrier as well. You also have punitive damages because he was drinking (some states don't have punitive damages so you need to look into that because if Michigan does, that's where you can really nail them. Also look to see if he had any prior DUI's). All of this is above the average persons abilities so I would get an attorney to help you along. You have lost wages as well along with pain & suffering so if I had your case here, it would be a policy limits case (good for you). The boy probably had low limits so you may have a claim with your insurance company depending on what your policy limits are. Again I'm not familiar with no fault but it sounds like a pain in the ass! My point is the insurance companies aren't the bad guys here, they're simply following what your state has voted into law. Down here if someone is at fault, their company pays for everything. Hope you and your family are OK and things work out for you. Rick

    Get an attorney and have him/her handle it. No fault is simply for the automobile, not the personal liability. You have to take civil action against the person. If he had no insurance, you will actually sue your insurance will have to pay under your un/underinsured coverage. You should pay nothing out of your pocket while this is going through the courts. GOOD LUCK

    Personal Injury Protection (PIP)
    This part of your no-fault policy pays all
    necessary medical costs if you are hurt in
    an auto accident. It also pays, up to a
    maximum amount, wages you would have
    earned if you had not been hurt, for up to
    three years. This amount is adjusted each
    year on October 1st, and you may wish to
    contact the bureau to determine the current
    maximum monthly amount. As of October 1,
    1999, the amount was $3,760.00 per month.
    If you are killed in an accident, your policy
    will pay your family up to the monthly
    amount for three years, based on your
    earnings and fringe benefits. You may also
    be entitled to up to $20 per day in
    replacement services. This is to pay for
    services you are no longer able to provide
    for yourself or your family because you are
    injured, such as housekeeping and yard
    work.
    You may coordinate PIP coverage with other
    health or disability coverage you have to
    reduce your PIP premium. Medicaid,
    Medicare, and some self-funded health
    plans, however, do not allow coordination
    with PIP coverage. If you do coordinate your
    health coverage, and you are injured in an
    auto accident, your no-fault policy will pay
    your medical expenses or lost wages after
    you have used all the benefits under your
    health or disability plan. When you
    coordinate, these auto insurance coverages
    may be called excess medical/wage loss.

    I would still call a lawyer to find out the real deal here man. It is complicated. No sense in getting banged up in an accident then getting screwed. I would assume an Indiana lawyer has had to deal with this in the past.

    Super Plus, they never told me why I was fired, they simply told me resign or be fired. Since then I've had maybe 7-8 interviews in a year. It's tough down here in Hotlanta. Unemployment doesn't allow much spending on my cars.

    Get a lawyer! Here in Ct. we are a no fault state. My wife, Jeanne, was hit in the drivers door as she sat stopped at a red light. An old guy came around the corner too fast. He lost control in his Ranger pickup spun so he was aimed at my wife in our 84 Delta and proceeded to plow into her door. She was injured in her shoulder. She did require surgery. We did have a lawyer and sued. Most of the award came from our insurance co. The rest came from his insurance co. No doubt our company sued his company to recover what they gave to Jeanne. We still have the same insurance and have never had an increase in premiums. We had no accidents prior nor since. You can say we drive like old people? Anyway don't waste time and get an attorney now.

    In some cases, you're in a better position if the "at-fault" has NO insurance (if you have un-insured motorist).

    But the bottom line, is to avoid the internet lawyers and find a really good (oxy-moron?) lawyer. Good luck. Stu

  27. "down here", we have uninsured motorist coverage---it's a rider on your policy that's basically insurance in case you get hit by somebody without insurance, even though it's law that you have to have insurance :eek::confused::rolleyes: And yeah, it costs extra.:(

  29. no it's just plain stupid!!!!!!and i've been told that the voters of this state are the ones who passed the "no fault" shit.....drive around up here and ya can tell it's a no fault state...damn near everyone drives like they are crazy!!!!!!
