Sales tax on used parts and why...

    So if I join the HAMB Alliance I should pay my state sales tax on $50? Ummmmm! I'm sure I will do that.......................

    Membership fees and services and the like are not subject to sales tax.

    Our wonderful State now has a tax on Internet purchases. Its a section of the State Income Tax form. Starts with 'list description and price paid for all items purchased via the Internet" and goes downhill from there. Of course some business charge the sales tax on sales over Internet (if they have a location in the State). Of course I don't buy ANYTHING off of the Internet..........

    Many states have "Sales Taxes" and "Use Taxes".
    If you purchase something in a tax-free state and transport it into a taxed state and USE it there, you're supposed to remit the taxes.

    Example: You home state taxes clothing sales. You cross state lines to buy clothing tax free in a sister state. Upon your return you're supposed to pay the tax to your home state.

    The same is true if you buy over the net. Upon delivery of the taxable goods you're supposed to pay sales/use taxes to your home state.

    Failure to pay the taxes is like bootlegging booze. Even after prohibition ended, it is still illegal to transport liquor across state lines even for personal consumption. The reason: every state taxes liquor differently.

    Michigan has all the previously mentioned taxes. But the one that gets me (and customers) is I have to charge sales tax on core charges. But no refunds on tax when core is returned. :eek:

    I sold tires for a number of years in Illinois,Oregon and California,Oregon does not have sales tax.If I had a nickel for everytime people bitched at me about adding state sales tax on the total plus Federal excise tax I could afford to have Foose build my project."You're taxing a tax? what the Hell is that all about!":eek:
     
  8. New York does this too. They set it up so you could either add it all up and pay, or just pay a default $20. Then they got greedy and went after like Amazon.com and other online retailers that sell here but have no location here, claiming their internet site was a "virtual presence" and demanding they collect sales tax and remit it to the state.

    The last I knew that had gone to court, but I can't remember if it had been ruled against NY or what.

    It's also a part of why sites like eBay don't want you to pay with money orders - there's no real record of something like that for them to easily check to find out you paid someone out of state for a purchase they can tax you for.
     
  9. No sales tax in Oregon. On anything! (We make up for it by paying the highest income tax in the country.) And we have some really good swap meets, etc, so come and spend lotsa cash. Keep Oregon Green!!

    Not that I agree but it is called SALES TAX, not new parts tax.

    It will be applied to Sales regardless of new or used. We allow the idiots in power to do this.

  12. Remember, boys and girls, WE elect the assclowns that pass these laws, allow unelected bureaucrats to enforce them with whatever "interpretation" they see fit, and on and on. It's time to FIRE the people that are in these positions of power, and elect people that will actually uphold the Constitution! People that will actually gauge success by rescinding unfair laws and statues, versus how many laws they put ON the books!

    You are correct - that part of the law is the "Use"tax (Sales and Use Taxes). If you buy something that is taxable and no tax is charged you are supposed to report it and pay the tax. Businesses usually have no other option but to report it (subject to audit), but buyers like us that buy things occasionally from out of state don't usually do it although the obligation is there. Technically, we are also "subject to audit" but it is not worthwhile for the state to do so. In some states the income tax form has a place to report out of state, non taxed purchases and pay the tax.

  15. You know, it's not that I even mind paying some tax, the country needs a military, police, jails and stuff and that has to be paid for too. I just object to taking it in the shorts on both ends, on everything, with no control whatsoever where the money goes or how much they take.

    Nobody like to pay taxes, but taxes are the price we pay for a civilized society. Without taxes we would have no police, firemen, garbage collectors, social security and hundreds of other services that our taxes pay for.

  19. Other services like flying two 747's plus backup planes to haul the limo's every where the man wants to go. Think one of the first trips was DC to Richmond Va. Think it was like 117 miles. How many duce roadster that cost.

    our fearless wuss of a leader already is trying to do this with a garage sale czar, not kidding dead serious. He wants to make sure all taxes get collected at garage sales and wants to regulate them. not trying to go political, but this is getting crazy. this is the reason they keep talking about getting rid of paper money, so they can track every last cent you own.

    California can top all the other States:
    10% sales tax on used cars, AND if you move there and bring your car, you have to pay sales tax if you haven't owned it a year before you got there.

    We have it here in the Netherlands in fkn Europe... Every 19% of it!
    They wanted to up the percentage to 20 last year but cancelled it, well postpone it is a better word, because of the recession.

    What exactly does any of this whining and carping have to do with hotrodding? As long as we're bitching, I'd like to see all you guys complaining about your taxes pay for your OWN public safety, streets, sidewalks, maintainance, kids grade school and prep school education, liberaries, state parks, highways, colleges, federal highways, defense, and on and on and on. Shut up already. Lets talk about cars...

    i dont think anybody here is against paying for the benifits we get as americans. i know im not.

    its the over payment,like 3000 dollar toliet seats, and free healthcare to illeagls and the myrid of waste that goes on. sure i'll pay my share, i jus dont wanna pay someone else's and hookers for the politicians, lol

    When all is said and done,,how many here have actually paid tax on used stuff you may have sold online,,or at a swapmeet?? I would venture to think the % is quite low
