dannyego was right. The number on the citation doesn't refer to anything noise related. 17.108.130 Penalties. They are after you for zoning violations not noise if I'm reading this right. Go to bottom right havd corner of this form and it states zoning code 17.108.130 http://www.discovercorona.com/do***ents/communitydev/Land%20Use.pdf
until you actually get charged, you have nothing to fight i.e. a fine. if you do get charged, they have to prove what 'EXCESSIVELY NOISY" means.. theres got to be a decibel limit that has to be exceeded probably for a certain length of time.. just like here, calling about a barking dog gets you nowhere unless it barks "excessively'" here its more than 15 minutes...but all dogs bark, and everybody makes a little noise sometimes "excessive" is arguable..its the length of timne that makes a difference.. then they have to catch you doing it..either way..until you are charged you cant fight it... hope this helps
I bet the code enforcement officer was supposed to visit the neighbor doing the construction on their house/property instead of riding your ***. Should be interesting to see how you make out.
i got another story about cod enforcement...my neighbor (renter) parked their junk minivan on my peoperty(side yard) and tore up my gr***...i called c.e. and they said all they could do is fine ME since its on my property and thers no way for them (village) tot tow it and they dont do that they just ticket the owner of the property the junk vehicles on..and they dont care who owns it....so i said what if i dont pay the fine ,then what happens? oh we put it on your prop. tax!! so, i had the junkyard come get it...and what happens?? i get ARRESTED!!...vehicle theft and criminal mischief!! my property..i i thought i could have it towed...but i guess i couldnt...so i was arrested put in jail..and in the end i pled to disturbing the peace...the pub defender said i got screwed...uhh yeah!! i asked the judge what i should have done..no answer..i ask what if i put my junk car on YOUR front lawn?? you touch it i can have YOU arrested??? well.. judges dont like smart***es.. i still dont understand any of this..anyone had similiar exp[erience??
LIE! call in on ALL of your neighbors, complain aobut them mowing at night and shooting guns and having loud partys ( who the **** cares if it's tru or not?)
Thats bull I would let go from house to house and find out who. I had an annoying neighbor Several times she called the cops. I brought in a dodge dart 4 door into the garage. 3 days later the wrecking yard came and hauled of a shell. Next dat san bernardino sheriff and chp came to search my house cause I was running a "chop shop".6 Months later I had the san bernardino fire department over cause my wife came home with a leaky radiator. Someone tried to bust me for hazardous waste. code enforcement tried to give me a ticket for 1 string of clear mini lights I had on the very top of the roof. The final straw was when her kids decided to drag race up and down the street in their honda. 2 more of San benradinos finest came ready to tow my car for illegal street racing. I opened the garage told them to go ahead and that they better stop at the machine shop and pick up the motor too. Damned if they didnt lecture me for racing.... @ days later her kids were arrsted for hit n run while they were drag racing.
Um this code ****s balls: Corona, CA Municipal Code 17.80.020-H: "(H) There shall be no operations in connection with the home occupation that create excessive glare, dust, odor, vibration, noise or interference with any radio, television, or electrical equipment beyond the boundaries of the subject property. Music studios must comply with the noise standards promulgated in § 17.84.040 and may be subject to soundproofing." No hours are specified. Might be time to move. and your saying that the neighbor didin't file a false report? fire with fire my oh so law abiding sheepish friend. do you narc out friends to?
Its about interpretation! The way this is written it is saying you cannot even mow your lawn, use leaf blowers or do any home repairs with(saws & drills and such)I bet if you look you will find a contridiction to this code in the list of codes.Where do you live?Gated community or townhouses or something?Do some more digging,or plan on extremely tall gr*** my friend!
Dude that ****s. I hate annoying neighbors. That is why I live in the country. Most of my neighbors are trees and deer. This is what I get to look at around my place There is one 90 year old lady across the street who bakes me cookies sometimes. Guess I got it pretty good
That's flawed without a decibel limit. The way its written leaves the interpretation of "excessive" up to an individual instead of a noise monitoring device. So a code enforcer that's hard of hearing would say one thing while another code enforcer with a migraine would say something quite a bit different.
If you have an air compressor running a lot, the sound from that can carry a long ways. If you don't have one you might think about building an insulated room for it with just vents for airflow. <input id="gwProxy" type="hidden"><!--Session data--><input onclick="jsCall();" id="jsProxy" type="hidden">
One more point that has not been mentioned is the original complaint. This part is going to make you unhappy. It's part of the reason I moved. Say you have Agnes Crotchety call and complain. The city sends out enforcement. THE OFFICER then looks over the situation and cites you. The OFFICER is the legal complaintant, not the biddy. Sure the biddy was the instigator, but her name will never be provided to you and you will not be able to face your (original) accusor because it's now the OFFICER! Corona CA is a known tight *** community. Even if you win this battle, you cannot win the war there. I wish you the best, and I hope that you can close the door, get this stain off your permanent record etc., but you should take a good long look at finding another community to be a productive member of.
Making peace with your nieghbours will be the best outcome, including others that are yet to complain. Seeing it as a battle is unlikely to see you come out in front. If you do go door knocking do it with a smile and an at***ude of slight embarr***ment that you have pissed someone off. If it was me I'd wear nice clothes that hide visible tatttoos. This way you may be able to negiotate an outcome agreeable with both parties. There has been several threads on similar issues, including ways to reduce noise. This ISNT being a *****, it being smart. I've salvaged a similar situation this way.
Hey, I don't know 'bout Corona, but in Long Beach you cannot repair vehicles in a residential area! Grinding, welding and running a comperssor for the purposes of vehicle repair will find ya in violation of several codes! If they return, you can be cited for for the noise complaint & the other code violations. I would call your city code inforcement office and ask to speak to the officer who wrote the ticket/notice. Ask him to spell out just what is/isn't in compliance with regard to the codes. Maybe he has a suggestion or two on how everyone can come up a winner on this one? DO NOT GO door knockin' about the neighborhood, or gettin in anyone's face over this matter. In California, jus' muther****in' your neighbor can land your *** in jail if your actions are seen as a threat! Also, if you find out who issued the complaint, do not talk to them without someone else there with you, a friend/family member, and any action you take against your neighbor could get you in deeper/expensive legal trouble! But when I find out which one of my neighbors was the one givin' me all the greif with the city over the years, I'll probably make a lampshade of their hide, and eat their liver with fava beans & a nice chianti! good luck, S****y Devils C.C. " Your head would look good on a pike!"
I'd fight that one 10.00 pm in my neck of the woods .I usually don't grind after 8.00 pm my self .Daytime no regulation ,I think it might be your township trying to get a few dollars from you.
Local State and Federal are all going broke. Here in Missouri they p***ed a statewide law stating that any town of less than 2000 pop. can only make 35% of there town revenue off of speed traps and towns over 2000 pop can only make 45% of town revenue off of speed traps . They are finding new ways everyday to make money by robbing the citizens everywhere .
Your best bet is to work with the door closed when making any loud noise and you should not have any more problems with the city. If they cant see ya,they are not going to bother ya. Most likley you have a neighbor that is not hot rod freindly and has nothing better to do with there time.
all of this is why i don't live in the ****hole state of california anymore. appologies to you folks in cali, i mean nothing ill of you by my opinion. having lived in san diego for 4 years, i garnered a severe distaste of california. too many ******** pandering laws to "protect the peace" that do nothing to preserve the freedom.
Buy a 100 dollar two stroke leaf blower mix some gas fill it with oil and run it from 9 am till seven pm with a sign saying , who ever called we should talk..
There's your controlling statute. Ouch, hard to fight that one. Sure, it's easy to sit here at your computer and say that you're going to fight it, but are you really going to win a legal argument in court on the theory of overbreadth? Probably not. Since you're probably in the wrong, taking a hard approach to the issue is not going to do you any favors. Sometimes you get more bees with honey. Try to keep the noise down. Maybe seek out the officer that wrote the ticket and get some guidance on staying within code. Raising Hell will do nothing but piss people off and bring more pain on yourself
I would have told them to get F**KED but that's me and I don't live in Ca. for a reason . You have too many damn stupid *** laws for me . I live in Pa and don't have that problem plus they couldn't here me grinding over the f**king neighbors dog that they put on their back deck that barks non stop for hours all day long and no body wants to do a thing about nusince noise . Just close your garage door and turn the radio on loud ! I am sure who ever called on you was watching out their window when they came to your house . When you can figure out who you pissed off , stop in front of their house at 1 am at night and open the headers on you car and rattle the **** out of their windows and the leave . RetroJim
