  2. The deposit should be in your pocket!!!! Your time and effort is worth something, and there was no effort to make a viable reason for not purchasing the car on his part. I'll be the first to understand if a guy has true problems in finishing a deal, but just a jacker and a dreamer like this guy, needs to be tought a lesson!! Just think, If you had kept his deposit he might think twice before pulling that crap again.;)

    Good post wingnutz, there are always 2 sides to a story. I'd like to add because you understood the down payment was the seller's, you did not go back on your word at all. Congrats to you sir, in my book your integrity remains completely intact.

    In reference to other posts, I'd also good-naturedly suggest there is nothing less gentlemenly about conducting business properly. A deposit protects the seller, and there's no lost honor in keeping it.

    When I sell anything it is cash only!
    In the few instances I have taken a deposit, I make it very clear It is non-refundable.
    Taking food out of his kids mouth or from bills?
    That is what the buyer must think of before the agreement to buy is made.
    We are talking about a contract here. Whether written or verbal, it is a contract, never the less.
    A sale is a put up or shut up situation.
    Any one backing out on the sale invalidates and makes worthless his word.

    I can think of at least 10 times where people have told me if they could get "car, truck, motorcycle sold" that they would come and buy my car. I have never had one of them show back up yet. Bunch of tire kickers!!! Just resold one the other day that a tire kicker left me a deposit on. Guess what he isnt going to get it back. He was going to finish paying with last years tax refund. What a joke. I think the guy is lucky you dont have a quick temper. I would have expected to take a beating for pulling shit like that!!!

    I have an add to sell and old engine short block and this guy has emailed me about it a 1/2 doz times with idiotic questions, the last being does it have heads on it. I emailed him back with my 1/2 polite response and have not heard back from him, almost make me want to just take all my unneeded stuff to the recyclers.
     
  12. To me, the whole idea of a deposit means it is non-refundable and makes up for the time effort you have put into the transaction as well as turning away other prospective buyers.

    I once sold a car three times. I plainly stated that I required a $500 deposit and that the car needed to be picked up and paid in full within thirty days. Two different guys paid the deposit but then couldn't finish the deal. I made an extra grand!

    If the shoe had been on the other foot and it was me that couldn't close the deal, I would expect the seller to keep my deposit and I wouldn't be pissed either. That's what deposits are for.

  14. I'm going through a deal right now with a newb on my old truck. He was playing mister big I guess. Going to fly in with the cash and drive my truck home. Never happened. Then another PM, waiting on bonus. Another PM, does it have a 4-link(suspension is detailed in add). Going to borrow from girlfriend. I've PM'ed him 2 times this week, no response. Game players. Deposits are yours to keep period. Good luck with your sale and cross your fingers for mine.

    Never deliver them, never give back a deposit, never let them even start loading the car without all the paper work being done. You're playing too nice.
     
  16. You could have kept the deposit, but chose instead to take the high-road. It was yours to give back and you did - didn't have to, but you made the decision.

    What really irks me about these sorts of things was all he had to do was be honest - BEFORE you loaded up your car and headed his way. Some people are just so chicken-shit to deliver bad news . . . as if a big bag of money was going to fall from the sky and land in his lap before you arrived. Just took a simple phone call. :cool: Wanker . . .

    The bad part is your pissed and wasted your time and it probably didn't even bother him at all as he was out basically nothing.Sorry you had to deal with this kind of person but beware there are more of them out there.

    I have no problem accepting a deposit or leaving a deposit on a vehicle. Regardless of whether I am the buyer or the seller, I always get everything in writing so there can be no misunderstandings.
    I do have one thing to gripe about on this thread though. I have seen several people say something like "bring cash and a trailer or it is still for sale". I rarely spend the money to drive a truck/drag a trailer to look at a car that is more than 20 or 30 miles away. This has nothing to do with being serious or not. It is because out of the last dozen or more cars I have gone to look at, only 2(which I did buy that day btw) of them were described remotely accurately. Why spend over twice as much in gas just to be lied to. Like the '56 Chevy that my dad and I drove 5 hours to buy only to find that the "solid, no rust fenders" had holes in the eyebrows big enough to put your fist through. Or the countless "good, solid" cars that "have not had any previous bodywork" and you get there to find the bondo filled panels coming apart all over.

    Deposits stay with me no matter how expensive your kids surgery was. If your old enough to buy and sell your old enought to forsee any hinderance to the transaction and take appropriate measures before hand. X2 on no loading before the transaction is COMPLETE.

    Threads like this prove that there are assholes on both sides of transactions at times.

    This includes the comments of "The deposit is mine and I'm keeping it".

    We are all human and sometimes things don't go as planned.

    In some places there are laws that prevent you from screwing someone over for a deposit, so look at that before you boldly claim I'm keeping your deposit.

    I have dealt with all kinds of people and as I said there are all types. There are the kind who will appreciate what you are up against and go out of their way to help (within reason of course) And also those who don't give a shit about anyone but themselves.

    Both of these types have posted here.

    You were a nice guy to deliver it. HOWEVER, when he renegged you just strap it back drive and drive away. YOU keep the deposit. He knows how to get ahold of you and come up with the rest of the money. Also, he comes to pick it up himself with CASH!

    Been selling old iron for over 40 years and I used to be the nice guy and give the deposit back, but that backfired on me one time and ever since then I have kept the deposit. I always get at least 25% down when I'm selling a car. I get 50% down on the chassis I build with the balance at shipping. Only thing with taking that kind of deposit is you better be able to deliver as promised or dam close.

    In this digital age where a guy and a gal can't go 5 minutes without talking about the nothing of their day it is so rude, ignorant and thought less that the buyer would let this man load the vehicle, drive it all the way to his house on a trailer and then try to pull a plea deal on him that it's so totally unacceptable that the buyer did not contact this guy to tell him that the deal went sour. This seller seems like a genuinely nice guy and it is a shame that he had to run across a buyer like this. I think it genuinely sucks that this buyer could not be square and say hey buddy please don't drop that car by today some bad stuff has happened can I please stop by and possibly have some of my deposit back? Had this been the case or the dialogue I personally would have said yes, no problem. But to let the poor guy bust his ass and haul it and then play games. The poor guy has to haul the car back home tell his wife that the deal went south and go for a couple days with that sick feeling. Sorry to disagree with you Blue One but do unto other ass holes as they do unto you. If you can drive away with that car going back to the house and that dim diddle buyer laughing with his neighbors at you as you drive away watching him giggle in your rear view, Bless you sir, cause I would need the warm feeling of a Ben or 2 in my pocket keeping that disrespectful guys face somber. Further, if I had you coming to my home to deliver an automobile to me and you had requested a reasonable deposit, I would insist that you covered all of your expenses at the very least possibly even consuming and requiring more than the actual deposit amount including your time, fuel and all costs,and personally apologize for being so ignorant as to not have been able to contact you so as not to waste your time. I would respect you sir.

    Blue One you mean to say that if a guy gives you a deposit on a car then wants you to deliver it on your own dime and time.You do all the work and cost ,pull up in his drive and he backs out of the deal.You are going to pat him on the back and give him his deposit back.Come on dude,get real.
