Bum deal on a motor I bought

    Been way too long now to expect him to do anything for you. How would you feel if you sold something and a year and a half later the guy came back to you on it?

    We have all had this happen (I recently bought a "50.000 mile" 351 roller cam motor and when I tore it down it looks more like 500,000 miles. So $1221.00 worth of machine work later I now have a shortblock I can use) but I am not going back to the guy crying foul...........I'm a big boy and went into it with my eyes open. When you buy something used that is the risk you take.

    Chalk it up to experience and move on.

    Same lack of care when you bought something you knew nothing about... 30 minutes of research would have avoided this hassle

    This is a clasic case...you paid tuition in the school of hard knocks. You were not a very careful buyer. It's a "bum deal' because of you. And the time frame, not worth an opinion. Again, your fault. Whether the seller knew what he had or not is not the issue. It is YOUR responsibility to know what YOU are buying. Words and intentions mean nothing. The bottom line is, you, the buyer must know what it is he's buying.

    When I read this I thought it was a joke. I suppose if the guy is a good friend, and very honest, he might take the thing back a year later. Anything is possible. But I have never seen or heard tell of anything remotely like that taking place.

    I have lost money on deals where I trusted someone and never got anything back. So I learned to be more careful.

    Also learned when I get taken and tell everyone about it, it doesn't do me any good I just look like a dumbass. So now I keep my mistakes to myself.

    You said he was a nice gentleman, which reminds me of my grandmother telling me that there are "nice" girls and "good" girls. Figure out the difference.

    Not to get technical on you, but he did represent it to be a 312 and it wasn't. That's a breach of an express warrantee.

    On the other hand, you didn't say how much you paid. Technically it doesn't matter, but practically if you paid peanuts for it you shouldn't complain. If you paid a fortune, complain a lot.

    You didn't research it at all, regardless what he told you it was. In my opinion its your fault.... not the sellers.

    I'd say it's YOUR lack of care that he sold something that YOU knew nothing about. Next time you buy something you will know to "read the label". Don't just trust the seller, unless you won't miss that money.

    I guess that is the key, how much did this motor cost? Here is the reality of trying to pursue the seller for misrepresenting this as a 312 vs the 272 it is. Yes, he may have represented it as a 312 and therefore "technically" misled the buyer, but if this ever went to small claims court the first thing the judge would ask is why the buyer waited so long to find out what it was. Secondly, the Judge would ask for anything in writing from the seller saying specifically it was supposed to be a 312, and I bet this sale was done with a handshake and in cash.

    All the seller would have to say was "I only told him it was a Ford Y block and didn't know what cubic inch it was" and the ball would be in the buyer's court to prove otherwise. No proof, there goes the case.

    I'll spend $ 1000 to get back a hundred when I feel I have a chance to recover, but sometimes we just have to accept that we screwed up and go on with our lives. We've all done something like this, just part of life.

    I'm curious also about this situation. I was sold a Ford 390FE and when I took it apart found out it was a 360. I just said whatever, took out the crank and pistons, and I'm gonna accept my loss and take everything else to the scrapyard.

    I sold a new Moser 9" narrowed rear housing and axles from a project that took a different route to a guy at my spring swap meet. Gave him a hell of a price and all was happy. TWO years later he approached me and said the axles didn`t fit and he wanted the cost of a pair of axles refunded to him. He paid the price of the axles for everything.
    I asked him why it was possible for my roadster to roll around for a year before I removed the housing with the axles not fitting.
    He had no answer but said the axles could be machined to fit for about $100 and if I paid that he would be satisfied.

    Well I set up at this particular venue several times a year and sell nice quality stuff at very reasonable prices so everyone knows where to find me. The last thing I need is someone dissatisfied standing around so I tell him I`ll give him $50 to help out but no more. He says that isn`t good enough so I reword it to"that generous offer ends in one minute".

    $50 made him happy and saves my reputation however I could have been totally unresponsive but I`m aware that projects take several years to complete and you buy as you go along.
    He told everyone within earshot how accommodating I was.

    $50 isn`t going to break me.

    I've made mistakes before like this, each one makes me just a hair smarter.

    I consider the situation a "stupidity tax" and try to minimize paying it whenever I can.
     
  18. First off, whenever I sell someone a part I make it clear that I am NOT WalMart, I don't have a return policy. I tell the buyer to "do your homework.... be certain of your purchase".

    Now with that said, the first (no.1) thing I see is it was over a year ago. Even WalMart won't take something back a year later.

    Then (no.2) you say "He shows me this "great running 312""! Did you hear it run? If you did then end of story, if not you should have.... still... end of story.

    Finally, (no.3) "we did some research" after the fact?!?! This is not the time to say "Oops"! You should have done this prior to striking the deal.

    Other people can't be blamed for someone elses mistakes. There are many times that someone thinks they are certain that what they have is what it is. The guy that had it before you thought that and so did you.

    I'd say that the "smart" buyer here was the guy that was getting it from you. He did his homework now didn't he?!?!

    A Hollander manual is your friend, or find a friend who has one. Never buy hard parts without some reference or previous knowledge of what to look for. "Hey I got this 327 motor for sale...", and you look at the engine pad and it's a 72 SBC. "I got a Caddy 500 for sale..." and it's a front sump 68 motor. See what I mean?

    Is it junk? Maybe not, and it has a value to someone. Just find him and sell it. If you lose any $$$, consider it a cheap education on Y blocks that you'll probably never forget. Just try to make some lemonade outta yer lemon.

    What a drag. I think you have to expect to suck it up, but if He's a good guy, next time you see him, tell him the Motor wasn't at all what he said it was. Maybe he'll offer you some bits for your troubles. maybe not. You can't expect i guess, especially if he had been duped as well.

    I don't know about your state, but here in CA we have 5 years. I'm guessing it's something similar where you are but one year is definitely not too long. If it's really worth it to you take him to small claims. He obviously mis-represented the engine, it's a moot point whether he did it intentionally or not. Legally, you are clearly in the right. All these people saying buyer beware and "as is where is" are full of it, the law says it's all on you when you mis-represent an item (knowingly or not).

    Kind of a bum deal, but it happens and we take our lumps. What I learn from these things happening to me is to try and cover all my bases when I buy a motor used. I've been stung by motors not being as advertised also. Not the wrong size, but not the condition advertised.
    I've learned to check all the numbers, run a compression test, and if possible fire it long enough to hear it run. I got stung on a engine not that long agao because I bought it with all the receipts and checked all the numbers to be sure it was right. Ran it for awhile too, but noticed a little noise I didn't like at around 6,000 rpm's. Pulled the pan and checked the rod bearings to find they had not been properly lubed or wasn't primed prior to start up. Ended up having to replace rod bearings, and main bearings (just to be safe) and then found the timing set had been beat on with a hammer. Replaced that too.
    Bought the engine from a neighbor's son, and when I told him what I found I got the usual response, "don't know how that happened." No offer to pay for parts, or anything else. Kinda what I expected, and just a lesson learned.

    Well, aside from all the bs from the usual BS'ers you now belong to the club of those who didn't quite do their homework and took the seller at his word. That may have been the "great running 312" that changed hands three or four times before you finally figured out that it was a 272.

    If it was me, I'd check it out to see if it was actually a good engine and then put it up for sale as what it actually is if it is indeed good. If it seems a bit worn advertise it as a rebuilder and someone will probably still want it.

    It still serves as a reminder that unless we are an expert on the pieces we are buying we need to do our research on the item beforehand and know what to look for to identify the part. I've got a Ford I beam axle in the garage that I still don't know exactly what it fits because I jumped the gun and didn't check things out close enough.

    So if you had bought it as a 292 and later found it to be a 312 then resold it for substantual amount more would you have given him the difference in your profit? I can answer that for you hell no. Just another way to look at it.

  27. When I sell something that I know is correct and someone complains about it I just buy it back and sell it again.

    I know that what you did was a business decision and it seems to me that it worked out well for you but I certainly wouldn't have shelled out the bucks myself without seeing why it wouldn't work.

    Not saying what you did was wrong just that I would have done it differently. I have had too many folks have buyers remorse over the years and try and either back out or recoupe some of their cash from me.

    On the 312 saying that a Y block is a 312 is like saying ran when parked. All Y blocks are 312s to folks that do not know the difference. If I bought it and hadn't done my homework and it turned out to be a different engine I would expect it to be on me. Going back and asking for some of your money back is just low rent.

sell his &#8217;65 Bonneville to pay his expenses etc. He told us that it was an original 389 car and that that engine had been rebuilt several years prior. We had no reason to doubt that info, and knowing little about Pontiacs (we&#8217;re Chev/Ford types) we never really thought how or why to verify.


    So we put it on the internet and a guy is on his way with cash money. Good deal on the car too. He looks it over and get this, CHECKS THE ENGINE. This is the part where we all learn together that the &#8220;rebuilt&#8221; motor was actually some junk replacement mule.



    He showed us the numbers etc. We renegotiated the price slightly and all were happy. Had he waited a year, I would have told him to pound salt in his ass. No way for me to know if his argument was legit. He could have done anything with the car and parts over that period.



    Until he told me otherwise, I had no idea I had misrepresented anything. Should I have checked? I don&#8217;t know. I didn&#8217;t check any of the numbers on the car anywhere. Should I have checked all of them?



    As he was the one forking over cash, I&#8217;d say he should have checked anything that was important to him. And he did.

    that's funny. don't you watch Judge Judy? no way to prove the guy said anything about what size it is or even that it is a ford motor. no proof, no case.

    if a person would go to small claims court after a year that would make him a bigger ass than the guy who sold the motor.
     
  30. I agree with P&B all 350s are LT1s all 302s are bosses but I am wondering why you would even post this here ,you must be very young ...I guess we ve all been there.
    Dont believe anyone,just because they look older just means that they have been doing it wrong longer. SOMETIMES.
    Next time do your homework.I know that all my 6 FEs say they are 352s but they are not.
