Hot Rods New Poster New Car BIIIIIIG PROBLEM HELP!!!

    Hey everyone first time poster long time lurker.
    So here is my dilemma I purchased my dream car a 1948 Ford Super Deluxe off of ebay from a great seller. I arrange shipping through the seller, who is friendly with a transport broker. He sets up shipping during shipping the driver of the truck attempts to jump start the car which is 6v with a 12v booster box and fries all my wiring............which is bad but it gets better or worse.........He then while shipping the car improperly ties down the car and it falls off the truck while the truck is moving and pretty much totals the car........He doesnt tell me anything until he gets to my house with the destroyed car........Im at a loss now the broker wont return my calls, the transporters insurance wont cover me, Ive contacted the D.O.T. and started a complaint but does anyone know anything else I can do to get this resolved ASAP I'm totally bummed right now, whats gone from one of my happiest days has turned into my 48 nightmare

  3. Attorney. Preferably one that does not give out legal advice on an internet forum. Make sure that while you are going to give him a retainer he is still going to try and collect his fees from the shipper.

  5. Unbelievable. Why won't the transporters insurance cover this? Isn't that what their insurance is for?

    This is bullshit. Get an attorney's advice. I generally don't like the idea of sueing people. I think too many people are "sue happy" but if there were ever an occasion where it was justified, this sounds like the one.

    Good luck with the insurance they told me that if their insured doesn't call them back then Im S.O.L. unfortunately lawyers are expensive. And I'm nervous to be out even more money
     
  9. Real bummer.Sounds like you need good legal help.Transporters ins should cover this under
    liability unless he's not being honest because it could raise his insurance.Good reason to use
    HAMB vendors.Wish you luck.
     
  10. Get in touch with E-bay and tell them what you purchased is not what you received and talk to a lawyer,many lawyers will initially consult for free and charge only if you win if it goes to court.

    It's a little late now,but there are professional haulers here,,not brokers and they do this day in and day out..and best of all the have insurance!

    Get ebay involved. They are pretty militant about their auctions.

    EBay wants nothing to do with it because it wasn't the seller who did anything wrong, it was the shipper.

    ebay is correct ! did the car shipper offer insurance ? also sounds like they had a very inexperanced operator driving the load. sometimes all it will take is a lawyer writing a strong worded letter on your behalf to get them to do the right thing!

    did you pay for it with paypal on a credit card? might try a claim with paypal, and another claim with your credit card but I think ebay motors is different. I know you can get just about anything free from ebay if you really want to.

    either eat the loss of the car or get a lawyer who deals with interstate transport thats your options . and if you get a lawyer find one that will make them pay his fees upon settlement , not you . your first consult is free and if they lawyer thinks there is a chance for a settlement , then he will agree to take the case , if not then try another if not by the second one then you really don't have a chance in settling .

    Forget about eBay. They are not much help on settling claims as it is. Its obviously not the sellers fault anyway. The shipper should be held libel as they are the ones who damaged your car.
    I'm also not a big fan of attorney's. They might take the case even if they think you can't win. After the free consultation, every phone call to them will run you at least $250. It might be difficult to retain an attorney contingent on him getting paid only if he wins the case. In any law suit the only sure winner is the attorney. I found that out on having to pay an attorney for my daughters divorce.
    Either way its going to be a hassle. Good luck. Keep us posted on the outcome.

    I'll post some more up when i get home. The biggest problem with the car other than the body damage on pretty much every panel is it seems like the frame might be bent.

    I took possession of it. I own the car I wasn't going to let them have my car and then be out the money I paid for the car also.

    A48, I agree you had no choice but to take possession of the car. No telling what would have happened to it if you didn't.

    About 20 years ago I bought a 1967 Corvette in Florida. When the shipper picked up the car they photographed the vehicle to document its condition. When the car got to me it had a lot of body damage that was not there before. The shipper took more photos to again document the car. I filed a claim with the shipper and received a check a few weeks later. No questions asked because photos of the car where taken at time of pick up and delivery. If the transporter has insurance I don't understand why the problem settling with you. I personally would question whether or not the transporter has insurance or is legally registered to transport cars.

    It seems by looking the shipping company up on the DOT website that they do have insurance. I have contacted them but the transporter gave myself and the seller a fake bill of lading with another companies letterhead on them when they picked up the car, so who knows what there scam is.
