I'm pretty sure I've seen this before..just relisted by the new owner for $3k less...wasn't there a drama behind this?
Yep...heres the original thread: http://www.jalopyjournal.com/forum/showthread.php?t=83651&page=1&pp=20&highlight=sue He used the original auction text and pictures too.
........the otiginal said it was shipped by truck..........the new one says it is in Hawaii???????????
Still in San Diego...owner is in Hawaii. Someone with 100% feedback just bought it thru "Buy it now"! The check is on the way from Nigeria as we speak...
Thats funny. He was all pissed at Plowboy for his description. Seems like he described it pretty much the same way in his own auction. I hope the guy who bought it is an idiot know nothing who needs to bring it to a hat rod shop to have some work done.
I dunno it looks to me like one that you buy and if it isn't the way you want it change it. I read some of the other thread, and it looks like the guy forgot bring his superslide with him to the shop. Apart from a few HAMBers that I know I take pretty dim view of rod shops and "Pro-Builders". So its hard for me not to sound biased on the subject. If I was buying something and wasn't planning on reworking it I guess I would have an appraiser or someone trustwothy take a look at it.
The seller in Hawaii lists it on e-bay just about like it's listed originally, but he's suing the seller for fraud in Green Bay? And sells it, no less. For more money, no less? What do you suppose it would do to a lawsuit in Wisconsin?
it ruins the lawsuit, because a) hes a hypocrit for doing the same thing to someone else b) despite claiming the description was wrong, hes now reusing the same description in any court case where you got shafted on something like a vehical, the best bet is to resell the itm with a PROPER description, then you can sue the person you bought from for the diferences and any costs on your part example .... 69 camaro on ebay listed as "100 original miles" ... car looks spotless and you pay 500,000 for it ... turns out the car in an impecably restored 6 cylinder car .. its worth 30,000 or whatever .. you cant realy just go sue for 500,000 and kep the car ... because the judge is going to ant proof of what the cars actualy worth bst way to find out what its realy worth ... resell it with a fair description on the open market ... put an ad in the paper or online and sell it off .... THEN when you get 42500 for the car, you can say "this is what its worth because its all i could fairly get for it"
Actually in this case the judge is going to want more than just the shops word that it is wrong. mayhaps on the mechanical pieces, but when it comes to grafted one year to another year the judge is going to want to word of a genuine known expert. The downside to sueing someone out of state is you have to show up to all the court appointments, that could be pricey and a gamble at best. its not overnight either it could take years. you should never sell a vehicle that is involved in a lawsuit. Once sold there is no proof of the condition of the vehicle or the value. The only way to get a true estimate on value is to go to a repsected recognized appraiser. I would think that if someone had a lawsuit against me and they were selling the same vehicle with the same discription I would want to own a genuine copy of both ads.
My guess is that they settled out of court for a undisclosed amount and now the new guy is selling the truck. My 2 cents.
