I just came across a web site selling photographs of my COE. They were taken without my permission, modified both in background and of the vehicle itself, and are now for sale... and yes it ticks me off. Has anyone else run into this issue, people trying to profit from our hard work? http://fineartamerica.com/featured/1941-ford-custom-coe-tim-mccullough.html FYI - I have contacted a law firm to see if it is legal.
If they are your property or your photos I think you have some legal rights. Will differ between here and the US.
I think it kinda goes with the territory, I have had my Cobra end up on an adverti*****t for a car show/ autocross. They didn't ask and I found about it during the event. In my case I really wasn't upset but they where not trying to sell the flyers either so it's a little different. Heck, I think I would look at it as a compliment and keep on trucking. Rob
Some if it depends on how they got the photo. If from the public domain such as a website then it can be difficult. Or if they or someone else took the photo while the vehicle was in a public place then the photo belongs to them. Though not with a vehicle, they did use a picture of my house to sell lots.
My son is a free-lance photographer, so I'm a little familiar! You can't use pictures of recognizable people for profit without their consent, (general pictures of crowds are ok) but if your truck was viewable to the public you've got no claim to that picture. To flip the script a bit here, I think you should feel good that he felt your truck was nice enough so that a picture of it might be salable. Accept his backhanded compliment, and fugidabowdit!
If those are photos YOU took you are en***led to royalties from every print sold to date. You can demand their removal although I hear that doesn't always go so well. Ask @BOMONSTER and @Del Swanson how they deal with this. Their artwork gets stolen on a regular basis and posted for sale all over the world!
No offense BUT besides yourself, how many people would want pictures of YOUR truck ?!?!? Maybe make a neat background on my PC desktop but I don't really want a big one in my living room !!!
You see people selling pictures of older stuff on Ebay all the time. I guess there is a collector for just about anything you can imagine. I've bought old copies of ads for the truck I'm working on, just to hang in my man cave. My son just had a large outdoorsy company contact him today to buy 2 of his stock pictures, to use on their store credit card. the price he asked/received each, was more than a months wages for a retired guy like me.
