Hey California guysWHO can tell me where to find the EXPEMPTION Waiver info in the DMV Code? For you that dont know what the H-E double L I am talking about it is this: IF you have a Cl***ic Vehicle as described in sections VC259 and VC5051, AND it has unpaid penalties due to unpaid back fees, you can request that the fees be dismissed. YESTRUE I have done this MORE THAN ONCEBut NEED to get the code from the book so it is easier the next time I go to DMV.<O></O> Anyone know where to find this?<O></O>
It is hard to find. There is a person who advertises in the "Cruisin News" who does dmv stuff who may help. The older DMV employees always knew it, but the newer ones, including managers, don't know, or don't care. Sorry I can't help any further.
Now that I think about it, I think it was the original Crusin News DMV guy that first mentioned it. Seem slike he retired or somethin.. John Swenney would peobably remember. May try him.
Vehicle code section 4604 (d) (3) exempts vehicles described in VC 5004 from the Planned Non-operation program. VC 5004 describes vehicles of historic value ("at least 25 years old and of historic interest"). It does not say that the car has to be registered under 5004, just has to meet the description. The DMV clerk had heard about this exemption, and just had me fill out a statement of facts, requesting that the penalties be waived. Saved me quite a few bucks.
You just need a "Statement of Fact" signed by the seller that vehicle has not been used on the road for the proscribed time period.
X2 on using AAA... I know 2 ladies there that are really smart with DMV stuff, I get fresh ***les from them all the time.
I used this a few years ago - my neighbor told me about it, and it worked fine. I tried to use it again 3 years ago and nobody in the CA DMV could find any information about it. I ended up registering it out of state, waited a year, then registered it back in Ca.
Looks like this is an old discussion. However, it is very important. I am a director with the ***ociation of California Car Clubs and Collectors. www.acccdefender.org We are THE watchdog organization for all car folks in CA and have been since 1971 when we were concerned that CARB would be overstepping it's authority, a**** other things. We can ***ist when citing this code or applying it. Most DMV clerks are unaware of it or unclear with how it is supposed to be applied. When presented properly, we have never lost a case where the vehicle is supposed to be exempt by statute from non op fees. As long as it has not been on the road, there should be no penalties. We are also reviving the discussion and legislation on moving the smog exemption up to 1980. Let us know if you would like to get involved please. Will need all the help we can get. XDMN : Please SPREAD THE WORD to all the antique/vintage/hot-rod clubs & ***ociations that you are taking up the fight again!!! Also, possibly aim for 1990, & "settle" for 1985? After all, it's been more than 10 yrs since we were "screwed" by that politician from Mountain View, so it really should be moved up by 10yrs!!

Like everyone says, print out the "statement of facts" from the DMV website, fill it out and don't leave the DMV until you get the fees dropped
