OT-Texas HAMBERS-anyone else get a letter from DPS?

    So I get something from these jokers about how I have 4 points on my driving record and my next ticket will put me at 6 points and a $100 penalty (on top of the fine I suppose.) My problem with this is that I haven't had a moving violation in 2 years and the last one I took defensive driving for so it shouldn't have gone on my record (right?). Hell, I drove a van for the Marriott and they check you record-mine was clear... over a year ago! My other question is why didn't they send the letter when I got the ticket 2 years ago? I got this thing yesterday so I won't be able to call til tomorrow, but it really just pissed me the f#ck off...
    I also wanted to add that according to the letter m.v. tickets carry over from other states and each ticket is worth 2 pt's. You have a 3 year period but it doesn't say when it starts (after the first or does it start over with each new ticket). On a bright note, you won't get pt's if you got a ticket for UNDER 10% of the speed limit-like cops really give those out right? I call big BULLSHIT on this, ya'll.

    I didn't know we had a points system either. On the point of speed limits, here in Laredo, you'll be alright unless you get pulled over by the damn biker cops. Those guys will pull you over if you are 1 mph over the speed limit and will not let you off with a warning regardless. It because of them that I found out the cruise control in my 2000 GMC works at 28 mph.

  6. Exactly what I was thinking. When I bought my house, 2 other people with my exact name came up on their search.
    Its not a common name either.

    Get copies of the tickets, and show them why its not you. Different height/ weight/ race, etc.

    Unfortunately the burden of proof is on you. My brother got hauled into jail on a DUI warrant because one of his buddies gave his info to the cops when he got busted for DUI. He had to prove to the court that it wasnt him that was taken in the first time.

    Nothing new. I got my license suspended when they started this about 3 years ago.

    I read in the paper that Texas is trying to raise more tax money, and the "surcharge" on top of the fine is one of their ways of doing it. If you ignore it, they issue a warrant and off to jail you go, the very next time you get stopped. I worked in the local county jail for a time. The food there will make you wish your taste buds would die, die, die! (Arramark Corporation don't you know.) Say Hi to "Ultra Fat" sheriff Tom for me and all of his super intelligent clones too!

    Supposedly, with a certain number of these points stacked againsted you, your registration will cost more. And if you get too many, you'll get your license revoked/suspended like I did.

    I almost went to jail b/c I refused to pay the stupid $100.oo fine, instead I ended up paying $850.oo worth of tickets. haha

    I did not know we were on a point system till a couple of months ago when I got a letter from an attorney wanting to fight my case. Sounds like a bunch of bullshit from the state if you ask me. What happened to all of that damn lotto money they get. Sure not going for education.

    is it true if you sit it out in jail it does not count as a conviction ? something I heard.
     
  12. I have heard of surcharges when a small town(like Lakeway) gives you a ticket that is on state funded highways....I think it just went in last Sept.
    The points system is new to me....I'll ask a Sheriff buddy of mine about it and if anything new that hasn't been discussed comes out of it I'll update.

  13. Typically the time starts when you get the ticket(in most states it is only 12 months). At the anniversary date of the ticket, the points for that ticket drop off. What I think that they are doing here in Texas is saying that if you accumulate a total of 12 points in a 3 yr period, that is when you licens is suspended. Back in New Mexico it was 12 pts in 12 mos. and naturally as soon as one tickets points would drop off, I would end up with anoter ticket. I almost always only had a 2 point margin and who ever gets a ticket that is only worth 2 pts.

  16. You need to get a copy of your record.
    Back in the '90s my insurace took a big jump and about that time i got a letter stateing my total points as far as good ol' MO knew. I couldn't figure it out I hadn't had a ticket of any kind in over a year, and my last ticket had been a parking ticket, expensive but no points.

    So I got a copy of my driveing record from the state. I had been written two speeding tickets in the same day. Problem is that I checked into a motel (on my way back from oregon) in Western Wyomeing two hours from the time the first ticket was issued.

    I had the credit card receipt still. I contacted the state and it took some doing, noterized copies of affidavits etc along with legal copies of the credit card receipt etc but I got it straightened out.

    Turned out to be a clarical error according to the state.

    :D Yeah a buddy of mine got a ticket for over a hundred ,why they did'nt lock him up who knows , any way he got a nasty letter the other day from DPS about suspending his license . He also has a CDL so they are nailing him hard with fines etc... He is going to Oklahoma to give up his Texas license and get an Okie license before they suspend it here , we will see how that works out!:)

    Not sure about defensive driving. DD may help keep your insurance in good terms, but still goes against the points. I don't really know that part.

    You know things like this happen, cause we all have that shrug of the shoulders and whatca goin' do, attitude. One by one things are getting worse and worse.... sigh

    I believe if the fore-fathers were like us, we'd all still be British.

    The other thing I just noticed is that if you get three or more tickets in a year, then you have to pay the "surcharge" all three years that the points show up on your record.

    To put it another way, if you got three tickets this year, that's $100...and it would be $100 next year and a $100 more the next until the 'points' went off your record.

    So you don't just pay for it once. That's fucked!!!

    A friend of mine got a ticket for not having his DL with him.His wife was pulled over and he was behind her in his truck so when he stopped an other cop went over to him and asked why he had stopped he explained that his wife was in the first car the cop's reply was since your here let's see your DLhe did not have his wallet with him.He had explaind that they had driven to their 2 buisnesses to check for huricane damaged since the rain had stopped.So he got a ticket for no DL,after he paid for the fine he got a letter from DPS that he also had to pay the state so he got screwed twice the great state of Texas.

    Finally got a human on the phone this morning. It's been exactly TWO years since I got my last ticket (4/4/04) so I have a year to stay clean. They also told me that defensive driving does count, so there you. Does decrease the lameness but oh well...
