Help with ART for our club logo win prize

  1. Disney and Coke are VERY protective of their trademarks and copyrights... They sued a daycare cuz somebody painted a mural with Disney characters on an inside wall... Those images are worth millions to them and they have armys of lawyers to make sure that their names stay pristine.

    I'd avoid any possible entanglement with them.

    I think had you never mentioned "Jungle Book" and just said "cartoon rattler" nobody would have made a connection. A cartoon rattler isn't a far stretch from a Disney cartoon snake, what else can you do to make it different? But you say Disney, and "oh, yeah, that's ours, yup, we're suing"

    I'd just change the facial features to be a little more rounded and squat, more like a Rattler than a Python, shorter eyes, and scales up the whole thing, and it's a rattler, not a Disney character

    I don't know where the law stands on this, but I think it is too close myself.
    That is just my opinion and as you know, opinions are like ***holes everybody has one.
    If you come up with something that has no resemblance then you don't have to worry.

    yep, its kinda close.. but i say , fuk disney!!!! ****, everything on earth looks like somethin else..thank GOD they dont own all the record labels.. every song would sound like its a small world:eek: that would still be better then the **** on the radio now!!!!!good luck and i think it looks great>>>>>>>>>>>breeder:)

    Maybe if you had a cheater slick with a rattler head coming out one side and the tail out the other. And raised white lettering on the side wall with club name and city.

    Disney is the first thing I thought of. Adding a rattle to an obvious disney character is not enough deviation. It's a cool concept though. Just draw the head differently.

    John, I am a member of a well established car club here in Phoenix called the Rattlers. We have been established for about 12 years and we are well known in the hot rod community, especially throughout the southwest and California. Most of us are in Arizona, but we also have members in California, Colorado, England and Sweden. In order to avoid confusion and to avoid any bad feelings that may arise, my clubmates and I respectfully ask that you not userp our club name and choose a more original name for you club.

    No intent was made to steal anything... I did it in Disney-esque, per your original request of
    "give you an idea of what we are looking for ,cartoony snake ala jungle book , shakey rattler , leaned forward spinning tireish loop center part , RATTLERS ,on top, SANTA CRUZ on bottom"

    ... but if you're thinking it's too close, I gotta agree in hindsight....
    maybe a re-shaped head, per the suggestions posted?
    The last thing I want is for you to take any heat from someone that thinks it's too cose, and, judging from it, it might....

    Mike ,

    Thanks for the message , I did some searching when we decided to revive this old local club name , and all I found was a few older mentions of your club , as you know there were lots of clubs back in the day that shared names that lived in different towns , the roadrunners was another local name as well as the cam snappers and road angels ,all of which have been used by other citys . The Rattlers was also the name of an all Black biker gang from Oakland , but I am sure that our original art work will be different enough to avoid any confusion . I thank you for being so polite with the request , and I will relay your request to the other members , we will vote on it and see what happens. I hope we can all still be friends .

    Mike, you think we can come up with a peaceful solution to this , and we can all hold hands and skip through the park at Paso together , if you are on the HAMB you must be pretty cool.

    I would hate to have to go to Court with you AND Disney.

    How about posting a pic of your club Jacket.

    I hope the 750 or so miles is enough to keep people from confusing the two clubs.

    When they sell California to Mexico, it won't make any difference. Unless there is already a Santa Cruz in Mexico.

    First, thankyou Bulletnose, for posting the picture of our club plaque.


    John, any club worth their salt should be fiercly protective of their club name. If your club decides to use the Rattler name, it will cause confusion and it will always be a source of irritation to all those in my club. Frankly, knowingly using another established club's name is just bad form.

    Back in the old days, the world was a much bigger place. If this were 1956, there is a good chance that two clubs in this situation would never even hear of each other. This is 2006, with things like the internet, cell phones, a road system that makes long distance travel easier, etc., the world is now a much smaller place. The way the world is today, we basically exist in the same geographical location. People will see both clubs and not make a destinction between the two. The deeds and machines of people in your club will be ***ociated with our club and visa versa. I see this happenning now with the Sinners of So Cal (Choppertown) and the Sinners that are now here in Arizona. Two completely different clubs, yet many people fail to make a destinction between the two. I do not understand why any club would want to create a situation like this.

    I strongly urge you to use another name for your club. It's the honorable thing to do.

    What are peoples thoughts on changing spelling to defferentiate clubs .....

    ie: throttlers - throttlerz , knowbodys - nobodies

    enough of a change or will it still piss off the establishment???
     
  28. I really dont think we should have to change the name. Our logos are far different from yours, and the chances of out clubs actually getting together isnt that likely. The only issues i see being a problem are what people start online, and its its always fun dealing with tough guys over the net. And to be brutally honest, i dont see anything trademarked.

    1. We voted to stick with the name.

    2. I have been going to car shows in this area for more than 12 years , and have never seen or heard of your club.

    3. as far as being original ;(according to Drake's book, "Flat Out") " The 7 organizing clubs of SCTA were:Hollywood Throttlers, 90MPH Club, Road Runners, ********rs, Night Owls, Mercuries &Centuries. They met on Nov 29, 1937 at the Throttlers clubhouse to organize SCTA.•At the next meeting the Derilicts joined SCTA•Later (subsequent meetings ??) the following clubs joined: Albatas, Desert Goats,Hot Irons, Knight Flyers, Velociteers, Pacemakers, Mobilers, Kings Men, Gophers,Outriders,

    wait for it ......

    ....RATTLERS,........... Sidewinders, Knight Riders, Ramblers, Idlers, Ridge Runners ".

    Were you a member of the Rattlers in So Cal in 1937? Didn't think so .

    So, so much for being original.

    4. You are right about being protective about your clubs name , so I will be.

    5. As far as causing confusion , our jackets won't look anything like yours , nor will our plaque , ours will be cooler and it will say Santa Cruz on it just so you don't get confused. And if I ever run into some one in a Rattlers Jacket that I don't recognize at a carshow I will thank them for driving 750 miles to hang out with us and buy them a drink.

    6. As far as using another clubs name being " bad form " , see #3 in the previous post and punish yourself accordingly.

    7. As far as your point that the world is a smaller place with the internet and all , I googled the **** out of "Rattlers Car Club" and haven't found **** about your club, you should put something out there about this club you are so proud of and introduce yourselves ,try something like rattlerscarclub.com , oh wait ,I already own that .

    8. As far as the cars and deeds of my club members being ***ociated with you , see #5 above , and dont worry , our cars are all Traditional 40s and 50s styled hot rods and customs, and should not be confused with your fibergl*** hooded , 60s style streetrods and g***ers.

    9. As far as rolling over and giving up as an " honorable thing to do " , I got into this hobby to build cool cars and hang out with my buddies and have a good time , my buddies and I got together and decided to start up a car club and we put a lot of thought into a good name , we made rules , and decisions , and we did it for us , not to impress you or anyone else . We made a decision and we are gonna stick to it , and I think that is honorable.

    10. Thanks to everyone that read the ***le to this thread and wanted to help out , and especially Ottatyme for the kick *** ORIGINAL ARTWORK it's just what we were looking for .You win something cool , please PM me and let me know what you are building , so I can reward you accordingly .

    11. As for all the whiners and naysayers that somehow read the ***le to this thread as " Please ***** and whine to me and give me your two cents worth because I really give a **** what you think." ... A wise man once told me that if you don't have anything nice to say , then just shut the **** up, and go work on your car.

    We're the Rattlers Car Club of Santa Cruz ....., and you ****.
