trademarks or licenses can be"rented" you pay a fee for each use and a flat fee to get licensed to use, and every change must be approved by the license holder or bureau. Its different for each industry, but print/graphics are like that.

Copyrights may be available then. If they are no longer in business and the family chose to not renew their ownership of the name, its pretty much open. Remember, though, once you open the door, anyone else has the same access unless you buy the copyright.

Lawyers can correct me if this is not right- But I believe you apply for the trademark or copyright on the name or medium you mention then if there still is one in effect they will then deny your application ......
