Car Hauler Ticketed...

    My brother told me he was ticket for hauling our cars on my Wooden Decked Dove tail trailer with my Truck..(see pic)..Hmmmm we had no idea that it was against the law to haul a car on a Wooden Decked Trailer. Anyone here know anything about this law. The ticket was given in McKinney, Texas. Also he was given a warning for transporting two cars on one trailer, a '38 Chevy 2dr body and a '40 Chevy 2dr Body. Plenty of room on the trailer I thought and well secured. Anyhow any info thanks.:cool:

    I've never heard of that before...and if it's just the bodies they can't be considered whole vehicles anyway for weight restrictions...but then again texas is full of pricks for highway patrols...I've been pulled over twice there and had my vehicle searched with K-9's for no reason, well one was because I "pulled out from behind a vehicle too close to pass" aka almost tailgating and then passing the guy...the other time was just random...

    i've NEVER been hassled about mine but i don't live in texas...

    was a ticket issued for the trailer being wood? was it the D.P.S.? news to me.

    this has got to be one of the most ridiculous violations I've ever heard of...I could see if it was a big heavy 4x4 on a rotten wood trailer or something, but a couple light car bodies, and on a trailer that actually looks solid?...I say until you see a statute in writing, contest it in court...

    most big truck trailers going down the highway have wood floors so I don't see what that has to do with anything.

    You need to look up the statute number the ticket was written against. As long as the load didn't exceed the trailer limits, and was properly secured I'ld take it to court.

    Bodies are parts, not cars. And trailers are rated by weight anyway so who is the cop to say your over weight. Did he weigh the trailer? I don't know about the wood deck thing but I've seen heavy equiptment on wood decked low-boy trailers before. How does he know how your trailer is built? I'd contest it.
     
  11. Yup, look up and see if there's any law behind it. If the guy's blowing smoke at you, challenge it in court so that if he doesn't show; it's thrown out, and if he does show, he gets just as much hassle for it as you did. Assuming you can do that in Texas, of course. Any time you get a ticket for something like this, the next move should be to a store and get a disposable camera and take a bunch of pictures showing exactly what your load and trailer looks like.
     
  12. Exactly, sounds like BS to me.
    If there is a statute, i need a new trailer before I go through TX again.
    How can it be okay to haul a huge bulldozer on a wood deck trailer and not okay to haul a car? As far as the load, as long as it's properly secured and not over weight, who cares what it is?
    Let us know how this turns out.

    Geez - everybody I know that hauls a car does it on a wooden decked trailer? I'm thinking the guy is a little gungho and enjoying the power...

    fight it. the trailer we have at work has wood decking and it is rated to haul 35 tons. its a landoll 317c. they offer up to a 50 ton capacity with wood decking so its not illegal.

    99.9% of the big trucks have wooden floors in/on thier trailers, and I'll wager that all of the enclosed auto transports have wooden floors. And I'm with the others on the bodies not being cars, but parts.

    Overweight?? I wouldn't think so, but if he didn't take the truck to a public scale, he wouldn't have a clue either. I'd contest it for sure!!

    Oh, and how about the commercial car haulers that haul eight cars on the rig........six on the trailer alone??

    I lived in Plano, Texas 1982-1983. I was a full-time student from Oklahoma. I received a ticket from a Plano city cop for not having Texas tags on my car. I contacted the dean of students and found out that OK and TX had a reciprocal arrangement for students, meaning students could keep the tag from their home state rather than transfer registration.

    The dean sent me a copy of the statute. I took it to court. The cop showed up. When it was my turn to speak, I held up the statute and started to read it.

    I was interrupted by a rude, conceited judge, probably then in his mid-thirties and very full of himself. He said, "It's not your job to tell me what the law is! It's my job to tell you what the law is!"

    Then he asked the prosecutor if he had heard of the statute. The prosecutor said he had never heard of such a thing. Then the judge asked for my piece of paper, looked it over, called the prosecutor to the bench so he could see it, and then the judge (arrogant jerk) dismissed the case.

    My opinion of cops and judges in the North Dallas area, which I guess includes Plano and McKinney, is that they're a bunch of morons. And that's on a good day.

    I wouldn't live in Plano again for a million dollars.

    Complete and total BS. I've been in trucking for 18 years, nearly every trailer I've ever seen has at least some wood in the floor, and I've never heard of such a thing.

    Tell me what statute he cited and I will research it. I am well read on Vernon's Civil Statutes (where this would be) and rather enjoy disproving such things.

    It's 17:35 here men so sorry late to check on things...Wow alot of interest here. Thx for the Response. My brother just emailed me and there is NOTHING on the books in McKinney or any other Texas books that say you can't haul around a car, tractor or anything for that matter so as long the deck is rated for that load and not deteriorated to point of not being able to carry load sprecific to the trailer. The cop was a young looking dude and looked green. Brother is also a Ranger in the Army and looks intimidating. So when he asked to cop about the Law he was being accused of breaking he got irratated with my brother. He said the old cars needed to be secured by Chains and Binders....Not 2" Ratchet Straps. Threatened to shut him down. Whatever I guess..I know they have a few upscale Nieghbor hoods going up in north McKinney so I guess they need the money. We thought about going in and changing the wood out for Diamond Plate Decking anyway to safe on wieght.:cool:
     
  21. There is probably some obscure law somewhere in a law book if you can get the dust off of it. Have him check the judges pouch for a joey when he goes to court.

    I was wondering the same thing myself....I have to look over at my troopers monitor next to me in order to continue and read the responses. He's getting a little anoyed with me. Like I need a 72" screen.:confused:

    He's apparently never seen E-track/T-track and tire straps either.
    Four 10#K rated straps on a 3600# car are more than adequate.

By the way, you were doing 45 in a area that has a 45 mph sign - but we just changed that to 25 the other day - have'nt had time to put the new sign up yet.   28. I have heard that the DOT changed the rules to make hauing a 9K up rated trailer w anything lower than 3/4 T PU illegal, but nothing about this wood deck BS.

    I think those are bogus violations. Our car hauler has wood floors. As a matter of fact my dads semi truck's trailers have wood floors. We have piled on the cars and never had a cop pull us over for haveing more than one car per trailer. But this is Ca. It may be different in Tx.

    This is Texas, you may want to reconsider that one. Have you ever let your trailer sit all day in the sun, then go out and try to secure chains on a car and have to lay on the deck to get under the car? I'm sure, now think about that metal deck just cooking it up waiting to burn your ass when you lay down on it. LOL


    Oh shit, somebody better tell the Mexicans! I see 1/2 tons that look like taildraggers with the truck and trailer so overloaded you avoid them like the plague on the road. And this is day in day out! its about time they did something about it, but even with the law on the books it will get overlooked. Because how many cops like to make traffic stops then call INS? They don't want to do that sort of paperwork.



    I think this is B.S., we've all heard of, or had cops pull some sort of B.S. But if you see their side they at least had good intentions and banged up a law somehow or even just somewhat. Your case is 100% trumped up, which doesn't ring true to me. Something seems askew. So is the trailer deck, and the straps the "REASON" why he got noticed by the cops in the 1st place?
