I think you hit it right on the head, the larger nuts and assorted washers are just spacers over the unthreaded portions of the clamp! The only loose nut to be worried about on this "fix" is the one that turned the wrench!

 

Those are banned in Merica now.

 

Maybe it's a farm trailer of some sort that only gets pulled along at 5mph and never goes out on the roads.......
Even so, the perpetrator should be hung up like a pinata and have the lollies beaten out of him with a stick.
