Tennessee's new tax law - YOWCH!!!

    Just went to title the old '53 Chebby truck I bought last month. I hand over all my paperwork, title, bill of sale, etc. The lady tells me that there's a new law and that unless I have a signed affadavit that the sales price is correct I will have to pay taxes on NADA book value on my truck, which is - drum roll please - $12,000. In other words, they want me to pay over $900 plus another $77 for a tag to license the old beater pictured below.

    Needless to say I didn't pay $12 large for the truck and I'm also not paying $900 worth of taxes on it. I left with the affadavit, I'll just have to track down the previous owner (out of state) and get it signed. The affadavit has reasons that the price is 'low' like poor condition, familiy member, inoperable, etc.

    Just a heads up for any of you TN guys, I'd get a few of those blank affadavits if you're looking to buy a project any time soon.

    They've had these affidavits a long time. I had to fill one out for a car I sold about 5 years ago.

    It was for exactly the same reason.....The sale price was way lower than the book value.

    I think you just got a bitch on a bad day.


    One time I had to go back home and bring PICTURES of the vehicle so that the woman would even process my CLEAR title.

    I was like...WTF? What kind of procedure is this? But she was serious, and I did it.....and she processed my papers.


    I know for me, its been a different circus each and every time I've went to the DMV.

    I bet they were just thinking of a creative way to give you the run around.

    ky went to this back in the late 90's......i remember going in with my 48 chevy coupe title.....samething.....low book was around 6 or 7 k at the time.....it was and is pretty much a joke......they don't question too much ....but you always got the goof ball that tries to say he gave a grand for his newer vette.....brandon

    You know, its like these asshats can't accept that a person can get a "Classic" for a reasonable price.

    ......and when someone does, they immediately assume you are fucking with them.




    What you have is a fat ugly woman behind the counter who doesn't know a '55 Chevy from the Batmobile thinking that its impossible to find old cars because she didn't see 50 of them on her pitiful commute to her shitty job at the DMV.

    She also doesn't know a burro (ass) from a burrow (hole in the ground).

    Kansas did this a couple years ago, enough people got "the word" that it got changed back. now we don't need notorized bill of sale, just a signed title.
     
  7. Hey I just licensed mine last month and didn't have to pay that tax. What gives? It came from AZ.

    my brother went through this a couple years ago here in NJ. He bought an early 90s S-10 from his work. it was an old work truck. they sold it to him for beans. A couple months later he got a notice and a bill from Trenton basically saying the truck was worth way more than he paid. He got the company to sign a bill saying that's what he paid. they'll get you one way or another.

  10. When I brought my 39 pontiac into arizona they went off an ad I had for the car (from 1939) stating the price was $758 f.o.b. they went for it.plus I get to run my 1939 arizona plate:D

    AZ lieu tax is based on the original price of the vehicle, and it depreciates a set percentage each year till it hits the minumum of $10. so anything old you pay $10 lieu tax on.

    been that way forever...although in the mid 80s they had a short lived sales tax on private party used car sales.

    Damn Gator, wheres my extra $$$$$. You got a real deal on my truck. I haven't had to pay by a book value yet, but it does depend on the person you talk to as to which HELL you will have to go through.
     
  14. Tax....we bring a car in to the UK...
    you pay for the car.. then when it's here
    10% car tax
    then
    17.5% VAT..(that's value added tax and it's on the price plus the 10% cat tax)
    the price you paid is checked....(with a reputable car dealer in one case I know who stated the value here was X amount more than the price paid so the tax was set on that price!!)
    you then have to register it.
    which involves getting a ministary of transport cert...but if the paperwork aint quite right you get to go to SVA......that means most 5 yearold stockers won't pass..If you do get your registration and all is well the car will probabaly have cost you twice what you originally paid for that "bargain" you just couldn't pass up while in the Colonies!!.....

    I think it's time for some one, (ACLU maybe?) to get a high up there judge to rule that when a government body assigns a value to a person's property for tax purposes, that that value constitutes an offer to purchase said property.
    I'd sell the old '55 second series in the driveway to the State DMV for $12,000 in a heart beat!

    I'm sure a lot of people would sell their houses to their County for what they are tax appraised for too!

    I don't know, first I ever heard of it, and the lady there acted like it was something new. :confused:

    And she was actually quite compassionate about the whole deal, even helped out getting me a temp tag. You could see the truck from inside so there was no doubt in anyones mind it's just an old truck. Normally I would have just parked it till I get it all sorted out, but I sold my Ranger yesterday and this truck is now my only source of transportation.

    And yeah, I do feel for you guys 'over there' trying to Hot Rod stuff, everything's gotta cost twice as much with taxes, customs, freight, etc.
     
  18. The affidavit had to be signed by the SELLER??? That sucks.

    Always before, only you as the buyer had to sign the affidavit attesting to the sale price for the sales tax they would collect, from you.

    I've got two bodies/frames I need to title; this could screw that up big time.:mad:

    like Brandon said,,KY has been doing that for a while,,,

    the thing that gets me though is,,,i bought my ol ladys daily 2 years ago ,had the afidavit signed ,paid the taxes on what the afidavit said,,
    then ,,we had to pay the PROPERTY TAXES on it in this past september and are NOW paying taxes on the actual book value which is $2000.00 more than what we paid for it 2 years ago!

    antother thing that gets me,,is if a car changes hands two times(or 3 or 4 etc) in the same year,,they collect property taxes each time that vehicle transfers...thats a GOOD BUISNESS to be in!

    Can you give me some more detailed info on a "signed affidavit"? I got a 51 p/u that I will be titleing soon and it sure ain't worth $12.000.

    Hmmmmm......interesting.

    I swear, 5 years ago I sold a car to a guy for less than book. He paid cash and we wrote down the total on the title and I signed off on it....he left.

    A day later he's back at my door with the affidavit in hand telling me the DMV needs me (the seller) to sign it to prove that I actually sold it that cheap.

    I filled out that the car had problems and signed it.


    Other than that, I know nothing about it.







    ..............and as far as the fat ugly DMV woman goes......
    Yeah, I feel quite strongly about her! :D I get the same damn one everytime.

    I'll be standing in a line with 1 person in it.......the "fat ugly" will have like 5 people in her line.

    Before I get to the window, she's done with those 5....the room has cleared....and she looks me straight in the eye and goes "NEXT!".

    DOH!


    Oh I hate her.

    When I think of SATAN.....I picture her. :mad:

I must also point out that with out the Tax on Petrol (or gas as you call it "out West") we have the cheapest "gas" in Europe...12p a litre (5 litres to the gallon) with tax around 80-90p a litre...yep that works out around $8 a gallon for petrol..and a bit of a stiffer when your SBC only does 15mpg...if your carefull (and i'm not)...do have a mate whos lucky to get double figures from his rod (460ci alloy BB) but couldn't really care..his new motor is 570ci and he drives it like he hates it...
