Beware of this guy

    I just had a bad ebay experience and I thought I would pass it on to you guys so you can beware of this guy. The ebay auction on my Dodge closed a couple weeks ago and I sent out all the info to the buyer. To make a long story short, the guy never responded until the 10th day, sent a personal check then tried to pick up the truck the next morning!
    He had fairly good feedback but I think he was trying to pull a fast one. I know he sells a lot of old tin in Mount Airy, North Carolina under the business name Unique Automobiles and mayberryinternetauctions on Ebay. Just be VERY careful if you are dealing with him!

    The bank tellers don't know crap-ola. It can take up to 2 weeks for them to clear a check (worse case). He did the right thing.
     
  4. you didn't say what you put in your listing for payment terms , but i always put in my auctions CASH on pickup only
     
  5. I don't know about your bank but here in the sunny south they have personal bank managers that can and do check to see if the funds are avalible,,,,,FACT!

    I am not defending this guys methods,,,but having been in business and dealing with all kinds of banking transactions for more than 40 years I know you seek out the people that are in position to get you the information to make a desision based on fact. HRP

    It might be perfectly legit. All you need to do is either go to a branch of his bank (if there is one in your area) and cash the check there, or go to your bank and have your bank manager call his bank to confirm that the check will clear. I prefer the former but have done the latter many times but only when I had a good feeling about the guy.

    I left out the part about him cancelling the check and refusing to pay for the auction when I told him I wanted to hold the truck until the check cleared. Hummmm...kinda fishy!!!

    Your auction clearly stated cashiers check or money order only. He didn't follow your TOS. Therefore, you were under no obligation to even take his personal check, much less wait for it to clear.

    I've sold a few thousand items on eBay, and every once in awhile someone will come along who doesn't want to complete the transaction as stated in the auction. Usually, the problems are worked out, but not always.

    I'm guessing the check was good, and that the guy was insulted that you wouldn't accept his personal check. It's also likely that he will leave negative feedback, since you have left some for him.

    If I was in the same situation, I wouldn't have accepted the check either. Cashiers check or money order means just that.

    There must be more to it than you are telling. I'll accept personal checks but don't expect shipment until the funds are in my possession. If you tried the many ways of getting around the problem and he was not cooperative then I'd balk on the deal but I'm not sure that I could imply on the internet that he was trying to be dishonest.

    Just because the funds are in the bank today does not mean they will be there when the check arrives unless your bank can guarantee the funds will still be there. I don't think they can and his bank has no idea how many checks are in transit.

    I have driven customers to their personal bank for them to cash their check. I realize this was not an option for you.

    I've tried to have my bank confirm that a check was ok on a couple of different occasions. They'll do it, but the last thing they always tell me is that just because it will clear today, doesn't mean it will clear when it gets to his bank. If he removes the money from the account or stops payment on the check between the time you deposit the check in your bank and the time the check reaches his bank, it's on you. Or at least that's the way it worked a couple of years ago.

    i agree, i wouldnt give up something like that until "cash in the hand" is present.. otherwise he didnt follow YOUR stated policy... so tell that hard-ass to piss up a rope...

    For internet sales when the item will be shipped I'll accept Postal money orders. A cashiers check can also have a stopped payment order issued. In person I don't care who you are it's a cash only transaction, I'll pass on a sale before I'll take a check. Got stuck with one over 20 years ago and that will be the only time.

    Wow, Ive watched a lot of his auctions, he sells neat stuff. But that, if that is all there is to it (which I kinda doubt) would be super wierd and I wouldnt accept that either.

    He just does a lot of ebay biz so I would kinda doubt he would be that half assed.

    The way i see it is ....

    If he made the effort to DRIVE to pick up his winnings .... Why didnt he just stop at the bank & get you CASH ?
     
  17. That is a classic method of passing bad checks. They take the item home before you get the bounce notice.

    It looks like he saved himself the $35 bounce fee by paying the $10 stop-payment fee and keeping it off the bank records that he passed another bad check.

    Don't let anything out the door without the money, that includes making sure checks clear first.

    Likewise don't accept PayPal payments for any item picked up in person. Without an official tracking number, you can't prove delivery. They can take the payment back AND keep the parts if you don't have a tracking number; and you can't show that they took the parts.

    Beware! There are some bad Postal Money Orders out there. Wife works for USPS, yesterday she took five $500 M Os away from some guy wanting to cash them. All had the same #, but looked pretty good. E-Bay sale..OLDBEET

    Seriously...that's all there is to it! No joke. I personally think (which someone else mentioned) that he check was probably good and he got bent outta shape because I pointed out that he f*ucked up and didn't read the listing. After I sent the email below is when I got a voicemail on my phone yelling and cussing that "I could keep my damn truck" and that he could afford to buy 10 of my trucks. He even threatened that if I left negative feedback (for his f*ck up) that he would "make up a lie to make you look bad" *EXACT WORDS*...which he did.
    Maybe I somehow rubbed him wrong or something but like I said in my original posting....just beware of him! I'm not saying don't buy from him....just beware!


    Received your check today...I'm guessing you didn't read the entire listing. I am only accepting cashiers checks or postal money orders. Please give me a call so we can get this resolved. Give me a call 561-XXX-XXXX Thanks, James

    Contact ebay via the 800 number. Forward all communication to ebay dispute resolution department. He failed to follow your TOS and threatened you. If nothing else the neg against you will be removed, best scenario is that he's removed from ebay.

    A guy on another site (who I don't personally know) posted this...about sums it up.

    (THX 138) I called him and "CALLED HIM OUT" about the dealings mentioned here with unpunk01 and he said to mind my own Fing business and said he'd deal cars how HE wanted...and hung up!

    Well then......that just about says it all about his character & morals ... eh?
