In april I bid on and paid via postal moneyorder for one of the un***embled '32 beds sold by last refuge hotrods in dolores,co. Since then I've made several calls and e-mails. Onjune 18 I requested a tracking #. He supplied one that DHL now claims was never shipped. Does anyone know this guy or have bought from him? He seemed like a nice guy but now I feel like I was romanced. His feedback is great but I need my bed.Any ideas on how to proceed or anyone close enough to visit him?

I was told that if someone stiffs you & you paid w/ a postal MO, its a federal offense. Might wanna check into that & see what options you have. I don't know if its true or not, but it might give you some more leverage w/ the guy if he thinks the feds can get involved.

yep, it's a fed offense. do you have any lawyer friends who could send him a letter (certified)? you could send him a letter yourself, too. tell him your plan of action and then follow through with it. don't let him get away with stealing. it's not cool. i am in law school so i know a little bit about your rights... but cannot practice cause i'm not licensed.

If you have the money order receipt you should be able to find out if the money order has been cashed. If it has not you can do a stop payment on it just like you can with a check and it will be replaced.

If it hasn't been cashed the deal might have just "fallen through the cracks" and you'll have to start over with a new money order.

I would call them again and let them know the tracking number came back as invalid and you want to double-check the number and the shipping status.

If they cashed the money order and can't prove they shipped and all else fails you can contact the Attorney General's office and they'll write the business a nastygram on your behalf. Usually once the AGs office gets involved things get settled in a hurry.

Plus the AGs services are free when it's a consumer protection issue.

As there seems to be lots of HAMBers interested in buying these beds, me included [IMG], I hope that Norby at Last Refuge sees this and gets his act together. I was just about to send him some $$$ for one so now I'm waiting with the rest of you. Hope everything works out!

True statement. However, getting anybody to act on it, probably won't happen. The lawyer letter is probably your only course of action that has any hope, but most lawyers will tell you it's a bluff that'll be hard to follow-through on.

True enough - to a point. However, you can only get replacement MOs & the original MOs never expire. So even if he hasn't cashed them (yet), he can in the future & you're liable for them, so even if you cash your replacements yourself, he can still cash the originals. Despite those lost/stolen MO lists on the USPS website, they do not check the numbers & have no way of tracking them. I ran into this problem a few months ago when I thought several MOs were lost in the mail for a Harley basket case. I had much correspondence with the main post office MO office in St. Louis - very disappointing/frustrating that in this day & age, they can't better police their system. Makes me pissed just thinking/typing about it. [IMG]

I'm afraid your best bet is a legal letter threatening action. If he ignores it, you're probably SOL. You can try the AG's office, but having been a FL resident most of my life, I don't hold out much faith there...

Sheesh, I too was contemplating one of his beds. Guess its wait and see time. Keep us posted. Maybe send him a URL to this thread, he may have thoughts on potential lost sales.

    Oh man, Dolores, CO?

Let me tell ya, theres not much there.

I think the population is something like 18K and is about 450 miles from Denver. Its north of Cortez and Mesa Verde national park.
