    Depending on if this will actually be upheld,as it does seem a stretch. I mean by law I think it would have to apply to all trademarks so sports clothing and stuff,but have not seen how it was actually written up. Needless to say could allow th police to stop anyone with a patch just cause ..and if folks in your neighborhood don't like your car much :rolleyes:

    I cannot see that ever holding up in a cons***utional law court. Certainly not in this day and age of selling everything for a corporate name-the Sprint Cup,Heinz Field, the US Army drag racing team?

    It said they can confi****e any clothes, other merchandise and vehicles. They're holding 60 motorcycles, mostly Harleys, and they said "the customized machines" have a value of about $22,000. I'm guessing they misunderstood, and that's EACH, not total.

    I've got little problem putting murderers, drug trafficers and organized crime members in jail, but I can't see how banning the possession of a legal trademark is cons***utional. If it holds up, the Hells Angels have gotta be next, and after that, any gang.

    This difference is the ****ols are really bad-*** guys, unlike car club guys who just play "dress-up" bad guys.

    Exactly. I am mad far away from them, but it seems they are going after them for murder/drugs yadi yadi, not organizing a car/bike club.

    That is some **** tho...

    No, it isn't.

    Do YOU live in/near a bad area? 1 mile away from me is probably the worst area NJ has to offer, ridden with drugs/murder/gang violence. If they wanted to start getting gangs off the streets and clean the area up, I wouldn't say a peep about my freedom or civil rights.

    I find people with this type of idealistic mentality always seem to live in nice, quiet areas.

    Gee, I wonder if the ****ols ever "chipped away someones freedom" when "someone" got murdered, beat-up, kidnapped or had their kids hooked on drugs because of them..or when they completely ruined and terrified a neighborhood?

    I really doubt that this judge'e opinion would carry over to the
    "Daisy Valley WILD Mini-Truckers Club"

    There are already laws against murder, drug dealing, and ***ociating with criminal ***ociations (RICO), etc. How about using them to get the bad guys off the street, instead of p***ing laws that could be used against anyone here.

    What a joke lets take away a logo and the problem will go away .This is the dumbest thing I have heard of at least before I new to steer clear of a person that could cause me injury.

    I have to agree with Larry on this one. If the laws already in place were enforced across the board, or if society would just use good old-fashioned common sense, many problems such as this would fail to exist. Ahhhhhhhhh, common-sense, where have you gone...

    ok, some of you are now acting just like the media. you're reciting something you've heard or read without really knowing what happened and why. you're just perpetuating a rumor.

    61 members of the ****ols were arrested for charges such as drug trafficking, credit card fraud, and murder. the DEA has been working on this case for quite a long time now. the DEA is trying to get the ****ols trademark revoked and break up the club thinking this will cut down on crime.

    this is not the "government" h***ling a club because of offensive images on clothing. there are real and substantial charges against these people.

    and for what it's worth, this whole breaking-up-a-club thing will not stick, imho.
     
  22. The government has been unreasonably searching and seizing property for years. If you're arrested with wads of cash on you, regardless of how legally you may have obtained it, that generally gets taken away and you more than likely will never see it again. Property and cash can be seized without conviction by trial and not returned. Happens everyday in America.

    This is, as far as I can see, is both a First and Fourth Amendment matter but I bet it never makes it to the Supreme Court. And I really doubt that any local car club is going to be affected unless of course they are really are miscreants and lawless scoundrels.

    Well, this is a Freedom of speech issue and I am sure the ACLU is chomping at the bit to get at it.

    Every guy who makes silk-screened logoed T-shirts or other items showing trade-marks such Ford script or blue ovals, Chevrolet bowties, Chrysler pentastars, the Coca-Cola script or block letters, and so on, is hanging his *** out there to be the recipient of a summons to a court action about infringement of trademarks. It can be very painful too. Fines, confi****ion of all illegal items, and other penalties plus of course attorneys' fees. OUCH.

    Really? They hold fund raisers for charity and book sales so that kids will read and not just get hooked on violent video games? They support soccer leagues and promote racial and religious harmony and understanding?

    Obviously, not every motorcycle gang or hot rod club is "bad" and banning their trademarked logo is stupid, but these folks seem to be charged with some fairly serious offenses. Where's the good?

    What's the old saying.....Those who would sacrifice liberty for security deserve neither?

    As it stands, all the illegal things the ****ols have done are already against the law. And there are racketeering laws on the book to address the "organization"

    Perhaps instead of grinding away at my freedom they could enforce the existing laws.

    If you want to support this go ahead, you're free to do so in our great country.

    But when there's a bad year and 2 or 3 car clubs get national news coverage for bad ****.........don't be suprised when the law starts looking into YOUR business and talking about confi****ing your hard earned belongings. But it'll be too late, cause you let the ball get rolling.

    I have to agree with Larry. It is chipping away at your freedoms if they can target someone's trademark. I have issues with the whole RICO thing in general as it is written. It is overly broad and written to allow them to usurp the need to actually catch some people.

    I agree... it won't hold for the trademark, if the other charges are legit they should stick though and that's the part that counts.

    again, yes....

    yep... wouldn't you want the bad guys to wear a sign that says, "hey I'm a bad guy"?

    Just don't do stupid ****. How about that. If one or two car clubs do this kind of garbage there still would be no grounds for a nation wide sweep of car clubs based on what this one or these two did. By supporting this action I am not giving up my "liberty for security." Just don't break the law and you won't get in trouble. I find the people most concerned about things like this are those who are already involved in fighting "big brother" or are worried that their activities will get them in trouble too, and usually they are one in the same. How about those clubs that are just organized and enjoy getting together and talking/looking at cars? Maybe go cruise to a fast food joint or hang at a members house building a car. There is no way that this ****ols **** would have an effect on reasonable and honest clubs. It only effects those who violate others' rights and that are a pox on society.

    If this means that YOU, wherever you may be, are not allowed to wear the word "****OLS" on your back with any picture of a bald guy on a motorcycle and the word "CALIFORNIA"- Then that IS a violation of your first amendment rights. It would be dumb to do but you have a LEGAL right to wear them. I am not defending these guys but it is a very slippery slope to the next image and the next image and so on. Think about it. You are allowed to wear a ********, dead fetus, Muhummad, etc... in the name of free speech. Some of these images may be violent, distastesful, disrespectful or whatever but the bottom line is that our right to display whatever we want in the name of free speech is a HUGE part of who we are as a country.

    The judge initially issued an injunction Tuesday, but that order was limited to barring the sale or distribution of the logo. New language was added, saying the gang members and their affiliates "shall surrender for seizure all products, clothing, vehicles, motorcycles ... or other materials bearing the ****ols trademark, upon presentation of a copy of this order."

    If you met one of these guys once, and they bought you a beer, you're affiliated. If they gave you a support sticker, and you put it on your bike, guess what?
