Calif law stoping private party car sales?

  1. Today on the Radio news a friend heard that California is trying to pass a law that an average person will not be allowed to sell his or her car, By putting a FOR SALE sign in the window. The car must be sold to/by a Dealer, New or used car Dealer, but cars wont be able to be sold between two private parties. Now is there any Truth to this?

    I can't find anything on this?

    California will never get it's act together and it's tragic. I have yet to hear of this proposed law but nothing would surprise me.

    There is a law in NY that only car dealers can have certain information on a for sale sign that's on a car. Something like only dealers are allowed to put the price on it or something stupid like that.

    It's just one of those laws that no one enforces, maybe that's what they're looking to do?

    Consider this, firearm sales are already controlled like that. I would imagine what they are looking at is, you would still be able to sell your car to your buddy, but you would have to accomplish it thru a dealer. Think of the savings they would have by not operating as many DMV offices. There would be no more sales tax revenue losses by people putting down bogus prices. And best of all no sliping thru the cracks on emissions testing. Now I am not saying that this is fact but coming from Calif I sure could see it happening.

    In some cities in CA it is illegal to park a car on the city street and post a for sale sign in it for the purpose of selling it, could it be they are trying to make it state wide.

    That law was struck down by a San Bernandino court years a few years ago as a violation of Freedom of Speech. Check with your local police to see if they are enforcing it.

    WOW, I can't actually believe that you guys believe that there is a law in the works that you have to sell your car through a dealer...!!!

    This, is yet another one of the "hand-wringing on the HAMB saturday nights" coming straight at ya...

    i heard about it. it said something about all pre-smog cars having to be sold though dealers. sema will be all over this one

    Congratulations! The California old car hobby convinced California Senate legislators to amend legislation (S.B. 1549) that sought repeal of the state’s current emissions test exemption for pre-1976 vehicles registered by new owners in the San Joaquin Valley Unified Air Pollution Control District. The District includes eight counties in California’s Central Valley. Under the original bill, after Jan. 1, 2009, new owners seeking to register a pre-1976 vehicle in these eight counties would have been subject to emissions tests for the life of the vehicle. Under the amendment, the repeal language was removed and the bill instead now requires the DMV to study the state’s special license plate programs and recommend improvements.

    It may become a little bit harder to sell your car the cheap-and-easy way in Los Angeles.
    The City Council today will consider imposing restrictions on car owners trying to sell their cars by parking on city streets and putting a "For Sale" sign in the window.
    Councilman Tom LaBonge, whose district extends from Koreatown to the eastern sliver of the San Fernando Valley, says that some residential streets have turned into de facto "used-car lots" and have become a blight in neighborhoods. LaBonge’s motion to restrict the practice comes before the council’s Public Works Committee this afternoon.
    Several years ago, Los Angeles prohibited the sale of vehicles on city streets, but that ordinance was challenged by the American Civil Liberties Union in 2000 on behalf of a man who received a parking citation. Eventually the ordinance was tossed out by a federal judge who saw it as a violation of the 1st Amendment. The city later repealed the ordinance.
    Today, the council will consider adopting restrictions similar to those imposed in Lawndale, which limits owners from parking for-sale vehicles on city streets to four consecutive hours in one spot. There are no time limits imposed on vehicles parked within 500 feet of the owner’s residence, however.

    Docc, big difference between putting a sign on your car and not being able to sell your car to a private party...

    In Fresno, Clovis and Madera they got around that by putting a time limit on the length of time a car can remain in one spot at a time. I believe it is 72 hours correct me if I am wrong, I personally watched them tow about seven vehicles from herndon and fresno street.

    the law about parking your car with a for sale sign in the window "parked with intent to sell" as my buddy called it, was meant to stop 20 cars parked on a popular street.

    of course it was turned into a way to hassle people. I got one where my car was parked where I always park it in front of my apartment on a side street. guess you are supposed to take the sign out when you park?

    as for the original topic here... no way. but if it does pass I'm gonna become a dealer who takes money for nothing and sells peoples cars to other people.

    If we can`t sell our own car then we won`t have any money for them to take out of our pockets and we all know thats the only reason they want us around is for our taxes etc. Also it is just another attempt by city & state to get rid of all the older cars. Whats next?
     
  23. As usual on here a bunch of stuff gets confused and woven together..
    The original poster question had to due with what DOCC answered which is totally different than the smog issue that, as reported by SEMA was already defeated. Two different issues.
    And it wasn't all of California just LA that was trying this. If it passes it will be challenged, again.

    So, there are two questions raised by the original poster of this thread:

    1. putting "for sale" signs on a parked car on a city street.
    (it has been tried in the past and some cities have put a time limit for a car with signs to park in one place...we will see)

    2. not being able to sell your car to a private party
    (well, that isn't going to happen, and I doubt it is even being proposed)
     
  25. The problem with a law like that is just like locally, where they passed a law banning the sale of cigarettes to 18 year olds in this county. There's nothing stopping those kids from leaving the county - there's nothing stopping you from taking your car out of the state, or buying one out of state - I'm sure someone at the state level will be able to understand that, unlike the 8 or so idiots on the board here.

    I live in a small community between Conroe and Houston. They have an ordinance that says you can't put a for sale sign in your car window. Me being the law abiding citizen that I am has a "Might be for sale sign". I caught flack over it the first couple of times that it was in the window. Nice officer knocked on the door to tell me, I could not have a for sale sign and I agreed. He read it ,laughed and went on. No more problems
