    I'm actually quite flattered. Oh, and their logo ****s compared to ours. Not really any legal recourse. All you have to do is change something 10% and the Trade Mark no longer matters. If you look at the over all design, they used our wings and center circle. Chad will have to chime in here, but I think the "Hot Rod & Cycle" font is close to ours.

    I was talking with Shoebox Mags this morning about it, and I would rather MAKE THEM sell our shirt. :D

    I've been wondering two things:

    1. Did the ***hat that copied our design even know what a "Ch***is" was, and is not knowing why he deleted it from the logo? :D

    2. How many people will do a google search for "Hot Rod & Cycle" and browse to our site because of Kohl's? (Maybe we should secure www.hotrod&cycle.com) LOL

    The font in your logo looks like 'Copperplate'. Their font might be a narrowed version of Copperplate aswell.

    Did you have your designs TRADEMARKED before you put them out on the market ?

    I looked at both pics & the only thing that is the same is they share a common style with the wings.

    But then, I have seen that in Military & Motorcycle stuff for years.

    I see no "RIP OFF" but maybe its just me, Post up a pic of Each in the thread so people can see instead of opening up different sites to try & compare.

    Also, I must ask HOW do you pronounce " chrome CZARS " What is a CZAR ?

    I f you can make them sell your shirt you will for sure come out with the upper end of the deal.DO NOT GIVE THE SOLE RIGHTS TO SELL YOUR SHIRTS in the event you break a deal.

    A Czar is a russian prince but it's gotten to be used to mean anybody in charge of something - a guy that runs porta-pottie company might get called an outhouse czar, the guy in charge of Hertz Rentals might get called a Rental Czar or something....

    It is actually an emperor or king but was most commonly used by Russian rulers. Also spelled Tzar or Tsar. I would like to meet the Hertz rental Czar though:D

    My wife actually bought me one of those shirts thinking it was cool. I really liked it until now... Might break her heart if I don't wear it anymore...

    I'd imagine it wasn't Kohl's but the ***hole T-shirt company that 'ripped' you off...

    Wally World has been doing it for years...buying from companies that rip everyone off...

    Today, all it takes is a clik to steal something, then modify it 10% (change the font, or change the wings slightly, etc.) and you've got your "own" design that you can use on anything...and it's perfectly legal.

    There's even ***holes right here on the HAMB that'll rip you off...maybe not those that post a lot, but those that lurk...I had a line drawing of a '32 Ford 5 window ripped off...and the ***hole made the mistake of posting the modified version in the Friday art show...I'd ***ume Norwell or Ryan banned him from posting, but like the rip off artist he is, I'll bet he's still stealing from everyone...

  24. You'd have to go look at the tags on the shirt to figure it out. Some stores have store brands for clothes and shoes and stuff, and some don't, and it would depend on which one it is as to just who ripped the design off.

    With the economy so slow they might just pay you off to go away to avoid any bad publicity possibly cutting into sales, but it would take a real lawyer to tell you if it would be worth the legal fees to raise a stink about it.

    It looks like Sonoma is Kohl's in house brand, or so it seems with a quick search.

    Rick, it's definitely a derivative of our logo and Tshirts. It's no secret that our logo is based on an old WWII aviation mechanics insignia, but you're right... the wings look (good and not so good) has been used ad infinitum for decades by a mul***ude of organizations.

    Our font is indeed Copperplate. They used something like Matrix Narrow. But look at the wings with the circle, their generic use of stars, the curved type at the top that says Hot Rod & Cycle instead of Hot Rod Ch***is & Cycle, the script font at the bottom. This particular shirt doesn't show it, but we have them "distressed" as well.

    Does this mean we are somebody now? :D

    Your logo is copyrighted? We have had one winery and another business here locally have to change their names and logos because they were "too close" to another companies logo.
    This is probably one of their grab the cash for the season and run things but it wouldn't hurt to be positive you are the one in the right.

    Yuppers, I'd say that makes you someone.

    It is flattering that someone like your design...but on the flip side, you did all the hard work and they are profiting from it. That isn't right. I would 100% for sure go after them. Either royalties or make them sell your shirts. It is only fair.
    I have had people steal my stuff before to make a profit and it pissed me off. On the flip side, I have stolen stuff before as well...but not for profit. It is a hard line to define.
