Damaged during shipping help??

    I have a 35 Dodge that is being delivered to me. The shipper told the guy that sold me the car to drive the car up on the tow truck while he directed him. Something on the tow truck caught on the drain plug of the TH350 Trans pan and caused it to cut right off and out came the trans fluid.

    The seller immediately called me and told me what happened. Then the company called me asking me if I STILL wanted it delivered after this happened, I said yes but that I'm also holding them responsible for the damage. They said, well the seller drove the car up, not them. I asked why he was even allowed to drive the car up and that I don't know any company that would let that happen or even ask the customer to drive the car up. He admitted that the company does not allow that. So I said, well if the company does not allow it, then the driver should not have allowed, let alone instructed the seller to get in and drive the car up and therefore is responsible. Furthermore, the driver didn't even fill this incident out in his pickup report. His boss had him go all the way back to the sellers house to fill out that the incident occurred. The company person on the phone said he would talk to his boss and the driver and get in contact with me. This was on Wednesday. I haven't heard back from them yet.

    Recommendations? How do I handle this? The car won't be here for several days so I just wanna know what to do. Do I withhold some money at the time of dropoff? I don't think they would release the car to me then.

    Well not for nothing,,its a drain plug ,,rethread if need be and put one in.. I understand what your saying,,but it is an easy fix

    Doubt I could. Seller welded around the plug to hold the plug in place for transit and such. So I need a new pan.

    TH350 pans are everywhere,,pan gasket your time $30 bux...Again I understand what your saying,,but I would be more concerned about driving the car,,,for what it is,,Can't see not paying,,get the car fix it,,then go after them

    yeah pans are cheap , call it a wash and just buy a new one , lot less h***le

    Think you're going to get in a ******* match over something pretty inconsequential. Fix it and smile as you drive your new toy that will already be personalized by you!

    have the seller give you the 30 bux for the pan, buy a new one.. enjoy.

    Fix it. Total up what it cost and bill the seller. Don't sweat future cir***stances or guesses, until you need to. In the end, it's no big deal anyhow.

    Now you can change the filter,trans fluid and have it adjusted.
    Then,that's one major thing you won't need to worry about once you start driving it.

    I would not try to hold back any money from the shipper. Unless you want to see you car drive away on that transporter and pay storage fees.

    I have a drain plug on my Th 350. I cant see what the hell would rip it off. Mine is a TCI. But those pans and gaskets are cheap enough that I would just right it off and fix it .

    I don't see anywhere you said anyone quit trying to drive it with no fluid in it.
    If someone continued to drive it after the fluid ran low, it could be more internal damage than just a $20 pan.
    So?
    Did everyone involved have enough smarts to NOT start it up again?

    I would just buy another pan and drop the "drama". It's not that big of a deal.

    Welded around the plug for transit??? Was he afraid someone going to steal the trans fluid? Or do the plug fall out when hauled? :rolleyes:

    Sounds like it was something that should have been changed even if the tow truck did not hit it.

    Like others said, fix it and move on. Give the bill to the seller if you like. He is the one that welded the plug in.

    The seller welded the plug back in and put some JB weld around it to hold it in and gave the driver some ATF so he could use it to get the car on and off the transport.



    I'm thinking I will do what several people above said, install a new pan keep records of it and send it in. Like others said, it's not too big of a deal. I'm realizing it now. Just guess I was more angry at the shipper then anything else.

    i would have to agree with this, I would tell the shipping company that you are going to take the car to a shop and have the motor inspected for internal damage and tell them they should front the bill of any possible repairs due to no oil in the motor and it being ran. Remember it only takes a few seconds for a motor to burn up!!!

    I think you might mention the name of the transport company. While anyone can make a mistake, this company's not doing much to help you out. There are enough shippers out there, and they probably need work, that this one could be avoided.
