Hit by a Drunk Driver after Billetproof.

    I was heading to the Mutiny to get ready for our show there after playing Billetproof when my 99 Ford Van was struck out of nowhere.I thought I was dead.Apparently a drunk guy doing 65 in a Residential T Boned me.The first face I seen was Mitch from the Mutiny lookin through my window, I didnt know he lived right there on tenth st. and seen the whole thing.I just got out of the hospital today with a broken collar bone and a left shoulder seperation and some cuts on my hand.I have some pics of of my van I might post later.Its hard to believe I didnt get kiilled, if I were driving my 34 Ford or any other car I wouldnt be here today for sure....I'm pretty pissed off at this ***hole who hit me..:mad:

    Glad to hear you came out alright...that **** pisses me off to no end! I nearly lost my Dad to a drunk driver....

    Damn man, that's awful. I sure wish you a full and swift recovery. As to the drunken ***hole, hope you can get a good lawyer to clean the ****ers clock. There is no excuse for drunk driving. Best to you. Mike

    ****s man.... seems like here in ohio the driving has gotten exponentially worse over the last 6-8months. Lots of erratic moves and aggressive driving..... and that's not even drunk. Seems like I can't even make it the 30mi trip home from work each day without some dumb**** on a cell phone doing about every other activity besides driving almost hitting me.

    Really makes you think twice a bout your build quality and safety. Used to think that it wasn't a big deal, now seeing the change in driving habits, I'm starting to think the other way.

    Anyway, sorry you got injured, he'll get his eventually. Hang in there and get well.

    Wow man.....Glad you are OK. Could have been worse. I hope the guy had insurance and you get a decent settlement. The fact that the guy was driving drunk means I have no sympathy for him. What ever it costs him, he deserves because he hurt someone because of it.

    Just ****s because I have to cancel some big shows we have scheduled coming up...I dont know if the guy has insurance yet or not.I need to get a copy of the report from Antioch PD.

    The law moves slowly, but let me relate a little tale to maybe get you to move on this first step.
    A friend was hit by a drunk driver. He was taken to the hospital, along with his wife. He was checked and released, she stayed overnight. They had to take a cab home. The next morning, the kid that hit them was in court. Seems a family friend was a judge. The judge opens the proceedings and asks the open court if anyone has a claim against the kid, knowing full well the people hit were not present. Nobody spoke up (obviously), and the kid skates. My friend had to sue the liquor store that sold to the kid for their injuries. Could not go after the kid. I still don't know how....
    Moral of the story is get stuff started NOW, you can always drop it later...

    Glad you're alive, even if a little banged up!

    Man it wasn't until I was in a head on collision with an 'impaired' driver that I learned to appreciate airbags, the more the better! And I discovered my O/T car was great head on, but **** for side impact without the airbags, and your odds of brain damage were really high!!! ****ing hell, who knew?!?

    It's almost enough for me to put 3 point belts in the '51.


    EDIT: I forgot, contact a lawyer *TODAY*, one that specializes in injuries or you'll get nothing. The insurance will sweet talk you(please tell me you have uninsured motorist coverage), and tell you they're going to fully compensate you for your pain and suffering, they're smooth like honey to convince you that you don't need a lawyer without saying it in so many words. They'll also try to record an accident statement. Talk to an attorney NOW , if you wait a few days it'll mess you up. You deserve to get a few bucks for the added aches and pains you're going to suffer later on for this, nobody gets away scott free.

    Sorry to hear that! The bad thing is I heard there are no punitive damages in California or you could clean his clock. I'm an out of work claims adjuster here in Georgia and if it happened here, you would be looking at $5000-10,000 just in punitive damages on top of your medical bills and pain and suffering. If he has a history of DUI's, it would be more. Thank your California legislature for that bright idea! Get well soon!

    Heard the story from Mitch early in the AM on Sunday... SO SORRY you got caught up in that crash. Mitch said the crash was caught on cell phone video by a bystander. Hook up with him for that contact info and get your legal ducks in a row NOW.

    VERY glad you were not seriously injured.

    I'm always sorry to read about good people getting involved in **** like this. I don;t know you, but I wish you the best in your recovery.

    As others have said, get a lawyer. My situation was not quite like yours (got hit by a cop car), but the one smart thing I did was lawyer up. Be patient and get copys of ALL do***ents and take as many pics as you can.

    First of all,it's good you can still type!!!I wish you are fully compensated for your loss of property too!
    I hate ****ing drunks and hate drunk drivers worse.Drinking and driving is one of the few things that really pisses me off.Accidents happen,that's why they are called accidents.When a drunk gets in a car,it's no accident.Two beers can impair judgement just enough to turn a close call into a ****ing funeral or put a kid in a wheelchair for life

  24. I think I would have filed a civil suit against the judge personally. Even if it gets thrown out, you get a reporter in on it and it sends a message. Or go to the state's attorney general with it.

    It just goes to show, though, that you should be calling the lawyer as soon as you hang up with 911, which is kind of sad. On the bright side, at least you weren't hurt any worse, you're still here to tell us what happened.
