  4. I agree 100% with this logic and here's a great statement I read once:

    "I respectfully decline to answer any question, make any statement, or submit to any procedure without an attorney present. Please inform me if I am free to go."

    Say this calmly, say it once, and then you shut up.

    As I found out first-hand locally, our municipality (and I suspect a shit ton of others) are allowed to legally re-issue a ticket if an error (I would guess losing all copies is the ultimate error) is made as long as it's corrected before the next scheduled process has begun.

    My replacement ticket came with a 'reason why' explanation list and some legalese number (Article IV Ord. 34 blah blah blah) that allows cops to do such. This lady cop easily had the sequence order to nullify your ticket and more than likely the video evidence to reconstruct. Sucks, I know.


    You do have one advantage, tho. You hold both tickets and matching up the first one to the second may provide you with a key discrepancy that may allow you to win, yet. Give 'em both a good looking over.

    Bottom line: You are F'd because the cop will get away with all of these shenanigans in court because the judge will side with her and because that same judge will ask you if you had parked there that way and you are not going to lie, you are going to say 'yes I did'.

    If you have resigned yourself to the fine, get ready to pay up because you will despite all of the barracks, bar room and jailhouse advice you have gotten on this thread.

    If you don't want to pay the fine (doesn't mean you get away scot free since you have to pay your attorney), then get an attorney.

    Only an attorney will be able to intercept the kangaroo actions you are about to encounter.

    Personally, I ALWAYS enlist an attorney whenever needed because there is no way I am ever just willy-nilly giving up any of my rights. The fact that attorneys cost money is just a bit of the price you pay to make sure that you enjoy the freedoms you are entitled to in this country.

    However this ends, make damn sure that both tickets are cleared by the court. If they aren't, one of them is going to pop up with an arrest warrant for failure to appear.
    Her screwup is starting to snowball, and I suggest you lawyer up rather quickly.

    I am not a lawyer or LEO, and have never played one on tv.....

    I would call my attorney to see where I stand. Unless there is a lawyer on here that is in your zipcode, you will not find the answer you are looking for here.
