    My sympathy goes out to you. Lots of good suggestions have been posted on here. Don't give up without a good fight. I never leave my cars in storage without checking in on them at least once a month, maybe twice a month. It takes about two minutes to do. Cheap storage is risky business, even secured storage garages kind of bother me. Not much between the thief and the goodies. Good luck and I hope you get it back for a reasonable price. I don't mean to come down on you....I just don't like to leave my cars out of my sight. Paranoid......maybe a little.

    DO NOT report it stolen. You will be guilty of filing a false police report and on Grand Theft Auto that could turn in to a felony, at least in some parts of the US.
    You need to look into local laws concerning vehicle tows and the amount an impound lot can charge. You also need to see if the lot is legally bound to try and locate the owner and they then would have to prove they indeed did this. The landlord was within his rights to have it towed as it was unlawfully left on his property.
    You might be able to sue your alleged friend for not taking "reasonable care" of something that had been left in his possession for the expressed reason of storage. You had a legal contract with him for this by the fact that you were paying him for the storage and he was in turn paying the landlord. A verbal contract will hold up in court and he would have a hard time disputing this as you had previous years of doing this with him and he had been accepting and making payments up until the time of abandonment. You can also sue him for fraud for failing to pay the landlord when you had been paying him in good faith. Of course he probably has nothing of value, but a judgment could at least cause him to have to pay you from whatever income he might have.

    Reading this story just about made me cry. Ignore the folks who beat you up 'cause you didn't check up on it, history makes us trust our friends (that's why they're friends, right?)

    Finally, I note that nobody has mentioned the side story here. The 'friend' did this because of drugs. It's what they do to you. It's why they **** (not the boring, everyday, ordinary kind, just the nasty **** - meth/crack/etc). That's the saddest part of all. A normal, ordinary, everyday kind of guy got ****ed up and did EVERYTHING he could to stay that way. The worst kind of horror story.

    Good luck getting the truck back, I hope the impound screwed up and didn't tell you, that's probably your only hope.

    Bolt cutters, a new vin plate and ***le sounds like a better plan to me. Then again. there are certain states that I fear entering for some reason or another. :p

    You're telling me they can tow thousands of cars, yet have no legal way to contact the owners to come retrieve them? ********.

    You have grounds for a case here. Contact a lawyer and get some clarification on the laws. You may still be out some funds because in the end, you, your buddy, and the towing company all have some blame in the situation.

    I think I can help here. I'm no lawyer but did find the section of Ontario's law dealing with towed cars. You can read the full law here:

    The part that applies to you is:

    Notice to owner, etc., in certain cases
    <!-- TRANSIT - HYPERLINK --><!-- .http://www.e-laws.gov.on.ca/html/statutes/french/elaws_statutes_90r25_f.htm#s4s4. -->(4) Where the storer knows or has reason to believe that possession of an article subject to a lien was received from a person other than,
    (a) its owner; or
    (b) a person having its owner&#8217;s authority,
    the storer, within sixty days after the day of receiving the article, shall give written notice of the lien,
    (c) to every person whom the storer knows or has reason to believe is the owner or has an interest in the article, including every person who has a security interest in the article that is perfected by registration under the Personal Property Security Act against the name of the person whom the storer knows or has reason to believe is the owner; and
    (d) in addition to the notices required by clause (c) where the article is a vehicle,
    (i) to every person who has a registered claim for lien against the article under Part II of this Act,
    (ii) to every person who has a security interest in the vehicle that is perfected by registration under the Personal Property Security Act against the vehicle identification number of the vehicle, and
    (iii) if the vehicle is registered under the Highway Traffic Act, to the registered owner. R.S.O. 1990, c. R.25, s. 4 (4).
    Contents of notice
    <!-- TRANSIT - HYPERLINK --><!-- .http://www.e-laws.gov.on.ca/html/statutes/french/elaws_statutes_90r25_f.htm#s4s5. -->(5) A notice under subsection (4) shall contain,
    (a) a description of the article sufficient to enable it to be identified;
    (b) the address of the place of storage, the date that it was received and the name of the person from whom it was received;
    (c) a statement that a lien is claimed under this Act by the storer in respect of the article; and
    (d) a statement advising how the article may be redeemed. R.S.O. 1990, c. R.25, s. 4 (5).
    Effect of failure to give notice
    <!-- TRANSIT - HYPERLINK --><!-- .http://www.e-laws.gov.on.ca/html/statutes/french/elaws_statutes_90r25_f.htm#s4s6. -->(6) Where a storer fails to give the notice required by subsection (4), the storer&#8217;s lien as against the person who should have been given the notice is limited to the unpaid amount owing in respect of the period of sixty days from the date when the article was received, and the storer shall surrender possession of the article to that person where the person proves a right to possession and pays that amount. R.S.O. 1990, c. R.25, s. 4 (6).


    The way I read it is that unless they can provide proof that they notified you that it was towed, you owe them for the tow and 60 days of storage. They can't charge you any more than that.

    Updated News Hambers.

    I have been trying to have my friend who owns a Transmission shop help me in this matter and I just found out that, They were to advise me after 60 days that the truck was in their possesion which they did not do. Right now they are giving me a price of $2,200 right now but my friend who knows the owner is trying his best to get the amount reduced for me.

    A sad tale to this story is the day the Truck was towed my FORMER Friend's Girlfriend had called the towing company to try to get the truck back and at that time the charge was $400. I just wish she would have had my interest in mind to give me a call but I guess she was scared to call me and that when she told her boyfriend he stated he would take care of it.

    But as you all know he kept telling me up until February that my truck was fine and that he checks on it each day.

    This storage place is a safe and Climate controlled Senior's Building so my trucks have always been safe. They have daily security and camera's located throughout the underground parking. There are many great RIDES stored there, some that have not been touched in YEARS.

    I will update as to what happens.. It so sad as I traded the truck last Fall to have my Kitchen redone for my wife and to cut back as I have my two other trucks and wanted to keep my wife Happy.

  14. FWIW it looks like this place is asking for about $50 a day. I know a guy here in NY who's currently getting $40 a day for outside storage. It's a scam - they want the bill to get too high for you to be able to buy the car back so they can auction it off. But it's a legal scam.

    Now that you know the law, I think I'd just get some quotes from a lawyer like I was them and had to defend a lawsuit from you, itemize that cost and subtract that from the 60 days, and just tell them "look, if I have to pay more than this, I may as well pay a lawyer and court costs and add that onto what I sue you guys for" ...
     
  15. Unless someone at the tow company loves the truck they'd rather have the money.

    If it's just 60 days that's better you can always take care of your "friend" later.

    I read on another (or maybe this one) were someone had there car impound and when they went to get it there was a high fees. He found out through a lawyer that the impound lot would charge high fees if they wanted the car for them selves. He also found out that it is Fed law that a impound lot can only charge either 20 or 25 a day not sure which. Maybe there is a law like that in Canada.

    Update.

    Finally settled with the Towing company on a bill of $1,000. I have to go look and pick it up next week.

    Only problem is that it was stored outside in the snow and rain since November.

    I hope its all fine and that their are no damages to the old Girl.

    My wife is happy again as she is still getting her new kitchen and the guy I traded it to is Pleased as well.

    The only thing now is to find that ***** that was once my friend and see if I can get my money back.

    Really? You own this nice F2 but you haven't checked on it for months...your friend is a druggy? You traded the truck months back for work in the kitchen? WHAT THE HELL MAN? Why did the guy you traded the truck for kitchen work not already have the truck by now....surely he looked at it before a deal was made to trade....Sounds fishy to me but if you got it back I guess all's good! Hope you learned your lesson!:(

    I was in the towing biz for about 10 yrs and ALWAYS tried to contact reg owners when I impounded. I had one of my cars stolen in early 06,(prescription druggy ex-girlfriend) car was picked up next day at the state line. Impound lot was in my state but didn't try to contact me for 6 months. Said his wife ran the VIN wrong when checking for stolen. Car looked like ****, bill was 4200.00 neg down to 2k. If he had been straight up I would have had my car within a week of being stolen........................BUT you know the sayin "Screwin you get for the screwin you got"!!! peace

    My brother "lost" our family 1957 Nomad in Baltimore pretty much the same way. My mother bought the car new and it was impounded and sold in 1966. I still search different sights looking for that car. I personally lost a 1946 Dodge 2.5 ton in Florida in 1985, same way. Have looked for that truck everywhere, heard it went in to Pasco county. I feel for you, friend!

    nevermind the new vin plate that one is ***led and registered to you and the truck is legally yours , think this through first but if it were me i would rip down the fence (bring a steak and a bat with ya) ,take my truck back , and deal with the chances of getting caught for tresp***ing and destruction of property and breaking and entering (no grand theft cause the truck is yours) all very serious charges and expensive to get out of ,but it is your word against theirs ,and they likely have cameras on their lot , so i would be sure to do everything you can to not appear on those cameras . stick to the fact that it must have been somebody looking out for ya and doing what is right but you have no idea who , you woke up one morning and the truck was out front of your house , if it comes down to you getting questioned . although it rarely ever occurs this way , you are innocent until PROVEN guilty . be prepared to deal with the aftermath of this as the lot owner may think like me and spend the rest of his life (however long OR short that may be) and make the rest of your life miserable . too much ******** goes on in this f'd up world , we really need to start handling our own business and owning our decisions and actions. good luck to you and if you use these methods to get your truck back good for you and no need to update this thread . it's amazing how much more confident a man is once he's made it clear to himself that he is self sufficient . as for your friend , write him off ,no good will come of "discussing" the situation . if the value of this truck, monetary or sentimental , doesen't add up to enough to make ya do potentially life changing things , write the truck off as well ,get in the stude and go out and clear your head of it , and pick up a kitchen remodeling HOW TO book from the local hardware store while you're at it !!

    i worked for a towing co. they have to send a certifide letter to the last reg. owner. they let it go just to make the bill big so you would give them the truck. good luck.

    Congrats on getting the bill down to $1000. I'm sure you've worked hard enough on this deal to have learned a lesson....
    Wish I could find my old 30 ford pickup stolen from me.

    Get your grand back in satisfaction. Tell everyone you meet about the $1000 screwing you got from the towing co. and they'll lose that $1000 in lost business.

    Then find that punk 'friend' and kick his ***.
