    Good valid points. As you may recall I did say being willing to help within reason. What was done was outside anything reasonable to be sure.

    The guy did plan on trying to change the deal at the last minute and that was not cool at all.

    Ummm I know this thread oughta die out...but I'm intrigued as to why anyone thinks a deposit to "hold" a car should be refundable. As others have asked; If it's refundable...why bother?
    Sure you can set specific rules for a particular deal...like earnest money on a home purchase...it may get refunded, say if your financing falls through..or your current home doesn't sell, but that language is in the contract. Try backing out for any other reason, the money goes to the seller.
    So... if the agreement consists of: "We have a deal, I'm buying your _______. Here is a deposit to hold (deliver or whatever) it until we can get together to complete the transaction"...or similar...Why any question about the deposit?
    Most big boys have been on both sides. I know I have. Being justly compensated for even just taking the ________ off-the-market is as fair and decent as anything else could be.
    Yes, I've lost money 'cause I couldn't make the deal happen like I said I would. It hurts, but it happens.
    But, it's business gentlemen, properly, ethically and nobly done. No shame, no dishonor, no disgrace.

    another member of the "Deposits are non-refundable" crowd. If i make a deposit i expect that if i fold its gone... but then again i am a serious buyer and dont go too far out of my means..

    I sold my 62 Biscayne to a guy from the Midwest. I sent him over 100 detailed images, he sent me a $1000 non-refundable deposit. After waiting for him for months to pick up the car he finally showed up and proceeds to tell me that he saw a better one in PA on his way out.

    He asked for his deposit back. I told him to take a flying leap and then proceeded to lower my garage door, lock the shop, and go into the house. He stood there dumbfounded and finally left.

    I still have the 62 and glad about it. Non-refundable deposits are just that, non refundable. You should have kept the full deposit.

    Good luck with selling our car.

    Yep, "no refunds on deposit", I have had to do it and the reason is after I held the car of someone, had many calls about the car and had to tell them it was sold.

    If the dip shits can't get their crap togather and come up with the money, it's not my problem

    I look at it this way ....
    I get paid by the hour at work. My time costs money (if we arent friends). My efforts cost money. Advertising cars for sale (often) costs money. If you are to suck away my time and efforts and waste my advertising, you'd better be paying.... and the same goes for the reverse. i expect to pay so i agree on a deposit that i can lose without breaking the bank, even sight unseen if i want something and time is of the essence. Just today i dropped a $200 deposit on a '78 Mini Clubman i am picking up on tuesday. If between now and then i need to re-neg on the remainder then for what ever reason i got out of it cheap and done the honourable thing. i would not be chasing $1 in refunds.

    Should've kept the deposit. How does he know you didn't turn down anouther cash offer after he gave you the deposit. A court would see it the same way. I've had guys insist of giving me a deposit, I generaly say $100 bucks and set a date for pick up.

    I think you did more then your share, taking a deposit, delivering the car and then returning the deposit. Don't know if I would have done that. The last two cars (both high dollar) I've sold were literally the "car sales from Hell." Can't tell you how many phone calls I received from prospective buyers who were trying to set up times for coming to look at the cars. All were from out of town with many wanting me to meet them somewhere so they could see them. Thats was never going to happen. One guy BS'd me so much about coming to look at the car, the day he called me saying he was on the way to my house, told him stay home as someone else is on the way to take it home. I could be typing on this key board for an hour telling you all the BS I went through selling those cars. That method of payment issue was a real problem as well. I'm at the point now I dread even the thought of going through another car sale.
