I have a deadbeat customer who owes me a substantial sum, I have the car and possession and could use a hand on what to do next...

    Thanks

I'm not 100% certain but I'm pretty sure all you (as a shop owner) need to do is go to DMV and get the paper to file for a mechanics lein. If you file for abandoned ***le they will try to contact anyone who's owned that vehicle, and that guy can just say "yup, its mine"...

I blew that one (see post 5). That is where read before copy and paste comes in.

Every state is a bit different on this so reading though the laws themselves will probably tell you where you are at.

http://www.azleg.gov/ArizonaRevisedStatutes.asp?***le=28 Chapter 7 article 4 but I can't make head nor tales of that.

There is a distinction between realestate and automotive liens. I have done quite a bit of googling at this point, and still am. Currently inside the DMV website scouring for info.

here in Sunny California I called a lein service and they did it for me. easy squeezy.. 60 or 90 days later (whatever it was) I went down and registered the car in my name.

I'm not a business, so it may be different for you.

I'm in MI and had the same deal 3yrs ago and am in one now. My attorney cost just $400 to file all the paper for the home gig. Even as a side jobber you have rights. You get your lien, you notify the client, they have "X" amount of days to respond. No response or satisfaction, you then notify the state as to a sale of the car to satisfy the bill. I had to post the public auction in 3 places. Nobody showed up, my bill was the 1st and only bid, got a ***le, sold the car. I'm in it now here at a licensed repair facility. AZ laws are probably very similar. if there's a dispute in MI about the bill (oldest trick in the book) then nothing can happen until the dispute is settled. Hope it helps you find direction for AZ. Good luck dude. I hate that ****.

Oh yeah...AVOID CALLING IT ABANDONED!! They might make you push it to the street to be towed!! MI does.

    I have a call in with http://www.azdot.gov/mvd/ELT.asp

I have found a few services also, but being cash strapped because of this fine gentleman, I need to be frugal.

    -------

Just talked with the ELT people and they are sending me a list of services available. You have to ask, who woulda thunk!

Good to know. I would much rather get paid what I am owed on this deal.

i live in ariz. and my sister works at dmv. according to her .you put the car on a trailer ,take it to dmv.tell then someone towed it to your property and told you i will be right back. but never returned. take all paperwork and plates off the car before going to dmv. they will inspect the vehicle and call phoenix to make sure it isnt stolen. and if it comes back clean they give you a form to mail in to dmv in phoenix along with a check for ten bucks and you will get a abandoned ***le in a week or two. after you get the ***le sign it over to someone you trust and have it transfered into their name. now you have a clear az. ***le i have used this method twice and it has worked both times. and no i dont go to the dmv where my sister works. hope this helps. Well, I guess pushing the issue works. Customer just called and has the money in hand and will be here tomorrow to pick it up; I'll start holding my breath now!

Good for you bro, hope he shows up. Our current dilema, the dip**** spent the insurance check. $5K worth of collision damage on a collector car. After nearly a dozen "I'll be in tomorrow" calls we still have the ****in thing. I billed this out March 2 or 3, and now after the certified letters and notice of sale I'M THE BAD GUY! Yeah, ****in eh. Anyone can just let their car hang around indefinately. We work for free, or **** I may even pay you to do your work I like it so much. Sound familiar to some of you shop guys?

I hope it works out for you.

Oh gawd I'm going through something similar on the Volvo project. I'm at two weeks past due on the his second invoice and one week past due on his third. I stopped all progress on his vehicle and now I am waiting on his insurance check from hail damage last October, this one is headed for the same fate you're dealing with I think.

Yeah, three ******** deadbeats in a row I have been dealing with.

As a dealer I use a ***le service. I am in Texas but they handle out of state liens for me aswell. The cost is $100 for a Texas ***le and $150 for out of state ***les. They are out of Dallas and do a realy good job. You should have someone in your state that does the same. Lone Star ***les. 800-714-7233
