    PLEASE consult an attorney !!!!
    As I thought, that Semi driver was supposed to take a drug and alchohol test RIGHT after the accident. If he didn't, and the Police let him walk (with a smile on his face, no less, I don't think I could have taken that, somebody wrecks my car and totals it and then smiles, there is likely going to be a really pissed off Irishman that would "Total" that truck driver!!)
    If he didn't drug and booze test, the Company he drives for, the Police that were on scene at the accident, are going to be in deep doo-doo.
    GET AN ATTORNEY !! Find one that doesn't brush his teeth; he *sharpens* them every morning. They will take the case, and only take a portion (usually 30-33%) of what they get for you.. if you don't win anything, they get nothing. It sounds, from what you and your boyfriend have said, that there would be attorneys standing in line to get this case...

    Best of luck, and please let us know how this all turns out.
    Just out of curiosity, who is your insurance carrier for the T-Bird?

    Gutted! The 'Bird was looking so sweet.
    Very glad to hear Sophia came out of it ok. She was very lucky. And how staunch to carry on and try to enjoy the rest of the weekend! Both of you in fact.

    I sincerely hope the damn truck driver gets what he deserves, and more.
    All the best for a good outcome from this.

    Damn Timmy, just caught this thread. Wow, glad Sophia is ok as well as the other folks too. Could have easily been way worse especially with a semi involved. Awful. It sucks dog crap, but the car is just a car and can be fixed or just move onto a new project if really totalled.

    Your car is looking great by the way.

    I heard about that accident, I'm glad your girl is alright. Metal can be replaced, flesh is a lil trickier.

    Super that your girl wasn't hurt and terrible that gorgeous bird took the toll.

    I agree with the advice above regarding an attorney. Insurance companies will definitely give you the run around, no matter how great they sound when they first talk with you. There will be someone there whose job is to contact you guys and try to find some minor reason why you shouldn't get the full benefits due. Be very careful what you say to them.

    Keep us informed how this one goes. Maybe it will help the next person as well.

    What rotten luck you had! I'm glad you guys pressed on and continued with your plans for the weekend, though.

    Best wishes to Sophia in finding another nice ride, and I hope she's able to take a couple of pounds of flesh from the truck driver!

    Sorry to hear aboat your bird, glad your gal is alright, if you need any parts, Jerry at Hiltop Classics in San Marcos has parts, he is on Enterprize st. San Diego county, I heard a kid got killed in a 29 roadster p.u. on his way to Santa Maria, man it is getting scary to drive to shows.

  18. As stated the Company should have and maybe did send him in to their testing facility. The cops do not have to do it if their is no suspicion.

    Also, there is a new system to track driver records and DOT employees called CSA 2010. It is a rolling window looking at 2 years driving history and is retroactive when instituted. It is separate from the CDL and state records. In essence bad drivers with accidents, inspection violations and tickets are going to be weeded out of the system. They are also watching abuses from DOT personal at scales and such. Regardless of the drug test this driver will get a few points on his record that DO MATTER. We could look him up down the line and see his history.

    As said, get a lawyer that knows these new laws and the trucking industry. We don't need bad drivers in this business. There are enough cell phone texting soccer moms to worry about.

    My boyfriend drives heavy wreckers and trucks and his CDL is the same way. One little teensy thing and you're screwed. Around here; semi-truck accidents are NOT taken lightly and all drivers involved must pass drug & alcohol testing, etc.

    I would be getting the name of the trucking company and contacting them IMMEDIATELY. Ensure they know of the situation; and send pictures for further proof. I wouldnt be signing anything until youve talked to both the trucking company as well as the police department who handled it. I'd be going there and demanding an explanation as to why no drug or alcohol test was given; and why such humour was used when multiple people's lives were in serious danger with this accident. If they dont want to deal with it; go to the next person above their heads. Dont settle for average in this one. If it was handled properly then it would be a different story...but it wasn't in this case.

    Truck drivers are supposed to be professionals who respect and care for the safety and well-being of themselves and others on the road. after all; they are driving weighted freight trains down the road.

    Im glad your girl is seeming okay right now. Tell her to take it easy for a few days. Accident pains have a horrible reputation of coming back to haunt and can lead to more serious issues; even if nothing was diagnosed from the outside. Lots of rest will do some good in the healing process. Im glad everyone was okay.

    You two sure handled the situation far better then I would have. Glad to hear only minor injuries.

    Like othesr have said, hire an attorney immediately and let the attorney do the talking on your girlfriends behalf. They are the professional and the last thing you want to do is say the wrong thing and it be held against you. No way I would talk to the trucking company or driver himself, nothing good could come of that.

    Hey guys, just wanted to give you an update since the police report has been released. Unfortunately, like we had expected, they are trying to fault Sophia. She has already submitted forms contesting this as well as a supplement to her statement since then officer left out probably the most important part, that she was hit. We have an adjuster coming tomorrow to look at the damage of the bird as well. It is sad that this has to happen but she is fighting it regardless. Wish us luck!

    It doesn't really matter if she was in her lane, and a "professional" driver decided that his vehicle needed to occupy that space.

    Dang Tim I just read this post..so sorry to hear the bad news about the Bird (you did a great job on it when I saw it last btw) and most importantly that Sophia is OK. Glad you all still made the best given the circumstances!!

    unfortunatley, as soon as they see she only had her licence for a week at the time they probobly wont side with her.. crummy deal tho..hope you get that money!!!

    Well, we are still moving forward, today she speaks with the officer about her contesting statement and supplemental. An adjuster is coming out today to view the car's damage. The independent witness that was behind her may have made a huge flaw in his statement which may help her. He claims that she lost control of the car because her "rear suspension went out" and it lifted and then dropped. Considering the suspension is still completely intact, this is not possible. We believe and are now fighting that what he actually saw was her tire being popped after she was hit (which would cause her rear to lift and slam to the ground).

    Brandon, she had her license a lot longer than a week.
