Retrieving Lost title. Does owner HAVE to come to the DMV?

  1. So here's another ***le question that I honestly dont have an answer to, and can't get through to my DMV to ask. I bought a car at auction withot a ***le. The "owner" I bought it from tells me that he bought the car from a gentleman a town over and never transferred the ***le into his name.

    By way of what he remembered of the original seller 10 years ago, and dumb luck, I actually track down that original owner by phone, whos name the car is in! He's happy to help where he can, but he lives out in the middle of nowhere and he's up there in age. Obviously the easiest way to get a duplicate ***le printed from him would just be to drive him into the town DMV 30 miles out and have them do it there, but under the cirumstances, is there any another way? Does he HAVE to come with me to the DMV, or is there paperwork I can bring him to sign to get this all done, have a new ***le printed, and have it sent to me? Or sent to him so as he can sign it, without having to leave his home?

    Any help is appreciated.

    In colorado? Might look up the laws...should be on the internet.

    In AZ you can get a power of attorney, but I think it has to be notarized...so you're probably gonna have to invite the old gent to a nice dinner in town or something to get it done.

    Another lesson in why you don't give money for a car until you have the paperwork right there in front of you, and you know how to make sure it's right.
     
  3. Yes Colorado. I bought the car with the hopes of working out the ***le one way or another, but the realization that if that couldn't happen it would still be a great parts car. Now it's more possible to get the original ***le and be in a better place with the car, just wasn't sure how to go about that.

    Here and in most states whoevers name is on the ***le is the only person that can and will be issued a replacement ***le. What kind of auction sold you something without proper paperwork anyway?Or did you just buy it for a parts car?

    Dunno about CO but in M*** here I lost my ***le and got a replacement by downloading and printing out a form, filling it out, and mailing it in.

    Get the paperwork and mail it the registered owner and have him apply for the duplicate. Pay the fees for him. He can then sign it over to you and you can take that to MVA.

    I bought a car without a ***le 4 years ago, probably wouldn't do it again.....:eek:

    Anyway, check the Colorado DMV web site, as you know trying to call them is useless:mad:. I would imagine you could get the owner to sign a power of attorney, and then you could apply for a lost ***le (?).
     
  8. Never done it in Colorado but anyplce else I have ever done it the ***le owner had to be present to prove that he or she is the actual person.

    Drive yourself over there and take the ol fella to lunch. He would probably enjoy that.

    When I bought my '41 Chebby in Kansas in the '70s the ***le was all screwed up and I tracked down the original owner the man on the ***le. he lived clear to hell and gone out in the country and was in his 90s to boot. I picked him up and took him to the nearest DMV about 25-30 miles. We went in they cleared up the problem and issued a lost ***le. Even let us keep the original it was really purdy, after they stamped void on it. I took him to lunch and the new hardware store in town. He was stoaked. Even tried to buy himself a new hammer which I insisted on paying for. When we got back to the farm we ate again. Was a great day for an old fella and a young guy to boot.

    I'd go along with getting the paperwork,, fill out everything except what he needs to sign and date and take the paperwork out to him. If the dmv requires him to go in to one of their offices to do it in person take him to lunch at a decent place for his trouble.

    If there is an old registration slip in the car with his name on it and all the info take that along and add it to the paperwork as that alone should speed things up.

    And if there are papers in the glove box go though them one by one. I was given an OT vehicle that "didn't have a ***le" last year because I wanted the rear end. while I was in the middle of cutting it up in pieces to haul it to the s**** yard the stuff in the glove box fell out on the ground and there in the middle of it was the ***le to the rig.

    A friend of mine just got a ***le for a vehicle that his tennant left in the garage after breaking a lease agreement. Not sure how he did it, but I have heard of applying for an abandoned vehicle ***le also. Might be something to check out. But probably the easiest thing would be to bring the old man to town and have lunch with him for helping you.

    This is how I would do it in KY....

    Create do***ent saying that you have owned the car for more than seven years (amount of time KY keeps registration records), and have lost the ***le.

    Have it notarized.

    Take it to the county clerk and apply for a new ***le.

    It's worked for me several times.

    Here in Utah I wanted to keep the original '69 ***le that came with my truck. DMV had me fill out a lost ***le form, have the seller (local university) sign it and two weeks later I had a new ***le. Only seller's signature was required.

    Bought a Chevelle at auction in Colorado last fall with lost ***le. Auctioneer promised a ***le because owner who bought it new was alive and willing to fill out paperwork. Finally got the ***le about two months later because according to auctioneer Colorado purges all ***les older than 10 years from the system. Then the State wouldnt accept a copy of the old registration as proof of ownership from the local court house unless the ***le clerk stamped it with a seal proving it was legit. This is the story the auctioneer told me and I was starting to get nervous about ever seeing the ***le but it finally happened.
