Buddys pushin the "storage" limit way too far,what to do???

    Good advice guys. I have the same problem too but my landlord hasn't said anything.YET. My friend,Tony bought a 51 POS Pontiac to my garage to get running, convert to 12V with alternator, do the brakes & install new master cyl.(All work this guy is fully capable of doing himself) last April & the car is still there.

    Tony used to have a barn/garage & land most of us would kill for. Then he got divorced. befor I got the shop I'm in now I used to bust my balls everyday working on stuff of his every freakin' day(for like 9 years) because I wanted to learn & he's my friend. Body work, mechanical work, motor swaps, sheet rock his new house,wallpaper, plumbing, paint house inside & out, dig the septic. I never asked for a dime. & when I had cars there he started charging me $30 per car per month. It was cheaper for me to get my own shop.

    He did help me chop the roof on my 49 chevy but I gave him a 49 fleetline with over $4k worth of reciepts for all the rebuilt mechanicals.

    He lives with his daughter now & turned her house into a junkyard & she won't let him bring the Pontiac home. He's got a 51 Merc coupe sled he could drive & a bunch of other projects.

    I felt bad the last time he dumped a big load of steel racks off at my garage without my permission & they were there for 2 years till finally zoning stepped in & I had someone take them to the s**** yard because he kept blowing me off abut it.

    Given these cir***stances what do you think I should do about the Pontiac?

    let em sue you. they'd have to PROVE that you even had the stuff in the first place, let alone that you sold it. have you ever reported anything stolen to the police?? they DON'T go looking for the stuff. you could steal the **** right out of their garages (though i know you would'nt do that) and sell it and there is'nt much they could do about it unless you were caught in the act. i've learned this from having stuff stolen. it's the sad facts.

    point is. listen to Nads, DON'T BE A DOOR MAT!!!

    i'd give em a date (and if it has to be tommarow so be it), if they don't remove the **** by then get rid of it, whatever way you have to. you are en***led to storage fees.

    i had a "friend" who had his entire truck sitting in my driveway for about a year. we bugged him for months to get it out of here and he never did. finaly we had a family function coming up at our house and we wanted the place cleaned up before everyone came over. we told him the date that everyone would be here and said it had to be gone the day before. he never showed so we called someone late that day and had them haul it away for s**** early the next morning. sure enough, while everyone was over, he calls and says he is on his way to get the truck. i told him; "tough luck. i had it hauled away this morning." and gave him the number for the place that had it. last i heard he could'nt find the ***le so he could'nt even prove he owned the POS, so they would release it to him. i never heard from him again.

    he was warned more times than he should have been.

    make an appointment with a wrecker service/s**** guy that is willing to come get it then tell him if he does'nt get it gone before they s**** guy gets there he's **** outa luck.

    sounds like he's been walkin all over you for years. lots of double-standards. i've had "friends" like that before. sooner or later you realize that they are not realy your friends and they are just using you for one thing or another. been there, done that. not gonna be a door mat for anyone ever again.

    I only ask them to pick their **** up once.

    If I have to ask again, the message usually goes something like this:

    "hey man, your ****s in the middle of the street... and its trash day!"

    Them guys who drive around looking for cool **** have really scored a couple times...

    Seriously.

    I've called him lots before and told him to come get at least some of the ****.
    Then when I got my notice to tidy up I called him and told him I had to tidy up by june 1st.
    He said he borrow his dads truck and come get some stuff.
    I said if its still here by the Cloverdale swapmeet then its going there and gettin sold.
    I guess I'll take a few things over and sell em off.

    I'm certainly not delivering it to his place cuz I'd hafta take a damn ferry!

    Killer,your idea is great but my landlord buddy would give me ****!LOL.....Shiny

    I can't believe Nate still hasn't got his **** out!
    If he doesn't get it make him pay for storage, and charge him for the time it took us to pull the motor for him.

    Yep, I agree. Dump it on their front lawn or porch.

    You're gonna be a bad guy in their eyes anyway,so you might as well keep the *****in' to a minimum.

    I'd definately say sell it, but you do want to cover *** legally though because they will show up once it's gone. Although as far as the legal part I seem to remember something about possesion is 9/10 of the law... but around here that only applies to things you're not supposed to have ha.

    Swap meet the ****, and pay for your rent on their behalf.

    Its a matter of respect, and they ain't giving you any.

If you want to keep them as friends: Call them tonight and tell them that the stuff will be loaded up for the swap meet tomorrow. if they want tp keep the stuff they have to come and get it tonight. Sell the stuff at the swap meet and give them the cash minus a small sellers fee and h***le fee....

    If you don't want them as friends: Load stuff up to go to swap meet and sell it for whatever you can get for it...keep the cash....Don't tell them ****...when they come by to drop more **** off and see that everything is gone tell them that the stuff was dsposed of...since they didn't come and get it it was considered junk and gotten rid of....

    My personal feeling is that these guys are not your friends and are taking advantage of you....well **** them....don't be a ****er...you are a businessman act like it....

    Technically since its been there so long without any sort valid contractual agreement, its considered abandoned by law (I think legally it is at least one year, and I think that goes for almost all states being that its case law) and as such legally yours. Sell the **** and consider it a good pay off to be rid of some human junk.
     
  23. You've had the stuff for more than a year with no money changing hands, you legally own it. Do whatever the hell you want with it, your "buddy" forfeited ownership.

    How far is 'Treasure Island' from Kelowna? I could help you remove the front axel if it is a dropped unit for my 'A'!!
    Always ask a liar(sp) .....lawyer, on legal issues...this first visit is usually free, and worth it.
    The best fix I like besides giving it up here on HAMB, is to rent a storage facility in their names and sending them the contract/keys:)

    Wow! Never thought this would be such a "hot" subject.
    After about six PM's asking how I did it; decided that I should share it with everyone.

    Situation: I was renting a 4 car shed (barn actually) that was located on a small parcel of land. Was getting ready to move and was giving up the shed. (and the land)

    Had buddy (??) who would (without permission) "drop off" various engines, axles and junkers on the property over about three years. He did welding for me so I was forgiving about the stuff showing up unannounced.

    To get my deposit back from the landlord; (a big one) the shed and land had to be completely clean. For almost two months I would call his number and leave messages on his answering machine, that ALL the stuff needed to be cleared out. (never could catch him at home) And he never returned any of my calls.

    So ... Had a school buddy that was a lawyer who gave me the "skinny" on how to go about getting some action.

    First; because I didn't have any aggreement with the guy that owned the parts regarding storage; I had to give him "notice" (the registered letter) that unless he cleaned the stuff up by a certain date; THEN ALL of it would be put up for auction.

    AN IMPORTANT NOTE HERE: Different states, and in my case the province I was located in; HAS DIFFERENT LENGTHS OF TIME THAT YOU HAVE TO ALLOW BEFORE SELLING (auction) THINGS OFF.

    In my case I had to give 30 days notice. The 30 days started from the date he received the registered letter. (I had to pay for an extra months rent because of this)

    Then I got in touch with an auction house who ran ads in a bunch of news papers indicating WHEN, WHERE and WHAT was being auctioned. The UNRESERVED auction took place at the shed and very few people showed up. It was interesting though that two s**** dealers sat in the back row; and didn't bid on anything unless no one else did. (five engine went for $10.00!)

    As I said earlier, there were a couple of pieces that I bid on; and got for next to nothing!

    After taking my lawyer buddy for dinner; paying for the auction service, (and the ads) and working out a fair storage rental cost, (plus the extra month of rent that I had to pay) I came up about $100.00 short. Ah well .. I know better for next time.

    Oh yeah ... I now have a different welder!
     
  26. Some people are just slow learners. Before you commit to building a car, or to having them drop off material for a car, tell them a 50% deposit is required.
    But that would require you to do some work also.

    Soory this is NO pal ,friend, or buddy , no real friend would treat you like this.
    Now i know the thing i would do as most of us just get rid of the stuff , call it abandoned property and be done with it .But know your law first .Without proper notification IN WRITTING it could leagally come back to bite you in the *** , worse than him walking all over you and pissin yer landloard off .Easy way to do this is 3 certified letters delvered to this person w/ a lien demanding removal or items will be sold for rent .Make copies signed dated and notorized . after 30 days and 3 notices you should be in the clear .Again check you country ,county , and state and city law .If not he could over inflate worth and your out bigtime .Just incase this does turn into a people court thing get your papers in order now and take pics .First thing you learn owning your own Biz " cover your *** ".DR phil signing off ;)

    screw all the sendin notice ****. if you've told him on the phone then thats good enough in my book. hows it gonna "come back to bite you in the ***" if he can't prove the stuff was (1) HIS and (2) in your posession let alone that the parts even existed at all. just play dumb when it comes to any authorities that may get involved (not that they likely would), "what parts? i don't know what he is talking about."...

    if there is no paper trail it'd be aweful hard to prove anything let alone that he even owns those parts in YOUR garage. anyone asks say they were your parts and you sold. "were did you buy them???" "at the swap meet a loooong time ago. forget from who."

    Trouble is, it would depend on how BAD he wants his stuff back. Although your approach MIGHT "fly"; I would hate to wind up in court with a civil suit on YOUR (my) hands. They can get expensive and time consuming.

    If you don't go about it the right way; the "burden of proof", (proving YOU DIDN'T sell, give away or whatever; HIS property) is now in YOUR hands. (and he could inflate the value of the goods)
