Just a bump at the light? No real damage? No ticket?

    Wasn't a fun Sunday drive today.

    Sitting at a traffic light when WHAM! Hit from behind by a Lexus SUV. Got out, saw the damage, felt like I'd been punched in the kidney, got back in my car and stayed there. Before I could make the call, a county mounty showed up and asked if the car would still start. I moved out of the intersection and waited. He eventually came back and said there wasn't much damage and the insurance companies could work it out.

    I said I had just taken a shot wanted to be checked out. I walked away from an accident before and went to work the next day only to find out I had 2 cracked ribs.

    So I was taking the ride and the officer came back and said here's your information. I asked why he hadn't asked me a single question about the incident. He said he got it all from the lady driver in the SUV. She said the light had turned green and thought I was moving.
    It was still red or I would have been moving as I was watching for the light to change.

    The trunk latch is pushed in 4 inches past the bent trunk lid. Floor buckled, both rear quarters bulged at the wheel openings and kinked at the tail lights. Yep, just a bump. Had no idea a 1955 Oldsmobile was so flimsy................

  2. They are not flimsy ... the SUV is LOL . You got hit from behind its the SUVs fault (unless you were backing up!) ... The insurance company knows that, get a doctors visit ... their insurance company will pay for that also DONT SIGN ANYTHING until you feel things are resolved.

    Sometimes cops are real un-professional jerk-offs, glad you had the gumption to get him back on-track, ...he needed it! In this case I would not doubt a bit of 'profiling' [spell that "prejudicial at***ude"] on his part, ..."just talk to the nice [well off] lady in the SUV, she's bound to be the upstanding citizen of the pair"! Gotta know your rights, stick to the facts, and be polite, ...but don't cut 'em any slack these days! Been thru this scenario myself a time or two. Sorry 'bout your rig, hope you're OK!

    Sorry to hear that. Sounds like maybe the driver of the SUV may have been someone "special". I hate to ***ume that but it sounds like the officer sure wasn't going out of his way to handle things properly.

    I was involved in a collision in a small town years ago and the hayseed that hit me was belligerent as hell. When the police arrived the guy hops out of his truck and they all start speaking on a first name basis and I figured then I was screwed..... I guessed right. To make a long story short I got a ticket and was told it was all my fault. I took it to court and everything was dropped but still what a h***le.

    By the way, for anyone that may want to defend the officers actions....... almost any accident where someone rear ends another person can easily be cited for failure to reduce speed to avoid an accident. Just sayin'
     

  9. You need to get yourself down to the cop shop and protest the police report. Explain to the desk Sarjint (sic) that there are two things wrong with it, fiirst and formost that it is wrong and sencondly that the officer only took information from the lady that rear ended you and none from you what soever. You probably getter look at it real close to make sure it doesn't say that you were backing up.

    I'm just sayin' its too late once your insurance agent gets a copy of it and its wrong.

    Hate to hear about your car, I kinda had the same experience a few years ago when I got hit in the rear while sitting at a stoplight. Long story short, the "rookie" cop (didn't even carry a gun yet) tells us that he was called to the scene of an accident so he "must issue a ticket". Oh, did i mention that this took place in Kansas, a no fault state! When he turned around, I quickly jotted down his name and badge number and proceeded to the police station, talked to the chief, ticket was dropped and last I heard the "cop" was flipping burgers.
    Karma is/can be a *****!

    Had an exact same situation, albeit different vehicles. Numbskull civilian woman in a small 4 cylinder car. Took off at the light (behind me) when no one else was moving (including me).

    Smashed the back of my 69 427 Tri-power Convertible Vette and managed to mangle EVERYTHING at the back end and even knocked the radiator loose as well! That was a $7,000.00 repair that her insurance picked up on my car (thank god), but this was a low mile never hit car. You can't really fix that once it has happened.

    Funny thing was, you couldn't see anything wrong with her car.

    People are idiots.

    Getting rearended when driving our hot rods is one of my biggest concerns. My Sons always wonder why I let them drive their cars in front of me but I figure if anyone is going to take the shot I would prefer it to be me. There have been a few times when I have heard squealing tires behind me and you brace yourself for the hit. People are such idiot drivers any more and so distracted with cell phones, texting, etc.

    I could care less about how YOU are doing, but I am crying over damage to my one of my favorites...a 55 Olds. JUST KIDDING!

    glad to hear you are too banged up, but you are going to be uncomfortable for a while.

    as Benno said, get that report straightened out. I had a similar situation due to the big crocodile tears from the woman at fault. In the end, it was MY insurance that paid.

    Sorry about you and the car. Not sure what your looking for though. Lady hit you from behind. It happens every day. Apparently she admitted as much or the officer would have asked for your side of the story. Your lucky that she was in a Lexus and not a hooptie driven by someone with no insurance.

    I just hope that your car gets fixed properly and that if you're hurt, it get's squared away.

    I don't trust insurance companies at all. I trust some cops slightly more and it sounds like he did the right thing.

    This car just turned 48 thousand original miles. Never bumped before. Can't say that anymore and there's nothing they can do to compensate you for that. ****s.

    Guess I should have seen it coming. Was wondering what this person was doing besides driving for 2 miles before the hit. Was going fast, then slow. Back and forth in the lanes and on the cell phone. Drifted back as I maintained the speed limit till I stopped for the light. Sat there waiting for the light to change and dismissed her. Then WHAM!, she found me again. Jumped out and came running up asking, you OK? you OK? Then she started talking at me in such a strong accent I couldn't make her out. I just said I couldn't understand her and got back in the car as the cop showed up.

    She was a nice looking young Asian, so I'm sure that appealed to the deputy. But it was a shot to the frame that I didn't see coming and the jolt did have me hurting in the lower back, so I stayed put in my seat after getting out and feeling it. So I guess I wasn't needed at that point. The same insurance company covers both of us, so I'm not sure how that affects things.

    But like you said Redline, it had never been hit before and even the original weatherstripping was good. Just drives me crazy it's not going to be virgin anymore. But that 5,000 pound Lexus truck came down on that back bumper doing more than it looks like. By the time the upholstery comes out of the trunk, I'm sure my inner quarters are buckled too. Rats!!!!!!!!!!

    But going 57 years without being hit or rusted at all to be screwed up by someone like this who couldn't get off the cell phone ****s.

    Don, I've had people do that ON PURPOSE. I gess they think it's funny to know someone cares about thier "old car".:mad:

    I have been hit in the rear two times in my life and both times the Police told me that in the case of a rearender the driver doing the hitting is automaticaly considered at fault.
    Hope you are all right.

    good luck, but prepare for the insurance company to fight you the whole way. remember they have the money you deserve, and they will take their time giving you the amount they feel like. i went through this with a low mileage mustang i restored, but after the accident they subtracted red paint they found under the blue because it looked like rust in the picture. hope your back is ok, sorry if i sound so doom and gloom.

    Thanks to all you Hambers who let me cry on your shoulder.

    Yep Tfeverfred, it's way fixable. But when you are as stupid in love with your car as I am with mine, it really hurts to see em bashed. Then I have to step back and remember to stay in one piece to fix it.

    Always good to see how much Hambers care beyond the wrench to support in this way too.

    just had the same thing happen but i was driveing my suv the lady was pulling out on the highway went 15 feet and slam her brakes on i hither and it,s my fault hope you and your car are well soon

    Be very careful, often it's days after you've been rear ended that the pain from the hit shows up in the base of the neck and the upper back. Trust me, I've experienced this, after being rear ended 12 times!:( Was the other driver on a cell phone or doing any other distracting task? Make sure your insurance company investigates this, it could be that she was "driving without due care and attention" and should have been given a ticket. That officer needs a lesson in who is the victim and who is apt to be trying to cover their mistake That is not insignificant damage to your car either. Despite how solid an old car is, it's the transfer of kinetic energy that causes the stationary vehicle to get the worst of the damage.

    You need to be careful about rear end shots. I was hit once in the rear and didn't think much about it until a week later when my neck started hurting pretty bad. Whiplash sometimes takes time to show up so don't sign off on anything until you let it run its course. And remember, the usual compensation for at fault is at least three times your medical bills, so get checked out and get it do***ented.

    Diminished value. Contact the insurance company and ask for additional money because your cl***ic car that had never been hit is not worth less money.

    Some will actually pay for this- although not with out a fight.

    Probably the best part of putting up a thread like this is the good advice coming from so many others that have had experiances in things I haven't.

    This is the first time I opted to get checked out after being slammed into, but I was feeling it right away. I know it didn't look like much of a hit, but it was right on the frame and I sure felt it. I had my hat on snug and still had to get it out of the back seat.

    The one good thing I have in my favor (I hope) is that my insurance agent is into our kind of cars too. He's working on a fabulous 40 Ford coupe. He has always come through for me in the past. Hoping for the same this time.

    this is a good thing, the guy [other persons insurance clown] told me that it is an old car and gave me comps, he found in the swop sheets, 3 cars all parts car, two didn't run, the other ran [if you brought your own battery] but had no brakes.
