Ever have buyers remorse and try to make the seller give your money back?

    To start things off i'm the seller not the buyer.

    I sold this 55 Chevy Nomad to a guy in Arizona. The buyer (who I will not name) has a residence in Arizona and Minnesota. At the time he bought the car he was in Arizona. Over the phone a deal was made for him to purchase the car. I was asking $15,000. He offered me $14,000. He is a liscensed auto dealer and his primary business is restoring high dollar cars that sell at big name auctions. A simple google of his name along with Barrett Jackson brings up about 10 cars that total well over 1 million dollars going through Barrett Jackson right now.

    The buyer sent me a bank check which cleared and sent a friend of his from Minnesota to pick up the car. Four days later I get an email from him saying he doesn't like it and he want's his money back, but in the same email at the bottom he changes his tune and says he'd be happy with $4,000 dollars back or he will take legal action. I reply back saying you should have looked at the car in person and Once the car is paid for and it leaves my property it's a done deal. (I'm not a dealer, this was a private party sale from me to him (HE IS A DEALER) The time for haggling on price is before the sale.
    Now I get and email saying he will make this all go away for $2500 cash back. This is absolutely rediculous! The best part of it all is with his check for the car he sent a vehicle purchase contract along which he signed and asked me to sign and send one copy back. On it it had the long "As-is" terms of sale paragraph.

    When his buddy picked up the Nomad from me his said the last Nomad that the buyer sold went for over 90k at auction. I think the one I sold was a hell of a good start to a car like that and my heart sank a little when he said 90k.

    My point here is when you buy a car:

    1. The time for haggling is BEFORE the sale.

    2. Look at the car in person

    3. If you can't look in person - send someone to do it

    4. If you don't like it, DONT BUY IT

    5. When you hand over a fist full of cash for a car. It's yours. Dont look back

    I would never in a million years go back to someone I got a car from and ask for money because I don't like this or that on the car.
    Absolutely rediculous!

  2. Save the evidence he has "gave" you-emails etc..... record your calls......be prepared,that way you can prevail in this deal as rightfully you should.
    He is over the top offering you less to get money back after a sale like that, no way in hell is he in the right.....nor does he have a leg to stand on.

    There are guys for whom all this is sort of a game. Restoration/rod shops run into it all the time. They believe that you absolutely HAVE to get over on someone and they're happiest when they can really screw you. When I had my shop we had several of these. A couple were big money guys. Go figure.

    Counter his "offer"; tell him to have his friend from Minnesota trailer the car back to you and you'll buy the car back for $8,000 "to make HIM go away".
    I get the feeling this guy made all his money in life by screwing people over. Tell him to do us all a favor and leave the hobby.

    Save every communication from this guy. The decreasing amount is a strange way to argue a settlement. I would not offer anything as concession or try to work with him in any way! It does take two to tango but your side sounds legitimate.

    this is exactly why I print out a generic bill of sale that states in no uncertain terms. Something like this..

    I would say it depends on what the issues were.
    What is his complaint?
    Does it have merit?
    For example, if you say there is no bondo in the car and it is all metal, and all repairs were done in metal, 1st class done.
    And he gets the car and the frame is full of bondo, the patch panels are riveted and bondo'd in....
    and there was misrepresentation, then he might have a point.
    Or if the engine smokes and knocks etc.

    Not saying this was the case, but need more info.

  15. There is two sides to every story but one thing is sure, the guy is an idiot for for not sending someone or looking at the car himself before purchse .... that was his choice and he just made a bad choice .... he should be strong-arming himself and not you.

    My brother in law sold a PRISTINE Ferrari 308. The buyer never saw it, just pictures. When it was scheduled to be delivered my brother in law called the buyer to make sure he was happy. The buyer was thrilled.

    Four days later the guy calls pissed, saying there are scratches all over it, foot prints on the hood, tears in the leather, a flat tire, and on and on. The buyer threatens legal action for the car being misrepresented. Brother in law hung up on him and called me for advice. I had recently read HERE about a similar transaction!

    I told him next time the guy calls, invite him to "lawyer up." He did the very next day. Upon the lawyer invitation, the buyer says he wants his $35,000 back and will be keeping the car, to which my brother in law laughed. Then the buyer offered him a "settlement", stating if he gave him $20,000 back he would keep the high powered attorneys off his back. B. I. L. tells him to piss off.

    This went on for weeks, each time the buyer offered less and less until he was BEGGING for $3000 "to fix the damages that weren't disclosed". At this point my B. I. L dropped a little bomb. He told him that although he very much enjoyed playing this game, that he had recorded every call, printed every email, and documented the transaction in every minute detail, including photographing and videoing the car IN THE CARRIER when it departed. This documentation was now on its way to the gentleman's State Attorney Generals Office, that they had asked for all of this information to investigate and prosecute a ring of extortionists in that state.

    Never heard from the buyer again. And although thoroughly documented, the Attorney Generals office was never contacted.

    I know that car, you must have gotten it from my buddy Augustine. Needs work but well worth that price, it's a Nomad for cryin' out loud.

    That's why I hate selling cars, because every once in a while you get a whiner that cries about it after the sale, and that's the worst. I just want shit to go away, or maybe send me some pics when you're all done restoring it, I don't want to hear someone bitch about it for the next 6 months. I'm with you on this one.

    Funny how when I buy a fucking car I never seem to have this problem. Maybe it's because I check the shit out ahead of time, and I know what I'm looking at? Could be.
     
  20. Had a similar thing happen to my Dad back in 1991. We're in Illinois. A California guy bought a '48 Chevy from Dad and sent a certified check, and had a friend come pick up the car for transport back to California. He never saw it in person. Got it a few days later and called my Dad saying "This car isn't as nice as you said, I want $2500 back". My Dad told him to pound sand. A few phone calls & he eventually went away.

    A check of the guy's name and his car club in LA shows he still has the '48 22 years later. Must not have been that bad of a car :)

    This guy's a joke and he can jump in a lake. You're in the right here.

    Play serious and put him through the wringer.

    Tell him you're game for the return of the car but it'll need to pass inspection to make sure it's in the same condition as when it left.

    Send him on some kind of wild goosechase. The further, the better.

    Deal's a deal man. Let him waste his time, not yours. I deal with auction "kings" a lot lately. Some are straight shooters but there is a decent handful that are a little shady. Remember that they are counting their pennies on every job. $2,500 out of your pocket pays for his paint!

    A guy who lived in the same street as me bought his first car.

    Was really proud off it.

    Couple of days later it was no longer in the driveway.

    I ask him " where is your car?"

    He said " my mom didnt like it, she made me bring it back"

    I asked " the seller agreed to that?"

    He said " she called him and argued untill he agreed..."


    So who knows whats going on with this guy...

    Maybe his mom doesnt like it.:rolleyes:

    You Know When he sent his buddy to Get it the buddy became his Agent so if his Agent was happy then it is a done deal , this Crap happens all over the world . If you buy a part at a swap meet and it takes more work to fix than you thought thats just tough , you bought it at the price you agreed you can say No, but once you pay THATS IT .

    I was selling a little OT 4-cyl pickup truck in the front yard for $600 just to get it out of my barn. Ran great, no rust, probably worth a little more but needed it gone.

    Guy stops and look at it, tells me it has a "miss" in the engine, he diagnoses a head gasket issue and tells me it will cost $800 to fix. I said "it's as is". The guy never mentions a price but comes over 3 more times and notices other things wrong and quotes how much they are gonna cost to fix. Last time he came over, the truck had been sold and he was pissed I sold it to someone else. Can you imagine if I had sold it to this guy?

    My point here is when you buy a car:

    1. The time for haggling is BEFORE the sale.

    2. Look at the car in person

    3. If you can't look in person - send someone to do it

    4. If you don't like it, DONT BUY IT

    5. When you hand over a fist full of cash for a car. It's yours. Dont look back

    I would never in a million years go back to someone I got a car from and ask for money because I don't like this or that on the car.
