Ever have buyers remorse and try to make the seller give your money back?

    What he said.When I went for my dealer license I had to take a class, and one of the things the Instructor said was never admit to a defect, because once you do they can return the car even after a couple of years. Now it may not apply to a private sale,when DMV tells you to keep your mouth shut, it's time to keep your mouth shut. I really doubt he would bother taking this to court,it will probably just go away after time.

  6. I've been a dealer in the state of Wisc. for over 38 years. Recently retired, thank God. In the state of Wisc. all private sales are as is, however, private sales rarely ever involve a purchase contract, a bill of sale is the norm, Now, You really need to read over the contract you signed. It may have a provision in there for such things as the engine being changed for instance. If the contract looks to be good and in your favor, I'd contact the Wisc. States Attorneys Office, if this dealer persists in trying to get some more money from you. Like I've said, I've been a dealer for a long time and any time I've made a mistake when I bought a car I wipe my nose and move on. And yes, I've made a few!

    I HATE when someone wants to buy a car sight un seen. Looking for trouble.

    I wouldn't feel the need to return any money as long as you were honest, told what you know, answered any questions and sent any requested pictures. It was his terms and he's a professional who makes money off of buy low and sell high.

    As for the original question yes I've had buyers remorse but no I have never asked for money back.

    I do believe it is the wrong thing to do (try to extort cash back) but if it was advertised as a 350 and it has a 305 a court could see it different, I guess the next time just list it as a SBC or check the numbers before the advertisement goes out. Still a slim chance you'll ever hear from him.

    I think I saw the seller also state that there were some "unforseen" rust issues, what was he supposed to have xray vision or something to that effect.Not taking sides here, there's two sides to every story.Was the car represented honestly or was enough time spent looking at the car before writing that description.Whether this guy is a dealer or private party if you guys were the buyer how would you like it.And by some responses on here you sound the same as the buyer.My motto is if you have a reasonable seller and a reasonable buyer you come to a reasonable conclusion.Looks like we have two unreasonable people here so what we get is a bunch of drama.I bought a car from a guy "unnamed" here on the Hamb rust free he said sent me pictures and everything got the car shipped and low and behold the roof on the side he didn't show a pic of had big rust holes in it and in a very difficult spot to fix.Called him on it and he knew what he had done but he made it right.We both agreed what was fair and he sent me a check.Two reasonable people came to a reasonable conclusion.And yes I would buy from him again.
     
  11. If I was the buyer, I'd be unhappy that it was a 305 but if I didn't have someone check the engine codes I'd only kick my own ass. Seller should do that, I think the 305 vs 350 thing happens more often than we think.

    ...EVERY car ive ever bought with a SBC in it... has ALWAYS been a 350 (and most of the time 4 bolt mains!!!),,untill i ran the numbers of course :) ,haha

    ..pretty much a given to NOT believe its a 350 unless numbers from the block are provided...


    edit: i just rembered ,now the thing sellers like to say is any sbc with atleast a mild cam and headers is ALWAYS a "383 stroker"

    What's the going rate for a set of 55 Nomad headlight eyebrows and fender spears?? I'm going to hazard a guess at, maybe, around $2500 - $4000??? Noticed they were missing off the car, and not a cheap replacement, as I don't think they repro'd....

    Whether he is a sleazeball or not, unfortunately if he really does decide to legally pursue he may have a case. Misrepresentation is grounds for legal action where "as is-where is" does not matter and applies to both dealer and private sales.
    Through the years I've had two friends successfully sued in small claims court regarding misrepresentation of engine size. In both cases the engine was swapped out with a smaller displacement engine by a previous owner and were misrepresented by the owners they bought the cars from. The problem stemmed from the fact they had no documentation (copy of the original ad, whatever) that they themselves had been duped and because of that they lost their cases. If you have some documentation regarding what engine was supposed to be in the car when you bought it you are probably OK. Otherwise . . .

    well; i've been in both sets of shoes; buyer and seller..... but, when i bought a car and it turned out to be a turd, i didn't go back to the seller; i made the best out of it by scrapping it and learning my lesson.... now; if i sell you something, i try like hell to let you know IF i know all the problems it has up front. that said, i'm not Miss Cleo.... you as a buyer need to take your responsibility. i don't have a wallet big enough to finance your education regarding cars.... you buy it from me, it's yours. i buy it from you, it's mine. go to WalMart if you want a money-back guarantee.
    it's not a case of "tough guys" and ass-whippings.... it's being a grown man and taking responsibility. go ahead, beat my ass.... i'll see you in court.

    it looks like a nice car , in ma it would have been rolling rust , he should fix it to his liking and flip it or drive it , but he should just go away 14 k sounds like a decent deal for a driver nomad , life is full of choices and each person makes their own ,

    Hey 'broke, give him $12K for the car and I'll take it for $14K. What does that tell you? Because it's a 305? C'mon already. Be calm, be professional, document, don't engage in a cuss-out festival. He got a decent car (a very desireable car) for what appears to be a really good deal. A pro-built Nomad can exceed 6 figures. Not cheap to do, but neither is a 4dr sedan! I'm pretty sure I could fluff and buff that thing a little, get some miles on it, and dump it at the next big "cruise" here in Motown for just under $20K. WTF is wrong any more?

    That's the "pro", the "con" is, I refuse to sell something that way. I broke that rule in Jan and actually spent $850 gambling that what I offered and sold sight-unseen was going to be actually MORE quality that what I'd described in the eyes of the buyer. I delivered the car 922 miles from home (!). Truth be told, it wasn't much of a gamble because I knew what I had, but then again so did he. I left having new friends in the midwest, but generally speaking, I won't do it. When I sold the 29 pickup I had 4 "I'll take it" buyers in the wings and explained that only face to face was acceptable. The 1st guy out kept calling me on his way here from Iowa to see if I still had it and to let me know where he was. I gave him my word I'd hold it until 4pm the following day w/out a deposit. He thought it was better than I'd described and left happy. The whole deal helped seal my faith in fellow car guys.

    I'm not knockin ya for the choice and you "papered up" good enough. Have a coffee or a beer and budget your next project. You're fine from what I can read. I've been at this gig for over 40yrs now. I don't hide from anyone and never will. It's easier than some think.

    There is alot of growing up between "it fell" and "I dropped it".
    Had a guy buy my 1980 Dodge aspen for $600. ran great with only 80k on a slant 6.
    two months out he calls bitching about bent valves and pushrods. He said he found BB's in the engine. I asked him how old his son was??? never heard another word.

    My buddy sold his mothers old DD and the guy looked at it and was happy to pay the price for the car as is. He called back a few days later and left a message that he wanted to return the car as it was going to cost too much to get it back on the road, my buddy never returned his call and never heard from him again.
     
  26. Well i sold a feller a 74 sportster years ago. The case had a crack and chip that had been filled with jb weld and leaked oil. Needed a new case half basically, along with tons of minor things. The guy beat me down on the price, how it was for his son, etc..

    I gave hima heck of a deal and spotted it on ebay maybe 3 days later. With a painted case and black painted chrome. He gave a nice story about this was his sons bike, he died in the war, its 95% restored, nothing is wrong with it. Just a bunch of lies.

    I wrote to him and told him that if he sells that bike to a real biker,then he should expect to have his teeth yanked out with rusty pliars.

    I drove down to Delaware to pick up a 65 Mustang I had bought on ebay, I had contacted the owner and asked about it, he described it to me, I bid, I went down to pick it up I looked at it, decided it was more work than I wanted to do there were better ones to be had, and I had called the woman I had been dealing with, there was supposed to be help loading it. I couldn't get a hold of her so I Left as I hit NJ I get a call from her apologising she had left her phone at home. I told her to junk the car or whatever she wanted to do with the car, and keep the money it was what they described, I was just foolish to think they were over describing it.It cost me around $700 all told between tolls and gas and the price of the car.Sometimes that's the way it goes, but it was nobody's fault but my own.

    I know a guy that was/is a muscle car/street rod/ hot rod dealer, this is how he makes a good bit of his money. He goes as far as to do a little research and actually file a complaint in his county so there is a complaint from the county clercks office stating that he has a complaint aginst the seller for x ammout of dollars, believe it or not he never does anything else and he gets money back on almoset every car he buys. He says something like he would like to have 25% back but will settle for anything they feel is wiuthin reason, so if they can come up with a number they feel is within reason and send him a check he will do his best to make that work for him and his partners in his business. Huge scam, but he makes good on all of his dealings every sunday... according to him...... Jim

    I'll admit I didn't read every post in this thread, but I read enough to find, three pages in, that you (unwittingly) advertised the car had a 350, and it turns out to be a 305. That might be an issue, but it's clearly a modified car, not a numbers matching original. I'd be a nice a guy and see if I could make the buyer happy with a partial refund of $500 to 1K, and chalk it up to experience.

    I ate the listing fees on my sons '68 Mustang convert when we listed it that online auction site, and a dealer on the east coast hit the "Buy it Now" for the full boat. We sent him the vin#'s, and it turns out the car was NOT a true GT as we thought (a totaled restoration we bought crashed) but a base 302 car. We advertised it as a resto-mod with a 302HO/AOD, not a resto of an original, but the buyer backed out. I never ran the numbers, the car has ALL the badging and cosmetics of a GT. Made no difference to us, and probably wouldn't have to hm either, as he continued to try to buy the car for several weeks, at a substantial discount. I finally told him the car was no longer for sale.
