California Title question

    I'm buying a 50's Cadillac in California. The ***le is lost but has a current non op on it. The registered owner has p***ed away and his brother is selling me the car. How do I get the ***le? Thanks!

    To clarify... Discussing ***les on the hamb is fine... buying and selling them is not.

    I just went through something similar here with a camper I got for my ot truck..

    The legal heir needs to go with you to the dmv with a copy of the death certificate and paperwork saying that they are the heir/ estate executor and you should be able to process it right there. You will also want the vin number off the car and any old registration or other paperwork that pertains to it. Old registration slip and or tag number.

    You should first check with your OWN dmv, as every state's requirements will vary. Once you know that, you can obtain the do***ents to register and ***le it, as needed..... :cool:

    The less you say, the better off you are. Have his brother make a bill of sale, and sign it with the owners name. Take your non op, and the bill of sale to a DMV service, tell them the pink slip is lost, and play dumb. The more you say, the more it will compilcate matters. Good luck!

    Ryan, I didn't mean it that way at all. His state may simply ask him to come in with the vehicle and fill out their own form (like a "statement of facts").... :)

    Statement of facts - lost ***le - plain and simple happens all the time. Form should be available on line www.dmv.ca.gov

    Besides which if the brother is selling the car put the burden on him to get a replacement ***le....
     
  13. Tell the brother he needs to find out who responsible for distribution the ***ets of the owner that p***ed away (the brother may be that person). That is the person who will need to sign the paper work at the DMV. If there was a living trust (I hope everyone has one, if not see a lawyer and find out why you probably need one) it will have an executer. If the car was left out of the trust there is probably a "pour over will" that will get the car into the trust ***ets. If there is nothing find out how the rest of the ***ets are being distributed. If the total ***ets are over $100K (check this to be sure I am still correct on this) there will need to be a probate opened but the car is not the factor driving the requirement to open a probate. My guess is that you could take the form requesting the duplicate pink along with the transfer papers to the person that needs to sign them instead of making them go to the DMV. It may take a little time but it should be an easy problem to solve (by all means do it right).

    I bought a car and then the seller died before I found that the paper work was not in order. I got the correct forms from DMV and his son signed them. Who's getting hurt? Nice clean deal. Kept the car for 31 years and sold it out of country. It was actually once on the cover of National Dragster. behind the car they were taking the picture of.

    Okay,first post,and I thought I'd come pick your savvy experienced brains here first,guys.I hope this is not violating any rules right off the bat. :(

    I'm thinking of buying an old non-op Packard as a 'training car' and parts car that I found on Craigslist.

    But,all the seller has is a 'bill of sale',no ***le.We,both seller and buyer,are all located here inside California.Seller's in Bakersfield;I'm in San Diego.My brother resides in Bakersfield and has agreed to hold it a few days until I can transport it down here.

    Question: Since the car is non operational and it will be used strictly as a parts car,will a 'Bill of Sale' do while towing or transporting it? I bought a Packard from Indiana and it had to be registered before it could touch a public road inside California.Does the same apply here? Will a transport company pick up and deliver a car with just a bill of sale?

    What should I require of the seller,if anything?
