Well, it's going on 4 weeks since my truck was damaged, and still don't know what's up. Many calls but little action. I called my ins. and my agent has been some help, but it's pretty obvious they're dragging their feet, so tomarrow I'll call my lawyer. What a lousy way to do business. I know the adjuster is going to try and pull some bull about the cost of the vehicle or the condition or somthing. I already have anger problems and this isn't helping.

You are being WAY calmer and nicer about this than I would be. I would not have left their place without the name and phone number of their insurance company, or better yet having their agent come by to write up the report.

The vehicle was in their control, they were driving it, so it is their responsibility........PERIOD. This is one that I would love to take to small claims court if they refuse to take care of it.

They are hoping you get tired of contacting them and go away, and if you do you are a fool. Start communicating via certified letter, with estimates enclosed from 2 body shops. If they balk, don't waste your money on an Attorney, that is what small claims courts are for.

They admit liability, I think this is how ins. co.s here do business. I should mention the repair shop gave an estimate of 5700 bucs and maybe more cause there might be hidden damage.

  4. I feel your pain Steve.

However this is why people get all pissed off at insurance companies and claim that they only ever pay out 1/2 of what the people claim the damage is.

I'm not seeing $5700.00 in damage here.

I'm hoping a lawyer will encourage them to do what small claims will make them do , without having to wait . Calif. has prettygood consumer protection laws so you don't need 2 estimates. I know they're going to pay, it's just a matter of when. The bad part is, I don't have my truck now and I was going to finish it in time for Autorama. That wont happen now.

$5700 sounds high unless there is hidden damage. I think it would be different if the truck had already been wearing a completed paint job.

Have it inspected/estimated by a reputable shop or two. Have your ducks in order prior to making a claim either through an attorney or small claims. Small claims is the way to go for a rather small amount, unless your insurance Co. will subrogate with their's? Its too small an amount to hire an attorney for the case. Hopefully a letter from the attorney will goose them to settle quick.
For $5700, you could bump out the fenders, replace the bumper and paint the entire truck.
Try to be patient, the truck is fixable, they're at fault and will eventually have to pay one way or another.

  10. Absolutely, and insurance companies know what's going on. They're not as stupid as some think they are. For one thing, they'll see right away that the bumper was damaged "prior" to this loss. Therefore the company IS NOT responsible for "old" damage. The bumper was shot before.... it's still shot!

I'm not saying to "bend over and take it like a man", but be realistic with the damages caused by the shop and your life will be much eaiser. The claim will be settled much quicker too and life can go on.

I have never let someone pull my vehicles into or onto a rack... if they wont let you then find somewhere else. hate to hear about this misfortune...

Had a jack slip from some retard at NTB I fought with them for 5 months to get 750 to fix the damage they did to my front header pannel.. so dont ever let up and be that pain in their ***.... might need to get a lawyer... I know Hagerty was ready to pounce on NTB when I was trying to get mine done...
