SRI It's a breath of fresh air to hear someone that wants to work through their problems. Honoring your obligations when you might have an alternative like filing bankruptcy is what real men are all about. I guess I would go sit down with an attorney and explain the situation and find out all of the 'what if's'. DO NOT sit down with a bankruptcy attorney. Like I once heard, asking a bankruptcy attorney if you should file bankruptcy is like asking a dog if he's hungry. Just find out what could happen. Next, I like the idea of a letter to each customer, but what would be better is a face to face meeting with each one. Explain the situation and that you aren't going to file and that they will get their car. Have your hat in your hand, so to speak, when you do this. If contracts need to be renegotiated, this is the time to do it. While you're doing all of this, keep building. Work another extra job and just don't stop fighting. Call on friends for help too. That's when you find out who is a real friend. You sound like a great guy and I'd lend a hand if I were closer. Keep your head up. Scott
P.S. Tim1, you're going to get your car. If you were dealing with a lesser man you would be out whatever you had into it by now because he would have filed bankruptcy. If you aren't a customer of SRI, my bad. But it seems pretty obvious. Scott
Well, talked to an attorny. If you are someone I am building a car for, expect an email this weekend. Basicly, I NEVER intended of ever reopining again. I will always build cars, but it will go back to being a hobby. The lawyer said, since I would like to move anyway, and since I am also selling some land we bought up north, to contact the guys, if they still want us to finish (and they are ALL almost done) and do so before listing the house to not scare any of them. The ones that just want the money back (have even offered them 10% annual on any money invested) to sell thier cars (because they are worth more then they are paying anyway) and pay off those with either the sale of the car or the land. He recomended not filing bankruptcy unless none of that is good enough for them and they want to "take another route". So that is where I stand. I thank all of you for your advice. And this builder is DONE!!!!!!!!!!!!!!!!!!
hey, sri, keep us posted, ok? even if nobody HERE gives a shit, i do... i'm hoping the best for ya...
S.R.I.- You are clearly trying to live up to your word. Kudos. keep building. funny thing is, if you get it done by the 25th, any legal actions attempted by "that feller" would pretty much be moot, because we all know Due Process ishould be called "slow progress." keep up the good work, and do what you do.
I have dealt with the public and ran my own business. I wish I was closer to help you out with my labor. I have seen so many guys just say F-U and run with the money. My hats off to you trying to settle this in an honorable way.
