There are no numbers on a GM frame from that era. I do not know when they started that. I know a 39 Chevy does noy have frame numbers. You may be able to do state assigned numbers. That is up to your state. If you want the car, give the man a deposit to hold until you get a title. If he wants the title in his name it comes out of the price of the car or he pays for it if you do not buy. If he isok with it directly into your name just pay for the car when you get it.
If he can prove that he's stored it for two years, he should to be able to file a lein for storage charges. So much per day for inside storage.
As long as we're doing super sketchy shit, why not just go take it when he's not there? Or have a buddy call and ask if the car he was storing at dead bro's house is still there, when can he come and pick it up. The guy has no way to prove it was his or that it was stolen.

It looks to me like it was a street rod at some point. Unless it met with a lot of red flags after the pink was sprayed, it was or is titled someplace, or it was built with a pile of parts that someone didn't follow the paper trail correctly on. If the guy that now has possession of it (or his dead brother) did not have an operating business, they may not have a right to claim storage against it, and even then, the dates would have to be documented with an owners signature. At this point, without proof of ownership, my take on it is that someone is trying to sell you a stolen car. From here, the entire process may start an ugly ball rolling for the guy trying to sell you the car. Do you really want to be part of that mess? That car, in that condition, under these circumstances, is a hard pass for me.
Part of me would really love to own the car. I could see it with a proper power train, the hair dryer would have to go. Everything else looks HAMB friendly. That was one of the cool cars when I was growing up. It is affordable, but I don't think he has any legal standing to sell it, which as mentioned could start an big ol crap ball rolling down a hill at me. And I wouldn't want to get run over by that ball. Best case scenario, I'd have to lie my butt off to get it titled as I can assure you he doesn't have receipts for the parts that are on the car. And yes it looks like it was a runner, so where are the keys, and what happened to the registration. I'm pretty sure his brother didn't take them with him. But wouldn't that thing look cool with the blown big block I'm getting ready to drop in the 51? Of course they don't show the rear end, so it's probably another 10 bolt.
Just another fool online. Here's my 2 cents. Seller dealt with the death and the estate. He knows paperwork is a pain. He just WANTS to get rid of the car. He WANTS to get a decent price for it, but doesn't WANT to deal with the hassle of doing it right. You WANT it but don't WANT to deal with the hassle either, especially not at a rainy day price vs beer price. Seems the only things you 2 agree on is not WANTING the hassle and he WANTS it gone and you WANT it. Go back and explain that for the hassle, he has to come down a lot OR he has to deal with the hassle. Otherwise, you don't NEED the car and the hassle. Oh, and you want a signed and notarized statement of facts from the guy no matter what. I'd even look into an initial consult with a lawyer who specializes in this sort of thing.
Well at first I was on the "go ahead and buy it side" but I was thinking it was just an old car, complete but not running, little rusty, very dusty, flat tires etc... After seeing the photos I would have to say this car was running and at least close to being on the road not too long ago. So I bet there is an owner and paperwork somewhere. RodStRace has a good take, let him know that the price has to make the hassle worth it to you. Getting it very cheap would be the only way I would buy it.

He owed $2,500 bucks for labor and thought "Hey I'm good for it" was enough. Nope. I was keeping it outdoors that summer as I needed the room in the barn. I suspected shenanigans so I moved it inside. Heard thru the grapevine he did a drive by to shag his car while I was at work. As of 08 it had been just shy of 2 years. I went thru the process which was fast and easy here in MI. Took my official paperwork to the S.O.S. after the no-show auction, which was posted in 3 public locations and 2 classified ads as well as 2 letters of intent, 1 registered and 1 not to assure it was delivered. The only thing was I couldn't get the $5 quick title service (same day) but it came in the mail 5 days later. I got paid. I sold the car. LEGALLY. So this guy can either ask for more lube or take the easy steps to assert his rights. Keep this all in mind moving forward for any like issue. A private individual or homeowner is NOT a target for those who'd prefer to fuck you outta your space, labors, parts, etc. when any form of legal agreement exists. Yes, verbal agreements count too. Good luck, tell the seller to get off his ass or enjoy being stuck with it.

As some have pointed out, yes the car is way to nice to not have documentation somewhere. But having been through dealing with a siblings death and their unorganized/undocumented affairs, I understand that it very well could have been his brother's car. I would think he would have known that, but who is to say how close they were. It could be something his brother held from their parents estate. But, with no documentation it is a crap shoot as to what you are buying. Yes, a unreputable person could very easily claim it was their car and go and try to get it. I don't want to be that type of person. The seller struck me as a decent person that may not have the intellectual capacity to go toe to toe with a win at any cost hustler. I don't want to take advantage of him nor knowingly help anyone else. I like the car and would enjoy it with a few minor changes (engine and color mostly). I know I can get the car titled, if it is truly not owned by anyone at the moment, other than the seller undocumented ownership. But, in our country today, there are too many people looking for something for nothing. I can see someone popping up and laying some kind of claim to the car in the future and it becoming a royal PITA. That could trigger old ways of dealing with problems best left in the past. If the seller still won't sell it the right way or complete documentation to my satisfaction (based on what an attorney says), then I won't buy it. And it seems that will be how this chapter plays out.

yup, not to mention the fact that those are mostly wood, the sheet metal body panels are held onto the wood with nails. if all of that is original I can't imagine how loose and creaky it would be

Yep, he listed it as sold. I messaged that I'd like to look at it in person. He didn't reply and subsequently the listing changed. It is very convenient that this deal pops up the week that Good Guys is in his the town where the car was listed. I think I'm far better off without it as I doubt it was on the up and up. But, I did show the wife what one looked like at the Good Guys show yesterday. She wasn't impressed. She preferred the old Ford Pickups. And I married her why? Actually her point was valid, not much room in the coupe for both of us on a long road trip and I'm 6 foot and she's 5'10. Not to mention, she does like to have stuff with her when we travel. Maybe I should show her some old Ford panel trucks as she says station wagons are old people cars.
