Calif law stoping private party car sales?

  1. I don't put anything beyond the realm of possibility with the California Legislature. They are the biggest bunch of tax & spend, power-hungry whackos around.

    I seriously doubt that. Maybe in NYC, where cars are hated, but there's no law I've ever heard of (or would obey) in the rest of the state. Of course, considering the one-party rule we're in for, I guess ANYTHING is possible now.

    Well let me put my tin foil hat on for a sec. Saying "thats not gonna pass" and then not doing anything to prevent it from passing is the exact compliance the government wants. Glad i live in a good ol simple state. Ill take some of that popcorn now.

    Even here in Queensland Australia a private seller can't show a "For Sale"
    sign on a car.If the car is for sale it must have a current roadworthy inspection certificate(less than one month old) displayed.

    Most sellers just have a sign that says "Interested" and phone number.

    Just more bureaucratic bs to get around

    not many people buy cars with signs anymore anyway,put it on craigs list or ebay local pickup. thats where everyone searches now anyway. :)
     
  11. This law is not bullshit at all, and has passed. It became law January 1st.

    It was supported by the Licensed car dealers and dismantlers in Ca, in an attempt to halt unlicensed dealers from selling cars out of their home, or on the street, etc.

    This is not to stop you from selling your own car to a private party, and does not apply to that. Unless you go over the 4 or 5 you are allowed each year.

    there are too many people buying up cars at public auctions, many times more than just one or 2 a week and flipping them for a few bucks. I personally know at least a dozen that buy 10-20 cars each month, and sell them all each month.

    Most go to Mexico, but others get sold locally.

    You would be amazed what the overhead to have a legally licensed dealership is, and how easy it is for bootleg sellers to knock the legs right out from under you. They are buying at the same auctions as you, but have nothing to do with the profits but to stick it in their pocket.

    Believe me, I hate the CA government on every level from local to state, I am not defending it. It has been in the works for many years.

    So now, instead of tickets on the cars for sale, they will get impounded on the spot.

    Here in San Diego, the place slightly south of L.A. just in case you where wondering, the whole Gypsy car lot thing is out of control in the inner city areas. Some streets are just rows and rows of cars with signs reading "Se Vende" on them and a few guys that look like they are going to the Pimp n' Ho ball, but dressed rather badly, standing around on cel phones.

    Unfortunately they are the ones fucking it all up for the real Private Sellers around. So yeah, I think going online to sell your ride might be the best bet.

    We have the 72hr. parked car rule here and it is rarely enforced due to the San Diego budget being so screwed up that meter maids are getting pulled to fill other positions.

    The City of Chula Vista, even further south of L.A., already passed some fucked up ordinance on pvt. sale signs on cars because they look ugly and might affect private property values!! Yeah, believe it!


    But hey, why worry, the weather is going to be in the 80's tomorrow!

    January 3, 2009 -- California has thousands of unlicensed dealers selling cars for years with
    little or no action by law enforcement or the dmv the numerous complaints against these unlicensed dealers have brought a new law with some real teeth the law will change jan 1, 2009 and enforcement will begin the new law amends the vehicle code ( section 22651 )
    to allow removal and impound of all vehicles offered for sale by unlicensed car dealers
    you may still legally sell a vehicle as a private party if it is registered and insured in your name otherwise to legally sell vehicles you will need a car dealer license we offer our car dealer class required to get licensed we are certified and approved by the california dmv
    in every region of california prices start at $ 100. with a free online tutorial in-person attendance is required by the dmv

    Thats the assembly bill on the DMV site. It is the law now, and targets unlicensed dealers.
    The parking tickets for selling on the street, etc might fall into your town's jurisdiction as usual.
    If you have a bunch of cars for sale at your house, I guess it gives any peace officer the permission to have them impounded.


    It sucks on many levels. For example, I get a notice from the county to get rid of my cars at home..so I put them up for sale so I don't lose my ass on them, and now they can just haul them off? Or a guy losing his house has to sell his cars just to afford a new place to live?

    I'm sure people will get screwed by this one.

    the DMV won't give you a license to sell cars out of your house. Just have a look at what you have to do to get that done. You have to be properly zoned, 50,000 bond, etc.
    The class is the easy part.

    So this law targets unlicensed dealers. This is a good thing, not a bad thing. Good job California! Got another one right.

    FOR SALE BY OWNER.....MEANS YOU HAVE TO ACTUALLY OWN THE CAR

    curbstoning is the practice of selling vehicles without a valid car dealers license

    the vehicles are sold from the curb, with no state oversight

    without warranty, vehicle history or the traditional protections of car dealer law

    ( minimum safety standard, warranties, car buyers bill of rights and buyer recourse )

    california has a new law which authorizes seizure and impound of ALL

    vehicles offered for sale bya curbstoner, an unlicensed car dealer

    ..............................<wbr>..............................<wbr>..............

    if you are the OWNER of a vehicle

    and the title has your name upon it

    you are allowed to sell up to five ( 5 ) vehicles per year

    as long as your intention is NOT to make a profit

    this has been the law for a long time

    the keyword here is OWNER

    if you have purchased a vehicle for resale

    and you have not paid the sales tax and dmv registration fees

    you are NOT legally the OWNER of the vehicle

    you may NOT legally resell that vehicle

    this has also been the law for quite some time

    but with limited resources and curbstoners numbering in the thousands

    the state has been unable to stem the tide and pain of these unlicensed car dealers

    this new seizure and impound law

    gives law enforcement the power to solve

    the curbstoning problem

    once and for all

    the new law will help by

    hitting the curbstoner hard

    in his wallet or pocketbook

    some curbstoners have 10, 20, 30 , 50 cars for sale

    and they are all at risk of

    seizure and impound under this new california law

    the ability of dmv investigations,

    chp auto theft task force

    or local law enforcement to

    legally seize and impound these vehicles

    has these curbstoners, unlicensed car dealers on edge

    the law went into effect jan 1, 2009

    but, just like a new stop sign at an intersection

    law enforcement will allow a grace period

    usually 90 days or so

    seems simple enough

    many people defend curbstoning

    without a clear understanding of the definition of

    just what is an unlicensed car dealer

    if a curbstoner wants to get licensed, it is simple enough

    the tax exemption for dealers allows resale without paying

    sales tax and dmv registration fees PRIOR to resale

    it becomes the car dealers responsibility to collect these fees

    when they sell their vehicles to the public

    they must do a smog and safety check

    post a buyers guide with any included warranty information

    and notify the dmv within 5 days when they sell a vehicle

    Well, I don't know....call me crazy, but I have to be licensed to run my business. If I understand all of this correctly, this law is requiring folks running car sales businesses to be licensed.

    People that buy 10-20 cars a month and then sell them are not in it for the "hobby", they are doing for financial gain....aka "business".

    I think businesses should be licensed to operate. This law makes it a requirement. Why is this bad?

    What am I missing?

    Thank you Charlotte, those are basically the same rules that Washington State has. You would be surprised how few private people actually go over the 5 car limit.

  29. In every city there is a street where people park cars with for sale signs. Just imagine you had a house on that street. You can't park in front of your house because there are three cars parked there with for sale signs. The value of your house is depreciated because who would buy a house in the middle of a used car lot? I for one would support a law limiting parking cars with for sale sign to 4 hours.

    Exactly, they go after "curbsiders" up here too. Nailed one guy I know who had 10 cars sitting in a K-Mart parking lot next to the street. That guy used to sell about 50 cars a year he picked up at auction and stuck out on the street. Bad part was he had a repair shop with a lot next to it that he could have done things legally if he had wanted to.
    I can drive to one parking lot right now and there may be ten to twenty cars lined up along the curb with for sale signs in them and several with the same phone numbers.

    I don't blame the car lots for pushing it but still a guy should be allowed to sell one or two cars a year out of his home or with a sign in the window. Trouble is that most of the curbsiders don't put the car in their name so there is no way to trace them.
