Close call in the 50 shoebox last nite

    What exactly was that giuy doing at the point of impact? Talking on a cell phone? then he is at fault. Driving his truck? Then he is at fault. If he hit you from the rear, he is at fault and owes you another car or enough money to buy and build one.

    Even if your lights were off, and I'm sure they weren't, it'd still be his fault. You have to be able to stop no matter what is in front of you. I'd say he was on the phone or screwing with the radio.

    Lucky, blessed, whatever, that was one heck of a crash for sure. Glad your okay!
     
  4. Man, I would still be shaking if it were me - so glad you are OK. Real sorry about your car but very glad you are OK - I'd be saying a few words of thanks every day - cars can be replaced, you can't be!

    i just got finished with a law suit a week ago from july of 07. i got hit riding a bike (lance armstrong style) side swiped messed my back up and all. the police didn't do shit even with 3 witnesses present and pictures of it while it was happening. brothers girlfriend was following me and took pics of this going down. they actually tried to pin it on me. the guy that hit me was a ex cop and his son is a cop too, that lived in the next township. my point being write everything down you remember from the accident it will come in handy should you have to go to court, if you go to deposistion they will ask you the same questions over and over again wording them differently to discredit your view of what happened. i did this and it still took forever to close the case. And yes that guy was movin pretty fast i deal with body shop cars everyday my .02 cents, at the very least on the conservative side 45 mph. glad you walked away from that. do yourself a favor and get check out by your Dr.

    Shit man! Glad you're alright! I don't know about NY, but in Florida if you're rear-ended it's automatically their fault. No ifs, ands or buts.

Guys don't think just because someone hits you from behind and you are stopped it is their fault. my son and i got hit a year ago stopped at a red light, and the kid's dad is a cop and they worded the report in such a way that their insurance co is saying no we are not at fault! so this is going to be a long fight. here is a pic of a guy that was hit as he was driving home 2 weeks ago, he was doing 50 mph and was hit by a honda going who knows how fast and this is what it did to his car.

    I'm so sorry to see and hear what happened to you-glad you're OK.

    I was in a contested wreck a while back (long story short, other driver hit me head on, but the other ins company tried to argue that I shoul've been able to swerve/stop to avoid getting smashed)....

    Anyhow-write down everything that happened, and only talk to your own ins. company right now...believe me, the other driver's ins is going to fight this 100%, that's what they're paid to do.

    I wanted to give you a bit of advice, which may be a long shot.

    If it comes down to it, find out if you can subponea the other driver's cellular records (assuming there is cell service where you were wrecked...). I'd be surprised if the person who hit you wasn't either texting or talking on the cell-they had to be distracted in some fashion. Also, measure any skid marks (you don't have to worry about the skid marks in your shorts though), and take good photos of the scene.

    Again, so sorry to see your hard work torn up like that, but congrats for making it through it alive-you'll get to build another one!

A rear end collision is unique in vehicular accidents. There is usually a clear indicator of who exactly is at fault. This does not mean, however, it will be easy to obtain a fair rear end collision settlement from the insurance company. It will be up to the victim to provide sufficient evidence to prove his or her case
    Factors To Consider

    A rear end collision, like many other types of vehicle accidents, consists of damage to two different components. These are the vehicle and the individual. Both may require replacement parts or at least some form of attention – either medical or automotive repair.
    • Vehicle – you need to decide whether the car is a total write-off or in need of restorative repair. Your insurance company will provide an estimate as well as their preference. It is up to you to decide whether their stance on this is valid
    • Personal – you may require medical care. There may be soft tissue damage e.g. whiplash. You could also suffer long-term damages. Be sure to consider such things as doctor’s bills, physical therapy, work loss, and other related “special damages.” Do not neglect other aspects resulting from the accident such as pain and suffering (general damages). Not all insurance companies will cover general damages. This is particularly true in a no-fault state.
    Proving Your Case

    The onus is on you to obtain the information to pass on to the insurance company – yours and that of the at-fault party. The insurance companies will do their own due diligence and arrive at a specific sum. It is up to you to provide them with accurate information. You must also be ready to back up your figures if you disagree with their settlement. To do this you need to
    • Inform the insurance company immediately about the accident
    • Report to a medical professional and keep accurate records of their initial and subsequent treatments and assessments
    • Gather expert testimony about your condition
    • Make sure you obtain a police report
    • Keep all documentation in an orderly fashion and make sure the company has a copy
    • Be prepared to refute the company’s “expert” findings with qualified and experienced experts
    Hiring A Lawyer

    Consider hiring an attorney to help you in your fight to obtain a fair rear end collision settlement. An experienced attorney will know state regulations and be capable of presenting your case effectively to the insurance company.

    Man, glad to hear you walked (hobbled?) away from that. Get your neck and everything else checked out. And keep us posted on the outcome.

    Seems all too often that when a cop is involved, even when they are obviously at fault, that the law somehow twists into a confusing DNR ribbon that ultimately favors the cop.

    old soul---I will not try to tell you what is right for you BUT I will tell you what I would do if it had happened to me. I would start by getting checked out by my doctor and find out if any issues could start to bother me later - the neck pain could mean more serious issues as time goes by. Then I would get some good legal advice not necessarily from a high profile lawyer who wants to go after the big bucks but one who knows traffic and/or insurance regulations for NYS. Then I would get together with my insurance agent to set the expectations of what he/she should and would do on my behalf. I would also get a copy of the accident report or have the lawyer do so. This would mean a lot of time spent to find out what the story is but you have lost a neat car and you have some possible lingering injuries. For the record, I work for a law firm (not a lawyer so no legal advice here!) and my wife is an insurance agent. Best wishes from a fellow New Yorker.

    doctor! get there as soon as you can. its complete bullshit that you have to jump thru a couple more hoops after jumping from a flaming shoebox but if you dont your gonna end up getting shorted by a no account insurance company.
