Florida Hambers Attention Ped. Killer POSER!!

    Hey, seems like i been through this shit enough already, some of you who have been on here for a long time probably remember the last incident. Well, it's come to my attention that some dude in Fla. is running a painted version of our name and skull on the back of his FLAT BLACK Anglia. At least this time it's not a stolen plaque but still uncool, he has no affiliation to our club whatsoever, and we don't have any chapters outside of SoCal. If any Hambers on here know the dude, could you please ask him(nicely) to have the paint removed from his car. I heard it was at the FLA Rumblers car show, and I'm sure he's a nice enough guy, even if slightly misguided and I'd like to give him the chance to take care of it before anybody gets pissed off at him(I don't wanna go through what happened last time) Thanks for any help in advance, one day my life will be simple and I won't have to deal with this shit anymore!!

    PS for anyone who doesn't know its "Pedestrian Killers"

    I saw the car. I think he won a trophy. Nads might know who he is. I've never seen the car before. I figured he had bought it from you guys, allthough I did think it was odd that the logo wasn't removed.

    I bet he's at the nostalgia drags at Lakeland Speedway this weekend. If some HAMB'ers go...maybe they should pass the word along.

    I always wondered how this stuff is handled.

    I mean, how could there not be people not using the same names as other clubs.

    is there really one only club called the salvagers, or the cam-breakers, or the shifters, or the contenders, or roadsters, etc.

    have you heard the line............"everything under the sun has been done" ?

    I was wondering if i or anyone else wanted to start a club they seriously could not even come up with an orginal name.

    I used a thesauras for 2 hours and could not find one good sounding name that was not already used by a former club.

    but i agree that people should not copy someone else's name. that's messed up.

    most clubs a copy rited? funny iv,e never seen anyone slap a hells angles patch on there back and call themselves a new club
     
  7. It is one think if the back of the car says "pedestrian killer" and has a skull or something. It is a completely other thing if it looks exactly like the logo of the club, and is a blatant rip off....

    you mean not only did the use the same name, but the way the logo looks is similar. that's even more messed up.

    I don't the guy, but he was at our show and he did win best race car. It's a Toplino not an Anglia.
    I asked him about the Pedestrian Killers painted on the car, he said he'd got the idea from Death Race 2000. He told me he had no idea that there was a car club with the same name, he's in no way trying to pass himself off as one of you.
    Dan, this is the first time I've met the guy and he seems like a really swell dude. If he's at the nostalgia drags tomorrow I'll tell him what you told me. I'm sure he won't be a dick about it.
    I don't even know where he lives. This car's strictly a drag car, it doesn't see any road duty so it's not out at every cruise night.

    I'll let you know what happens.

    an older friend of mine's brother was a hells angel. he grew up in san fransico in late 60's. and some of the shit that went on at their parties is unbelievable. also what they did if someone they knew got screwed with or screwed out of money. interesting that my friend turned down their offer of membership

    i learned alot about the "one percenters" from this friend

    thanks for all the feedback. Unfortunately I havent seen it in person, just going on info I've been given, and unfortunately this is just the latest in line of a few incidents i've had to deal with. Like I said, if he didn't know it was a club he was just not well informed, but it's a matter of respect. i wouldn't paint the name of an established club on my car or start a club using an already established clubs name, even if they were on the other side of the country from me. I came up with the name for the Pedestrian Killers about 10 years ago when i was still in the lucky devils, it was a sketch I did that i still have of a guy standing with his back to you wearing the club jacket, with a coupe crashing in the background. I don't want anyone to give this dude death threats or anything like that, he didn't steal our plaque or anything, but hopefully when he finds out whats up he will respectfully remove it or change the lettering to something else. Thanks for the support, there are still plenty of good names to be had you just have to be creative.....here's my gift to you(if it's not already taken) The Mis-Carriages, yer logo could be a Roth-esque aborted fetus driving a hopped up baby carriage, have fun!

    OK here's the deal Dan. I did see the guy at that dragstrip yesterday, he does live in Orlando and he races the Topo on a regular basis. It's a fast mutherfucker too.
    I told him what you told me and asked that the Pedestrian Killers would like you not to run their name on his car. I also told him that the next move's up to him. He asked if you guys want him to 'cease and desist.'
    Dan, you've gotta dig this, I don't want to be in the middle of y'alls dispute, Orlando's a very small city, pretty much all the guys into tradtional hot rodding know each other and I don't want to rankle the people who support our show.
    I shoulda have gotten the guy's name and number, but I didn't, I can get it next time.

    You've also gotta know that the guy's really a stand up dude and he wasn't an asshole about anything. I also understand the position you're in, we're goona have to deal with some folks down Miami way who're doing some stuff we don't like.

    Can you post a better picture of your logo so I can compare it to what he's got?

    hey Nads, thanks man, heres our logo from our website( for comparison uses) and also a link to the website, maybe you could send him a link to the site so that he can see that we aren't just a bunch of kids trying to ruin his fun. I don't want to have to deal with a cease and decist(if i don't have to), I would rather have him understand that what he's doing causes confusion within the hotrodding community, and just honor that and take care of business like a man. Besides tell him to look at the article about my 31 coupe in #2 Hot Rod Deluxe called"Pedestrian Killer" that ought to clear up any confusion as to names of cars. He sounds like a cool guy, and tell him we understand that it wasn't intentional, so hopefully it wont have to go any further. Also, our jackets have the logo in the center with Pedestrian above and Killers below, like his car is done. There was also a band in OC that used our logo on their CD cover, stickers and T-shirts they ripped it off from Burnout magazine, and I had to do a cease and decist, it's a pain in the ass, but if I have to I will.     Just a random thought, what would happen if this dude in Orlando had a pic of his car with that logo from say 12 yrs ago. Who would be obligated to redo there logo? I am not causin trouble its just a what if.

    i think he who showed it first wins...but in Dan Collin's case, i remember his club name when i first heard of him...back in 2001...i filled out most of the registration cards for Moldy Marvin's Rat Fink Extravaganza car show...

    I was gonna say what is the big f'ing deal if his drag car runs the same name as your club.

    But since his logo is identical to yours, I realize what the big deal is.

    I agree, there should be a s&d on this.

    But would it work? Its not like he is making money off of this logo or causing you to lose money.

    i understand the principle of it all, but can anything legally be done?

    yea, something can be done, especially in Dan Collin's case. he is a copyrighted artist and the Ped. Killers logo is one of his pieces. so even if the name of the club (let's say as a hypothetical) is not considered an actual trademarked organization, the artwork that represents them is...

    on the issue of whether or not the guy is making money off the logo, he IS using it as a form of marketing (on purpose or not) so it would be considered that he is making use of artwork w/o paying the artist & creator-- royalties and all that good stuff, ya know?

    as Dan mentioned, he already had to go through this with a band, so he can definitely do something about the guy who is rockin' his art...

    The thing is, I'd buy the whole Death Race 2000 thing, but not if the logo's 100% identical. He must've seen this somewhere, it's not like you PKers are living a life underground invisibible to all but the moles.

    Thanks for the support guys, like I said, I'm not gonna jump to conclusions yet, hopefully the guy is as standup as Nads says. It's not a matter of money to us, basically, we don't want to dilute the image of the club. I would never sell a t-shirt with our logo on it, our support shirts had a seperate image, and we've had to fight so hard and i've even pissed off some people who wanted to be able to buy or own a plaque without being a member(not gonna mention any names) and if you don't fight each instance the following instances get harder to manage, and harder to win. If it's the art or the name, either way, it creates confusion within the community, and dilutes the image of the club, and say for instance this guy wasn't such a stand up guy and ended up actually hitting a kid on his bike or something(hypothetically) then it would draw negative attention to US. say on a lighter note, he just happened to be a scam artist and pissed off a bunch of car guys who thought that he was part of our club cause he had OUR NAME painted accross the back of his primered car. See how it could turn into a problem? If a member of our club did something fucked up and it was brought to my attention I would be able to do something about it. Thats one of the reasons our club is so small, and why we no longer have chapters anywhere else. I personally would be embarassed to run the logo of a club I wasn't associated with, I would feel like a poser, but that's just me. like i said, the name and art are copywritten, published, dated etc. Fiat Toppolino's are badass, and i was actually thinking about building one some day, but it would suck if I couldn't run my own artwork on MY own car cause some other dude put MY art on HIS car first, doesn't make sense does it? Just trying to make a point. Like I said, I have every hope that he is a cool ass dude, and it will end there. Sorry for rambling.

    Collins, you're not rambling, I'm on your side 100%.
    I honestly think the guy took your idea, but I don't think he realized how important it is to you, honest mistake. I'd be hopping mad, but I don't think he really knows how important the PKs are to you.
    I betcha if I sat down and had a mano y mano with him he'd see your side.

    Trust me, the guy's one of us, he wants to go as fast as possible, as quick as possible. I just don't think he realizes what a small comunity we really are and I don't think he meant to trad on anybody's toes.

    I'll see what we can do. I'm sure it'll work out allright.
