Here is a link to this mornings newspaper article about the ruling in favor of the Mo Kan dragstrip. http://www.joplinglobe.com/story.php?story_id=118050 I was happy to see that the judge ruled in favor of the strip. Carl, the owner, has worked a lot of hours to provide us with a good place to race and he needed this victory.
It almost always goes the other way as the county would rather keep the larger tax base happy. I just hope the nit **** enforcement doesn't tighten up as a way to make the thought of staying less pleasant.
Hmmmmm.....you buy land (large amount at that) NEXT to a Dragstrip. And later complain about noise. Kinda like building on a flood plain, and complainig of FLOODING. Fine the plantiff for clogging the system with 'sewage'. Thank's for posting a win for the 'strip.
Good to hear. This sub heading caught my eye "Ruling finds neighborsnot significantly harmedby proximity to racetrack" it looks like someone forgot some spaces but it makes for a better read in my book.
"Gee I realize that your track has been here for 42 years...but I just bought the property next door and the noise is bothering me" What a ****ing ***. Glad the judge shot him down.
If you don't want land near a dragstrip... Don't buy land near a dragstrip.... Dumb***! Good gob Bill! HC
WOW! A Judge with some common sense and the balls to apply it. Can you send him down here... PLEAAASE!
WOW!!! A judge actually interested in practicing law!!! I guess that *** hole should have hired the lawyer who sued McDonalds for the fat ****s or coffee burns!!! So, How much noise do you figure we can make at the HAMB drags? Open headers EVERYONE? RASHY
A huge amount of the chicken you buy in stores comes from here in Georgia. Huge 400x60 foot chicken barns all over. Ever smelled a chicken barn? It ain't pretty. People keep buying property next to them, and then ***** until the chicken farmer is forced out of business, either through the judicial system, or get the area re-zoned for residential. Happened to a guy here, and he'd just built the barns two years before (HUGE investment). He lost, and had to stop raising chickens. So he walled off rooms inside each of the barns, added front doors and windows to all the new "apartments" and crammed them slap full of immigrant workers, who cut through the surrounding neighborhoods to get groceries, to the bus stop, to school... Another guy in Florida ran into the same problem with his trailer park. He solved it buy removing all the mobile homes and starting a perfectly legal hog farm. I say we all buy that judge a big ol' snort, and invite him to the track! -Brad
The good folks just outside of Charlotte NC wanted to shut down the dragstrip.........Shuffletown Dragway. They tried a time or two without sucess. The City of Charlotte said we have a noise law, They would HAVE to shut down if you were in the city limits. Put it up to a vote and the citizens voted themselves into the city. Nevermind that the dragstrip had been there over 40 years. It was out "in the sticks " when it started. They moved there......... Another one hits the dust.....
The track owner better quick try to get an injunction to keep the neighbor from developing the land as residential or it's just a matter of months before it starts over again. That happened here in Long Beach with the Marine Stadium. They built town homes all along next to it and a month after they sold them there was an order to stop running ski boats and wekly races in the stadium
This type of thing happens at airports ALL the time! The airport is there long before anyone builds houses there. They build houses around an airport and they are cheap. People move in and after a while complain about the airport near their houses!? Damn airplanes making all that noise! ***es
Good news, its good to see common sense win !!!! we have it all the time here with folks with too much cash buying what are now expensive houses around the outside of a local speedway track and convcert venue (natural volcanic ampithetre), they have been racing speedway there for something like 70 years and people still whine about the noise, hell it was there before all of ya, you don't like it ya shouldn't have bought there !!!!
The bad part is Carl spent a ton of money defending the track. Bealls had lawyers on retainers so it basically cost him nothing, To bad the Judge didn't make him pay Carls legal bills.
