    Ask the insurance company to confirm that in writing so that you can forward it to the Attorney General's office. In fact if they give you the runaround contact the consumer affairs department of the AG's office - the insurance will really love the scrutiny, bureaucracy, red tape and paper work.

  4. If you do not want to move the car to a body shop, then have an independent adjuster come out to give you an estimate to compare to the insurance adjusters estimate. This happens all the time. I inspect heavy equipment for damages such as yours. If you have placed a claim with their insurance carrier, you may not need a lawyer, unless there is a legal issue down the line.

    I cannot comment on matters of legality and liability, however, I CAN say from personal experience that if the insurance company starts passing you around and refusing your claim, call the insurance commissioner in your state and file a complaint. I've had problems in the past, and a call the the commissioner got an immediate response, and, in less than a week, money from the insurance company.

    The insurance commissioner exists to protect consumers, NOT insurance companies, and insurance companies do NOT want to get involved with state regulators. Give it a try...

    I wish I'd known that years ago when I had a claim with Farmer's. My family had been with them forever, and they tried to diddle me around over a minor claim. I dropped them forever.

    But I might have actually got a settlement had I been aware of the laws.
