If a cashiers check was good as gold you wouldnt have to wait 10 days for the ****ing thing to clear? Yup i got one for 42.5k and it didnt clear and hit my account for 10 days just like they told me when i deposited the ****ing thing... Nothing is good anymore unless its cash and thats scary too.. when the guy came to pick up my roadster he handed me 24k in 100's and 50's.. I gave it to the wife and when i went into the house after we loaded the car and he left she says i called the bank and they are closed.. I told her no way was she going to the bank with 24k cash... I lived on it .. **** im still kinda living on it but it dont take long to spend Any cashiers check can be stopped . If it couldnt there would not be a waiting period. The bank it was drawn on may be iffy too. Dave
In case he did just use it to haul a car home, ask the cops to check with the DMV and see if he bought a car recently in the vicinity of where he picked up the trailer, or anywhere, for that matter. And, although this doesn't help your situation, thank you for bringing this to our attention, I for one will treat a cashier's check just like any other check from now on!
The guy that bought my roadster offered to send me a grand to hold it and he said he would send a bank check.. I told him why bother just send me a personal check cause it takes the same amount of time to clear... Dave
well after a few more phone calls and reading all your advise, we contacted our lawyer. he called the banker in sd and advised her that she may want to rethink her clints decession to do a stop payment, or we would be seeing them in federal court real soon. wouldnt you know she said to go ahead and deposit it, she'd make sure the check cleared. thanks for all the advise.
good out come. super advice. I bought a pen at staples for 5 bucks to ck money. Thanks from an interested party for all the good advice.lawyer up.
If ya gotta take something other than cash make it a US Postal money order, ain't no puttin a stop on them and they gotta pay cash for them.
go ahead and deposit it, she'd make sure the check cleared And that's what you get when you make a woman a bank officer - sorry. "Stop payment" orders are covered by banking law - it's not a favor that they do or don't do, based on whether they like you (which is how women evaluate all business and legal decisions). Stop payment only requires proof that you're the purchaser, probably the original receipt, and... (drum roll) a cash deposit in the amount of the cashier's check (or a hold on your account balance in that amount), which is held in escrow (I don't know how long, it may vary between states). They stop payment when you give them enough money to hold so that if it goes through they don't get hurt. They cannot refuse to stop payment (what are they supposed to do if it burned up? you're robbed?), and certainly not based on a phone call ("Oohhh, you're an attorney? Hold your business card up to the phone, please? Well, that's OK, then").
