  3. What kind of truck?

    I used to get get pissed because some dude parked a ratty hvac van in front of my house, which was illegal. A few of us complained.

    Sorry, no one by that name works there, and no city official can ever, ever tell you that you can break the law.
     
  8. Brilliant!!! Why didn't I think of that! My problem started when I marched my ass wipe neighbor off the property after catching him snooping around when he thought we were all gone somewhere. Bastard thinks he can go where he damn well pleases. I put his ass in the street and told him not to come back without an invite. I guess I should have been a little more forceful. He's been using the county codes guy to harass me ever since. I should have filed for a restraining order after the first call. After all, he's the one who snoops around trespassing on other people's property and he's the one harassing me. Damn, that's just brilliant!

    I'd buy a large amount of drugs, bag it for sale, hide it in his garage, and call the police on him for selling drugs.

    I am so glad I live next to a cemetary. Best neighbors you can ever have. They don't complain much.

    It's crazy that so many people want to live in a 'crackerbox neighborhood' where all the houses look the same. Living that close to so many people who all have their own opinions, is going to start some kind of problem somewhere. I live on a private drive(1/4 mile long) off of a dead end road. If anyone complains, I don't hear anything about it. And the one time they did when I bought the place....I shut them up quick by standing my ground. I bought it, it's mine, and no one is gonna tell me what I can do on it. So my way of helping you......... is man up, grow a set, and stand up for what is yours.......... period.

    have some friends with super ugly beater vehicles go park in front of the neighbors house for a couple days at a time. clean your guns on a folding table in the front yard. pour cat piss into the cabin air intake of their car, release some mice into the inteerior, etc.

    Actually that is a type of property encroachment, when an owner who allowed the neighbor to encroach on their property and didn't confront the situation and after a number of years of letting it go, it can or has become a permanent encroachment.

    Eminent Domain is when a municipality can force you to sell (in effect take for payment) your property because a planned or proposed use is better for the community than what you are using it for.
    Neither really applies to batshit neighbors :).

    MY TRUCK IS A TYPE "A" vehicle and the commercial catering truck would also be classifieds as an "a" neighbor never complains about his just mine police have actually come around to have me move the truck into my backyard if it waS AFTER 7 P.M. probably says i complied on the police report. funny thing is this neighbor has a $70,000 lien from the city for an illegal shed both mortagages on his house have been in foreclosure for a yr numerous other violations which the city refuses to write but my truck is the issue

    I despise them, but this is where housing associations do help...my $130.00 a month goes towards silencing morons like these through legal channels. Sicking the associations lawyers on clowns like this idiot can make them conform or move...or?
     
  22. If he has violations, report them, so much the better if you can quote chapter and verse the codes he's in violation of. Report it once a week or so until something's done about them. If he's that far in default he probably can't move if he wanted to.

    While you're at it, get the police reports, if there even are any, you might need them if you have to go to court, to show you've complied to the letter of the law, if not the spirit.

    I think I may be the only lawyer on this site (shhhh, don't tell anybody) and I also concentrate in real estate and land use. It's amusing reading the range of advice you got here, but unfortunately since I'm not licensed in your jurisdiction I really can't offer legal advice to you. I think the best advice posted above is to get down to the municipal offices and get copies of the codes and don't take anyone's word for it (either way) unless you read it on the official documents. If the guy files frivolous complaints, the town code enforcement officer will get wise to him pretty quick.

    Actually, this concept is called prescriptive easement. You are taking some property rights (in this case an access easement) by openly and notoriously driving across somebody's property. Eminent domain is when the city takes your property for the greater good of the community (they want to put a road through it).

    The term you are looking for is estoppel by laches. Estoppel is the premise whereby Person A (the city official you talked to) gives Person B (you) a reason to believe that you can do something...and whereby Person A cannot later to his/her benefit deny these facts stating that the action was inproper.

    Laches is a legal term that states that a person who takes too long to assert a legal right they had (code enforcement of certain vehicles) lose their right to entitlement or compensation.

    The two terms in combinaton is used to defend/address zoning issues where you think you have the right to do something based on information you receive, you engage in that activity for some long length of time with the city knowing you are doing it, and they fail to act to stop you.

    The trouble with this is proving that you were told something by somebody and whether the city failed in an obligation to enforce. Without a paper trail or specific names, times you called and who told you what, you have a big uphill battle. You might want to sit down with an attorney and discuss options...

    The only time I have seen this successfully used is when citations or nastygram letters were issued by city officials and then they fail to follow up. That is hard evidence. Still requires court action to fight any subsequent enforcement unless they voluntarily back down.

    One big lesson with cities, always obtain statements in writing if possible. Always get the names of individuals that give you information. It works in your defense later on.

    I DO NOT POST VERY OFTEN SO HERE I GO AND STRICK MY FOOT IN MY MOUTH. I AM A BUILDING INSPECTOR/ PLANS EXAMINER FOR A COUNTY IN OREGON :eek:

    With the down turn in building I am doing code enforcement. Not the thing I like to do, but it is a job. On to the problem, go to (in my County it is land development) who ever enforces the codes for your problem. <O:p

    Find out what is allowed. It sounds like the inspector is just as tired of coming out to your place as you are of hearing from him. All complaints have to be look into so look at your crazy next door crazy person. As long as you are inside the rules go get a lawyer and find out what can be done to stop this nutcase. (I hate lawyers but what can a person do unless you want to spend hours reading very dry codes) :eek:

    This is one of the big problems I run into no one wants to work things out, just complain to who ever. In my County for example you can have five cars with one that does not run outside. Under cover the sky is the limit to how many you can have. Even the outside rule there is a way to get around it. Move them every 48 hours and you can have all you want. :D

    Each area is different so go find out where you stand and ask question, if I did this or that? In my area I try and work with anyone who does not act like the ground he walks on loves him and the other thing is that the person has to like old cars. I am always on the look out for that special one. There are out there, but the person does not want to sell because someday he will get to it, yea after 20 years. Nutcases all around us! :(

    Make yourself well informed, I have a similar situation that has been tied up for three years. Check your states law on harrasment. Although mine has made a million complaints it is actually covered under Delawares stalking laws.

    Not to take it off track too much but where are you in Hollywood? my father in law owns Toucan's Bar&Grille right on the beach. Just seeing if you've been there or if I know where you're at.
     
  29. 59 Brook: This is no answer, but to EVERYONE I highly suggest you invest in ARAG legal insurance...I use it through my day-job and pay about $30 a month for the full services of my lawyer. It does not cover your lawyer's travel, copies, and some misc. fees, but it does cover 90% of the normal fees your lawyer will bill you for. It has saved me over $5000 over the last 5-6 years of using the service. Get it...

    It is better to NOT go out of your way to make trouble!!!

    The "city" is just doing their job. Be respectful to any "city" official that comes out and work with them to find a solution to your issue...

    If your neighbor is a nut bag then that will become clear in time and he/she will not get the reaction that he/she is looking for...

    I have one neighbor that is not pleasant to live next to. I "KILL" her with kindness and do my best to appease her "ISSUES" to the best of my ability. It is clear to the whole neighborhood that she is a nut bag and I believe it is more difficult for her to live in the neighborhood than it is for me to deal with her...

    If your neighbor is in a bad financial way with the "city" and his mortgage company it is only a matter of time before he/she is gone...

    Until that day hang in there...
