OT Ebay auction - can this guy sue me?

    donorbone, let me be the first to say!! i feel like a shit head!!! should always know both sides to a story before comment... very sorry to hear about your son.. i work in the public everyday and all my employees are women.. theres 10 sides to every story they have so i learned to block it out;) just kidding ladies.[sorta]. anyway, that will learn me to type before i think.. once again SORRY!!! poorboy, anything to add??? were you pulling our chains here or what??? by the way donorbone, keep your 78 average and perfect waters... give me bone shattering cold and salt rusted rides anyday:D :D breeder

    First off sorry to hear about your son, that is terrible.


    I dont feel like i have to defend myself here, because anyone who has followed this knows the story and has seen the auction listing. Speaks for itself. I never pulled anyones chains, the facts are all here and they dont lie. I only write because I cant help but to add my two cents. The things that donorbone continues to bitch about (the fact I wouldnt accept a wire transfer, or use an escrow company) mean nothing. the auction stated bank check in 10 days. Couldnt be more obvious. It all really means nothing after the fact. As far as the other complaints.............

    There are two sides to every story, and he gave me a list of stuff that was unsafe from the shop he broght the truck too. This included.
    floor unsafe, rear axle not centered, radius bar mounts not even, front axle caster/ camber not correct, frame unsafe, loose radiator mounts and the list goes on. totally unsafe. (his words)
    I have my doubts that all of this was corrected prior to the sale, and The only thing you changed from my auction listing was the fact that it is a 32 ford frame. (big fucking deal, quit acting like a duece frame is worth shit) How come you didnt disclose the list of stuff the rod shop said needed to get fixed????? Im sure you didnt pay for all of it to be done. If you want to talk about being honest then why didnt you include this information in the auction. You used my description (the one you said was total lies) to resell the truck. I guess it couldnt have been that far from the truth if you decided to use it. Its one thing for me not to know some of these things, but its another to be told them by a professional, and then be dishonest in the auction listing. I posted this issue here to get the opinion of some fellow rodders on the sale of this truck, from an ethical and legal standpoint. No one thought that it was an unfare deal, and im sure the people bidding on the truck once you relisted it will agree.

    Why dont you go buy another Viper or Beamer, and leave the hot rods to guys who enjoy working on their rides. Its obvious you dont because you wouldnt even throw some seat belts and turn signals on this truck, and your bitchin about 6 bucks in spark plugs!!!! Lesson learned on both our parts here. Only thing is yours costed you $$$$, and dented your pride.

    poorboy is a username here not a description of who I am. Although my boat is an 86' and my New(2001) truck has 136,000 miles, my 30 ford is a body shell now, and im really rollin in dough. Good call, and another great attempt to drag my name throught the mud.

    Im not going to argue this issue on this board for the rest of my life. Feel free to send me another PM about my guilty consceice. I think I might just pull up all the emails from you telling me how terrible the truck is and all the problems, and forward them ALL to the guy you sold the truck to on ebay. Japan right, thats a hike. He might want to ask you why you didnt disclose this to him prior to the sale??????

    To everyone else on the board thanks for the advice, and dont let this bad story turn you away from this hobby, cause im not losing intrest, and im heading back to the shop right now. I love this board, and its the greatest resourse I use, however its not a place for whiners like donorbone.

    Donerbone, Sorry for your son, and we all understand the need to resell the truck to cover med bills and such, BUT! Poorboy's auction description of the truck was good in covering all he knew about the vehicle, { apperantly so much so that you practicly copy and pasted the whole auction and pictures for your own auction}, including the I did this,first person descriptions, you did not even allude to the fact that you did not do anything to it except for your little disclaimer at the end of the auction. The action said as is, just like your own, you bought it as is end of story, take your losses like anyone else would and move on.

    END OF STORY!!!!!!!!!!!!!!!!!!!
     
  6. Well at least I was man enough to admit my mistakes and take my losses and not sit around and post over a 100 messages because I had a guilty conscience. You lied to all your friends here about being sued, for sympathy. Legal stand point my ass, you dragged my name & rep thru the mud to ease your paranoid guilt as soon as you heard ebay wanted the cops & Feds involved. I don't think that they would go out on a limb like that if they didn't think misrepresentation of the model year wasn't a big deal. But like everyone here says, Reconstructed Title & "AS-IS". So I never contacted you again, shit happened with my son and I moved on, made a decision & sold it and will take my losses. Your just pissed off cause you didn't get the $19K you were dreaming about getting for it. Remember, I asked if you had a "Buy it Now" and you said no. "it's gonna sit at my opening bid for a week and then, then there's gonna be a bidding war & then at the last 30 seconds, someone's gonna hit it for $19K." Sound familiar? But I hit it at the last few seconds and you all call me a snipe? At least my hypocracy only goes so far!

    So I left it alone, one of you contacted me. I have your full name & email address, but that's not my style. Such things are very simple to get.

    After this, how many of you would really deal with me in the future if & when I decide to start another project? Too bad none of you, except one, really saw it. You can read a description all day long and see photos of, but up close & in person is a whole other issue. That's the point I came here to make.

    It just amazes me how so many have such a strong opinion on something they have never seen themselves in person. Any of you actually know Rob personally? Talk to him on the phone, would vouch for him in a court of law?Like I said, I know what "AS-IS" means and I'll take my losses. As for threats, go ahead and email the buyer & break this deal for me, then you do leave yourself wide open to a lawsuit.

    Again, I do work on my own and have my own tools, I had time limits to deal with and he was coming home. I wanted it done before Christmas, less than 3 weeks. No Beamers, don't know where you got that one? Another one of your lies or made up fantasies. Still can't explain how the plugs got broke off at the head can you? I didn't bitch or whine about no escrow co.'s or inspection, I just stated the fact that you refused them and you blew me off until after T-Day cause you were conveniently out of town. Remember, your way or no way & you all bitched and said I didn't have a leg to stand on because I didn't ask for such things.

    And for the last time, the truck wasn't here. I stated, described to you as it was to me. I changed the chassis year & and a few details & left it at that.
    If you all thinks it's so great, then what's the problem? Oh that's right, none of you actually saw it, none of you actually paid your money for it, but all of you have an opinion, one of the last free things in this country just like spell check!

    So, as soon as Japan says he isn't paying because someone emailed him this, I'll be on the phone to my attorney. Remember, ex-cop, I know the law!;) Anyone want to drop by or call, please feel free to PM me, we can meet and I'll show you the real photos and video.

    First, Donorbone's son being injured is a tragedy we all feel sorrow for. Whether we agree with the war or not, every soul on this board supports,respects and is grateful to the men and women offering their lives for us.

    That being said and as unfortunate as it is, it really has nothing to do with this situation. Poorboy69 offered a car for sale,AS IS, told what he knew about it, said how he'd want to be paid. Donorbone had ample opportunity to ask questions, get photos, find out if it possessed the safety equipment required by his state-and didn't do it.

    I am also concerned that when the car was re-posted, Donorbone did not list the problems he now knew existed with his car. How is this honorable-Poorboy maybe was in ignorant bliss,but it appears Donorbone intentionally hid the defects he knew about-how did this happen,Donorbone?

    Thing is,the car itself,defects included, seems to be about what a $12K car
    should be. Mine was,my buddy's was. We got running vehicles with lots of problems and things to work on. Donorbone,you may not have gotten the car you wanted,but I've yet to see any single person,in what's now a very long post,say the car wasn't worth what you paid for it.

    Time to move on.

    It still amazes me the amount of money changing hands on ebay....with just a few pics and some text to sort out the transaction. If you buy on ebay, the bottom line is this......Check it out as good as you can.....send the money....then, live with your decision. If you can't live by these rules, don't buy anything from ebay....pretty simple.

As for the sob story if it's true that's a shame but it has no bearing on this transaction and was inserted for sympathy purposes. GET OVER IT you fucked up. There are thousands of hot rods out there and if you thought he was being dis-honest from the get go by not allowing you to fly out and look at it then sir you are the Idiot here for buying it.
     
  10. It amazes me the amount of ignorance & arrogance spoken here. I had a beef over the year of the frame, I corrected that in my auction. The rest is BS! $10K was for a new frame with the drive train, suspension and cab mounted, nothing else. What part don't any of you get? I did all that was asked by Poorboy, requested pics, asked questions, offered to fly out, independant inspection, you name it, I did it.

    Can any of you honestly say that this is a '34 frame not a '32 from the pics? Especially when it's channeled! I don't fucking think so and if you do you're a liar! As for using alot of his description, again, wasn't here, didn't have time to use my own & try & remember all the little details, did the best I could under my current stressful situation. Can't understand something as simple as that, too bad!

    So talk all the shit you want, but Mr. Hot Rod expert welder himself, you know the guy here who built it but couldn't even tell the difference, didn't know there was a difference! Mounted the bed himself but never noticed the rear end was off center, come on! How much BS you gonna fall for? Ever heard of common sense?

    Even if I flew out, I still bought it & was obligated according to eBay, so what's the fucking difference? And for all you book lovers, Donorbone's a medical term, look it up! So put the Hot Rod magazine down, get your dicks out of yours hands and use your brains for once. Assnine is spelled ASSININE, heard of spell check Einstein? Look that one up too.
