Scrappage Bill In Ohio We Need Hamber Help

  1. Be sure to post some signs at the borders reading "Welcome to The People's Republic of Ohio"... and like I said before, get the sponsor out of office.. rumor campaigns, mass e-mail, push-polling (the ones where they call up and ask questions about nasty rumors about his opposition)... just pretend you're with the Clinton campaign and use all their dirty tricks.

    And someone's going to have to have to sacrifice a parts car and take the state to court if the law's going to change. If they do this with no due process it shouldn't be too hard to get it thrown out, but it's going to cost a lot of money.

    Is this the law that lets city officials tow your cars even if they are out of sight behind your 6' privacy fence?

    I'll never understand how these laws are allowed.
    "The right of the people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
    Fouth Amendment, United States Constitution.

    What's not clear there? What am I missing? It seems pretty clear to me.

    The sad part is, for the law to be reversed, some poor schlub has to fight it in court, at his expense. I guess that's how they do it...One out of how many tens of thousands has the cash to fight the state government in court?

    I hate to be so negative, but it seems to me that this country has been headed downhill rapidly for several years now. Watch the news for just one day and you'll be confronted with the fact that the Constitution means nothing to most of the folks in charge.

    i drive big truck and i avoid the state of ohio other than the toll road if i can help it, theres something funny in the water they are serving up at the capital i am sure of it. even though the truth is this happens all over, and isnt getting any better.
    whether its the guy who has a few rides he might get to or something that isnt getting "restored" is not the issue, i own it or not it dont matter, its the fact a piece of what ol tin can be scrounged up thats left is getting stolen right off the property a guy works n pays taxes for. good stuff is scrapped unknowingly everyday on one scale or another but this is mass murder. i wouldnt mind a little property with some spare parts on it myself, i would be furious to see a flatbed going down the road with some ol car collection and some ir-replaceable pieces of history on the back or stuff better than what we are piecing together knowing someone was just robbed blind and i am witness to a crime. probaly bound on a one way ticket for the great lake to be put on a ship for asia, what fat cat politician has his hands in that pocket. guess we are supposed to sit at home and do a new acceptable hobby like grow a herb garden n compost and pretend we dont beat off n our crap dont stink. just another way of telling us what we can n cant do to live up to other peoples standards, and ever being judged for what we choose to do and defines who we are. i dont believe they want us to think, just go on with the dilusions we are supposed to follow that comes out of our television set, the ol slide of hand and diverting our attention from the right and wrong for profit of the few as they rob us blind. about the best i can do since i do like politics, i just shake my head in shame. its just wrong.

  11. My neighbour down the street stopped me yesterday and asked if the bylaw officer paid me a visit...I said no and asked him why. Apparently the local bylaw has it in for him and he found out they had been in his yard while he was at work. They were taking pictures of his cars and boats and making lists.I,ll add he does have several camper trailers also. Most of the stuff is hidden behind a privacy fence. He contacted the local police OPP who informed him that they have absolutely no right to trespass to gain information.Its going to be interesting as my buddy is going to try and press harassment and trespassing charges against the bylaw officers.He also mentioned trying to gain a restraining order.Since I have 2 unplated cars I,ll be watching what goes on down the street.....

    Well, I am in the process of moving OUT of Ohio. It is the home of the freakin' Gestapo and I will be glad to be outta here.

    Personally I have never seen such a fucked-up and self-righteous collection of State government employees ANYWHERE. These people do not have the slightest respect for the personal rights of ANYONE. That includes the civil servants, the cops, and the legislators.

    I spoke at length personally on the phone with my state rep about this bill on three occasions. I expressed our views and offered several suggestions for making this bill more palatable. They were scoffed at and ignored. He voted in favor of this crap anyway and was NOT the slightest bit apologetic about it. His view was strictly about property values and nothing more. Typical party hack. He had no clue about the differences between junk and classic/collectable cars and could care less. Unless they were shiny new and in a garage they were eyesores and needed removing

    They are coming for our cars, and this is a SERIOUS loss for us.

    This really is not a surprise, I live in Massillon, it is so strict here that I got a warning delivered by the police for having my car outside of the garage for three hours. The cop showed up as I was finishing up helping a friend fix some stuff on his car. I put mine outside for more room to work on it. I got a citation stating I had 30 days to scrap it or hide it from view. Before this I got a letter two days before my Corvair's sticker expired that my unlicensed vehical had to leave. At the time it was insured and driven daily. Point is with it this bad now, if that Bill passes we are screwed.... Who ever wrote the Bill just didn't have anything better to do than to cause other people greif. I'm not for harbouring junk but I should be able to have something other than a new car in my driveway without it getting hauled away...

    If they are worried about property values why don't they do what they can to bring more good paying jobs into the states so people can afford to take care of their property and fix up these cars that they want to scrap. Another way to look at it. If you don't like the laws that are in place, put yourself in a situation to change them. Run for office in your area. You can start at the local level or move up to a state level.

    "(C)(1) In the case of a junk motor vehicle on private property, the board of township trustees may provide in the resolution for the removal of the vehicle not sooner than seven days after the board serves written notice of its intention to remove or cause the removal of the vehicle on the owner of the land and any holders of liens of record on the land."


    We already have laws like this in New York State. I'm not sure at a state level, how many days notice the minimum requirements are....but the law is there and the municipalities have the ability to make a local law that is no more restrictive than what the state allows them to do. Basically, if a municipality wants to make it 30 day notice, they can because it is less restrictive.

    Not all municipalities have chosen to adopt such laws and most of the ones that have adopted a law like this have a system where the offender is notified of the violation, allowed a certain time to comply with the law and if the offender is uncooperative, then he/she must appear in local court to explain his failure to comply. It is a "last resort" for the municipalities to go onto private property and actually bring it into compliance. The expense of performing the work is recorded and billed to the property owner. If the owner refuses to pay, then the costs are levied as a tax lien on the property.

    Most municipalities that are forced to use the law and have work or vehicle removal done on someone's property do not perform the work themselves. They sub-out the work to a contractor and sometimes "prevailing wages" and strict insurance requirements dictate that the price to be paid for some simple lawn mowing can be quite high.

    New York State also has a State "property maintenance code" which has been adopted on a state-wide level and is supposed to be enforced by each municipality. The State's code is in many cases, more restrictive than the local ones...but in some cases the local municipalities have gotten even more stringent laws passed. The State code states something like "storage of two or more junked/unregistered/etc.. motor vehicle on any premises is unlawful".
