Smashed my Sedan pretty good today....

    Hope everything checks out good with the doc. Ugly what happened to the sedan, but rods can be fixed/replaced.

    I agree with Rickybop- running headlights in the daytime may not be a bad idea, but he could paint his car screaming yellow, jack it up to ten feet tall, and put a strobelight on top, and it wouldn't make that other driver any less of a fucking moron. Nor any less at fault. Take her ins. co to the cleaners, and hope they pass it on to her in higher rates.

    One other thing- if any of you ever witness a crash, be sure to sign on as a witness. Wait until the npolice arrive and give your information to them. I witnessed one last month (surprisingly, something almost as stupid as what happened to Joe) I signed on as a witness, and I got contacted by an attorney for the guy who wasn't at fault last week. From the questions I was asked, it's pretty clear the shit the guy who was at fault is trying to say to take himself off the hot seat. Fortunately, I was able to refute a lot of it with what I saw.

    shes still at falt, making a u turn on a business district is not legal if not made in a left turn lane!
    22102. No person in a business district shall make a U-turn, except at an intersection, or on a divided highway where an opening has been provided in accordance with Section 21651. This turning movement shall be made as close as practicable to the extreme left-hand edge of the lanes moving in the driver's direction of travel immediately prior to the initiation of the turning movement, when more than one lane in the direction of travel is present.

    Thanks to all you guys. Doc says just banged up and ill hurt more in the morning. Thought I may have a slight fracture in my hand but thankfully nothing. The accident really is cut and dray as far as fault goes. Shes not even denying shes at fault. I have a witness also so at least that part of it looks like itll be fine.
    The downside of fixing it is that when they pay me off for the car they will probably label it with a salvage title so rebuilding it would require a new frame and another early title. I dont think id want a branded title on this thing. Not impossible at all, just a pain in the ass. I was starting to get all my projects wrapped up. Yeah theres stuff I wanted to change and now is definately the time.
    Again, thanks to all of you. It could have been a hell of a lot worse.
    And for interests sake, the road is 6 lanes wide with a double double yellow center lane and she made the u turn from the far right lane across 2 other same direction lanes. What are some people thinking....or not thinking as in this case.

    Oh and I forgot to mention that the frame is twisted so badly the driveshaft fell out of the trans. lol WOOHOO!

  16. Hope you at least got a tc report and the copper cited her for improper turning movement. U-turn from the far right lane...yeah that's a good move right there...what a stupid idiot she is.
     
  17. Tell the insurance company you ABSOLUTELY WILL NOT ACCEPT A SALVAGE TITLE. DO NOT ACCEPT THEIR FIRST OFFER. TELL THEM YOU WANT EVERYTHING IN WRITING AND WILL ONLY CORRESPOND THROUGH EMAIL. this let's them know you are establishing a paper trail for a lawyer. DON"T LET THEM TOTAL IT.... It's actually your choice. Don't let them tell you what your car is worth. Get an appraisal and gather as many comparable vehicles in your area as you can. When they go to "compare" the value of your car to others they will try and find the lowest priced and worst examples of cars to try and value yours against. I can tell you exactly how to fight this. It will take a while, They are trying to get you to settle as low as possible. My OT 1979 ford f250 was recently hit. they value it at 1,500 and "totalled" it. I fought it. I had it appraised immediately after the accident @ $7,500.00. The truck ended up repaired without a salvage title. The repairs totaled around 6,800 dollars. That's a big difference! tell me it wasn't in there best interest to total my truck...

    Glad you are alright and good luck with the insurance company. Definitely try to get them to write a paper trail, as stated before, as it helps a lot to prove what they have said and offered. At least you are okay and not badly injured.

    But seriously, sorry about your loss, and not to hi-jack your thread, Ive had some crappy luck lately as well. Just last Friday My 50 Shoebox wich I hardly drive for this reason, got rear ended while I was already stopped at sign for about 20 seconds, waiting to make a left turn on the same street I live on out of all places, 30 seconds after I pulled out of my driveway, by a,.. lets just say non American, overweight lady who bearly spoke english. Make a long story short, not surprisingly turns out she was not covered driving the Dodge Ram wich completley missed my bumper and damaged my trunk area and frenched taillights... :mad:
    That explains why she didnt want to show me her insurance info, and called someone else to drive off in the Dodge when the cops arrived, (wich were supposed to cite her but didnt because they were in a hurry just like her apparently)
    They oughtta make driving a privilige not just anyone can get!!

    As a result I didnt waste any time and hired an attorney.. Gotta love driving old cars in So. Cal...
    The damage to my car is actually worse than the pics make it look if you see it in person..

  25. Get a lawyer ASAP, a real shyster if you can find one. Get the hand looked at CLOSELY. Insurance will pay out on fractures and broken bones in general, you get nothing for anything else. Play it up, this is your moment to cash in.

    On cell phones, I renew mine by email and the new one comes in the mail within a few days.

    Hitchiker is dead on. Don't accept their first offer. Tell them you may have to run it by an attorney friend of yours. Once they know you have an atty though, they won't talk to you.
    Get the appraisal from a vintage car appraiser so you can establish value, then get an estimate for the repairs from a Hot Rod shop. Swapping the frame, etc. at their hourly rate should= serious bucks. Even if you're capable of handling the repairs, look at the scenario with the mindset that a specialty shop will be doing all the repairs.
    Look to possibly go with a total if their offer is huge AND you keep the car. Like you said, a new frame and title, new front end (chromed this time?) and you'll be good to go. You'll have extra $ for chrome and other upgrades, especially if you can do most of the labor yourself.

    This is why insurance is expensive and always a fucked mess when a claim is made.An accident is not a license to steal or a lottery.........The OP here had his car wrecked by a careless driver.it was an accident.He has some injuries,doesn't sound serious at this point.Driving open wheel cars in modern traffic full of 5000 pound SUV's is risky,but no excuse for someone to ram you,but it can happen.
    His car needs to be repaired to the way it was before the accident.Or he must be given fair compensation if the car can't be repaired.His personal injuries need to be cared for.

    If you have my kind of luck, the insurance company will find you 40% at fault for not having a front bumper, which is why your car received so much damage (Insurance company logic, not mine). I hate insurance companies. Good luck.
