T Shirt Rip Off. Possibly PLEASE Help

    I understand both sides of this coin and I don't have a strong opinion either way. The only thing I know about the law is I have the right to remain silent.

    That said, we build, fab, customize, and paint these cars in to a work of art. Is it legal to go to a museum or art show take a picture of a painting and sell it on a t-shirt?

    You mean you have a sticker that says if you take a photo of the car you can only use it for your personal use?
     
  3. I believe you cant Copyright something that hasnt happened, I.e by putting the sticker there you are assuming any images are yours.
    Thats not correct its the image taker that owns any commercial copyright, and each and every image needs to be stated as such.

    You can assign non-release clause into a photographic or image contract, however if you take the car to a show youre not going to get every tom and joe to sign a contract!

    I can understand getting pissed that a business could use an image to portray as if it was their build.

    Protecting images so that its "owns" the front page of a magazine, wont work if the car is taken to a public show, or an image on a forum.
     
  4. My Merc has been used on a few things. I'm nobody famous,so I was honored to see it show up! The publicity is kinda cool! Now,if it was used in an ad for a company or product,you have a case. That's what a friend from a magazine told me,when I asked about my car showing up on a shirt and on a clock.

    This thread confirms that there are stupid people out there. To think that someone took a picture of your car and is using it to make money and somehow that is ripping you off or that it is a scam is just stupid.

    It's as simple as that. Just because you own a car does not give you exclusive rights to an image of it, or even a particular part of the design or construction details.

    Brains, or shall we say properly working brains seem to be in short supply these days. :D

    If you are so concerned with people taking pictures of your car for whatever use they want, then why not just leave it in the garage and wait till its finished and debut it on the cover of the magazine?

    How do you copyright a hot rod? Damn near every hot rod ever made is at least partially inspired by another hot rod.

    Agreed! Further more... if it is just a silhlouette of your car there is no way of proving that it is truely a depiction of your car... get over it!
