Im buying a car(1962) from a friend. Its a project, and it does have a ***le, but its changed hands a few times since it was last registered. The owner who last had it ***led did sign off on the ***le, but then another previous owner signed the ***le into his name, but then never had the ***le transfered into his name. 1. Can I get a bill of sale from the guy who signed it into his name, and take that and the ***le and get it directly into my name? <I hope thats what I can do... 2. Or will he have to go register it, then wait for the ***le, then sign it over to me? Or if its been a few years since its been registered is there anything stopping me from using one of those ***le services in NY or LA? Thanks, Cory
If you do a search on this topic you'll find about a hundred threads on it. I believe that you'll have to pay his sales taxes along with yours.
Fill out a "statement of fact" which you can pick up at any dealer or tax office. Explain that the transaction was not completed to the persons name who is listed as the buyer on the back of the ***le. Also state that the ***le has been corrected to show the actual buyer. Draw a single line through the buyers name and address on the back of the ***le and fill yours in right above it and change the sale date. Sign the statement of fact as the seller signed it on the back of the ***le. It does not need to be notorized. Make sure that all the sellers printed name and signature are exactly the same as on the front of the ***le. This happens all the time because some people don't want to pay the tax. So they never transfer the ***le into their name. In Texas, you will need a sellers donors traders avidavid (form 130U), the ***le, statement of fact and a current insurance card on anything you own. in california your situation would only require that you pay an extra registeration fee for the guy that didnt finish the paperwork plus your fees .mabe texas is similar.
Curtis- BIG THANKS man, I appreciate it. Thats exactly the kind of factual information I needed. Is the 130U form the one I always have to fill out when I transfer a ***le, or something diffrent? I know I could pay for the other guy to pay the tax, but thats a lot more money, a lot more time, and a whole lot more hasle than I want... Amen-I had done a search, but got the "Ive got no ***le..." kind of situations. If you know of one that has the kind of info Foghorn posted I sure didnt find it. Tampering with a ***le is very hard to do(probably like a check, at least how all but the very oldest ***les I see are), and can get someone in some real trouble(if its bothers the wrong person, or winds up on the wrong desk), so erasing it isnt an option for me(plus its in pen...). If it's a project and you don't have it running, you can do a ***le only. It costs another $15 I think but you dont' have to worry about a green sheet or insurance.
Cory, it's the same transfer form that you are used to. You can even download it online along with a statement of fact, from the Texas DOT website, under forms. Or, any tax office will have the paperwork. It really is a simple thing, just make sure you corrected the ***le by drawing a single line through the buyers name and signature on the back, and replacing the information right above with yours.
